Air signed us up as an affiliate partner in February for a cost of $100,000 with the promise that it was zero risk and, if after three months, we wished to opt out of our contract, we could do so without any issue whatsoever and receive a full refund. After fulfilling every aspect of our contract and contacting *** over 10 times in the last 7 days, we are getting no response. The *** software is not as advertised and it quickly became apparent it was not going to work for us. We did everything outlined in our agreement and would like a full refund as promised.

In April of 2023 I was growing my medical and dental billing company to consulting. When I spoke to a sales representative from this company, they assured me that this program was for absolute beginners and they would help me get the program set up, market it and then sell it right out of the gate. I was hesitant to invest $9800 initially because this was a new venture but I knew I needed coaching if I was going to grow. The sales rep just tells you what you want to hear. He said there is a money back guarantee so what do you have to lose. Well I followed to the program to a T, I went to the required calls and did the work. This program is absolutely NOT for beginners. If you have an established platform, I could see how it was beneficial. But for me and my situation, the program was not built for people like me who are wanting to get started, but know nothing about SAAS in the online sales space. I reached out to Air after the 6 months of doing the program and I said that I did the work, but I dont feel this was a good program for me and since I was promised a refund if I did everything, I would now like my refund. It has now been almost 9 month's since that confirmation email that I will in fact be getting a refund. The owner reached out personally and said they do not have the money. I have a signed contract saying I will get a refund and I have an email from the owner basically giving excuses. I emailed them today and they said I am number 22 in line to receive the refund. I was 27 in October of 2023. The business is unresponsive for any resolution of this refund and now because I have been waiting I have been paying interest on a loan I took out for this investment purpose. They did not deliver what was promised and I am pursuing a refund from here now.

This complaint is against Air.Ai (*******************) for misleading sales practices and unfulfilled promises, particularly concerning refund policies. I enrolled in AirAi's program based on ******** ads presented in February of 2023. Notably, the promised affiliate marketing program was non-existent during my course engagement. I was informed it would take an additional eight weeks to establishtime not accounted for in the original agreement.Additionally, they required further financial investment in ******** ads. ******************* kept this point secret during the initial sales discussions. This lack of transparency put me in a financially untenable position, as I had already invested $22,000 based on AirAi's representations. I would not have signed up for the course if I knew that I would need to invest further dollars to achieve my goals.AirAi is backed by the industry's boldest guarantee: "Within six months of joining the program (the 'Starting Term'), the Client will have used AirAi to generate revenue equal to double or more of the initial cost of the Air Access Card. If not, the Client will have the option to cancel their Air Access Card and forgo the Air platform upon which they will be refunded the full amount of their initial cost." I joined the program on March 1, 2023, under the account name of UnCeiling You, and then started the program in May. Despite this promise, my experience has yet to meet these guarantees. They refused to refund my initial costs. When I asked for a refund, the Air.Ai team refused, stating that I had not participated in the live sessions. However, I had informed them beforehand that I had a full-time job and was never told that attending the live sessions was mandatory. Furthermore, this stipulation was not communicated in their terms of service.Given these facts, I urge the BBB to investigate these practices. I seek a full refund of $22,000 from AirAi and an assurance of better service transparency for future customers.

On 12/19/2023, I paid $13,500 for 300 appointments using Air.AIs robocalling services. They were to book me 100 appointments per month using leads I would provide. I told the salesmen from the beginning my intent was to purchase homeowner lists for the bots to convert into appointments, and I would need it up and running quickly, as I was maxing out 3 credit cards to pay for the service. After a month and a half, on 1/31/24, I received a text saying the leads had to have specifically opted in for robocalls, none of the leads I had to provide had done. Had I known that, I wouldnt have signed on for the services in the first place, as it would have been cost prohibitive for me. I told them my leads hadnt opted in. They said they were working through everyone, and that they would get it forwarded it to the proper department. On 2/1/24, I asked how long the refund process would take? *****, the respresentative I was in communication with, responded on 2/2/24 and said he forwarded the information to the proper department again. On 2/7/24, after not hearing anything, I told them if I didnt receive my refund by 2/15/24, I would be disputing the charges with the credit card companies. He said thanks for letting me know. On 2/29/24, still no refund, I disputed the charges. The merchant responded to the disputes. They are attempting to keep my money when they said they would issue a full refund and havent delivered any services. My Apple Card ruled in my favor, but my *********** cards its unclear. The entire time, the communication was lacking, going days between responses. All of my communication with them was done through text. In their contract, it states that a refund requires a wet signature by both parties. It also states that if they dont deliver within the timeframe, Im eligible for a refund on any unused appointments. Its been well over the 3 month time frame, zero appointments. I am beyond frustrated and ready to take them to court if need be.

My husband and I responded to an ad from Air.ai we saw on ******** and set up a call to learn more about the company. After several meetings and a lot of questions on our part, we unfortunately signed an agreement with them. The agreement stated that we would pay them $15,000 in exchange for their marketing and AI services to help generate business leads and find customers tailored to the services we were offering. They were very responsive during the sales process, but once we signed, we did not hear from them. We have reached out numerous times and have not received any sort of response. Part of the agreement was that if they did not double our investment in the first 6 months, we would get 100% of our money back, guaranteed. It has now been 7 months and we have not earned a dime, nor have we received our money back.

Air AI agreed to cancel and refund $30,000. They did not perform services as agreed. They sent an email confirming they would process a refund but when we disputed the charge with our credit card company they refused to refund

In summary, I (*********************, ****************** LLC, the Consumer) paid $50,000 to Air Ai which operates as Apex Scaling, LLC, Arizona entity number ******** (formerly registered as Air Ai LLC and Air Ai ****************** Arizona entity number ********) for an ********** License. The product did not deliver as promised, and after multiple attempts to resolve the issue with the Company were unsuccessful, I requested a refund per the terms of the Agreement that was signed as part of the purchase. The Company and its representatives (owners) have repeatedly given me the runaround and as of the date of this submission, have failed to issue my refund, although they have acknowledged that I am owed a refund in full.I have been more than fair and this company and its owners have continued to take advantage of me throughout this situation. This has cost me far more than $50,000 when you consider the time and opportunity cost I have lost since September of 2023 when this ordeal began. Throughout this ordeal, I have encountered several other consumers in similar situations, and have become aware that this is a recurring issue with this company (as well as the multiple other entities that they own(ed) and operate(d) from in the State of Arizona over the past several years). It is unfortunate that they feel they can continue to take advantage of consumers worldwide, not just violating the terms of their own Agreements but also Arizona Consumer Protection and Telemarketing laws as well as FTC regulations. It is extremely unfortunate that this has continued for so long, and I am hopeful you will be able to help resolve this matter, and obtain my refund of $50,000.Full Explanation: *************************************************************************

Following our attempts to resolve this matter, you, *************************, one of the founders of Air LLC, communicated via email the intent to refund the total amount. In this correspondence, you requested our wire information. You proposed a payment plan due to your current fundraising activities, suggesting an initial payment of $4,500 followed by two additional payments in the same amount at four-week intervals. We have acted in good faith, awaiting the promised refund, yet we find ourselves compelled to escalate this matter due to the lack of follow-through on your part. If the full refund of $13,500 is not processed and confirmed received by Aegisbyte LLC within 48 hours of receiving this letter, we will have no choice but to seek legal recourse to recover the owed amount. This letter serves as a final warning before we initiate legal proceedings against Air LLC and any involved parties for the recovery of the total amount, in addition to any applicable damages and legal fees.
