    On March 28, 2024, I paid Adesso Capital a 20% processing fee, totaling $1,787 for accounting services to file amended tax returns to the *** for years 2020 and 2021 for FFRCA funds (pandemic relief for self-employed 1099 workers). In September 2024, I received a letter from the *** stating my amended return for the year 2020 was denied, because Adesso had filed too late, past the 3 year filing deadline set by the ***. I called the *** when I received the letter to confirm it's legitimacy. I reached out to Adesso via email several times, and was told I would receive a refund within 5-7 business days per the policy on their website which states "If you do not receive your tax credit for any reason, we will reimburse you any fees paid." My emails went ignored for months. Finally, I got in touch of their director of operations (****** ******) who asked me to call the *** again to verify the letter because it showed the year 2023 (which I did), and confirmed it is correct, my 2020 amended return was in fact denied, and the *** had a typo on the letter... However, the letter verbiage states it is for 2020 and Adesso filed too late. ****** and others at Adesso have ignored all communications, I have reached out several times with evidence that my claim is denied, I have told them to verify with the *** themselves and they have continued to ignore me. I am entitled to at least a partial refund for the year 2020 in which they filed my amended claim too late.

    Please help me!!In May 2023, Adesso started my paperwork for the ***** money that would be available to Cosmetologists for Covid relief. I paid upfront $1678.00 to have my 2020 and 2021 tax returns amended so the credit could be processed. The *** received this paperwork on Oct, 23, 2023 and it still cannot be processed. The *** wants me to give them the amended tax returns amounts for verification, but Adesso has failed to send me a copy of 2020. I have repeatedly emailed them but they still have not sent me 2020. My 2021 amended return has errors on it and I dont know if that will delay it when the *** tries to finally process it. I have reached out to my local county representative to see if they can help me. They in turn have reached out to my local tax advocate to see if they can view my amended return amounts, just so I can talk to the ***. And here I am, still waiting! Adesso is incompetent and I feel they sold everyone a lie about getting this relief money. Because after a year and a half of waiting on it, my business could use this money to help pay bills.

    I had Adesso 360 amend my 2020 and 2021 taxes for the ****** My 2021 was submitted and accepted by the *** on March 18th. I asked many times about my 2020 taxes and they said it had to be filed and mailed to the ***, that they would not accept it electronically for that year. They said I would have the papers the next week. That was at the end of March. I sent multiple emails after that with no response. The *********************************************************************** a response from them. There is no number on their website to call them. I paid them over $3000 and did not receive the services I paid for,

    Negligence and abandonment of services rendered in the contract.It came to our attention that Encore Capital Finance, **** (DBA of Adesso) rendered our services to the *** for the Employer Retention Credit (***), and the company was paid in full for their services or lack thereof. Included are the historical events and communication with this company since we first hired them to assist us with this process. Months passed and we were never notified about the communication with Encore and the ***, and were not aware that several dates in the documents sent to the *** were inconclusive. The only reason we were informed that the documents were not correct was that the *** sent our company, Jalapenos, a letter in September letting us know about our *** status. When I spoke with our **** ******************************** he mentioned that everything was okay and there was nothing to worry about. We kept receiving more letters from the ***, and ***** kept mentioning that everything was ok. It was not until I started doing my own research and noticed the document dates were incorrect, and nothing was finalized with the ***. On December 6, I spoke with ***** again, and he mentioned if I wanted the errors fixed I could contact the *** myself (see attached text doc). This is the reason why this company was hired, if we didn't need the help I would have ever sought out their services.Research:When we spoke to the ***, an Enrolled Agent (EA) told us that the original form 941 was missing therefore the *** credit was not granted. Encore should have notified me that this was missing. The EA agent mentioned that due to the lack of response to the *** and being over 30 days since the letters were sent out, we would need to start the whole *** credit process again. (see *** Letters Attached) As a small business this credit is a necessity and to date this credit has been canceled. We are seeking a refund of $11,432.61 for services not rendered, this company took advantage of our situation.

We are confident that we have remained committed to the process, and have fulfilled our promise of service without any deviation.     Thank you so much for your attention on my complaint to Adesso capital, 

    I would like to start by saying that we are not in any way accepting the response of Adesso capital to our complain, I will list a few point to explain our disagreement,

    Adesso capital did not gave any arguments of explanation not to ***** our petition of the refund,
    As far of getting the service promised from them, to this day we have not got any type of explanation about the *** process. We are still not sure where exactly are we on the steps to getting our process accomplish.   

    As a third point, we have not seen any satisfactory results on the *** process nor have we got the founds from the ***, they have not fulfilled the services that they promised to do to obtain the ***. We are still uncertain if the process is still valid or if it has been canceled by the IRS. 

    Due to this points we do not agree with the resolution from Adesso capital to this complaint. 

    In regards to the time given to us to responde to the letter from 06/21/2023 to agree or disagree with the resolution, we would like to comment the following;

    We were given 5 calendar days to reply to Adesso capital response, at the moment of this email we still have a few hours to reply.
    We would like to notate that there is not equality on the times given to Adesso Capital and the time we were given, since we have waited more that double the time we were given to reply. 

    We are formally requesting to keep this case open in order to resolve the matter, please consider the comments we have provided on this letter since we have been on time on all the process.

    Firstly, we understand your concerns about the perceived lack of clarity surrounding the *** process. Our goal is to ensure our clients are well-informed and confident in our procedures. It seems that we did not meet your expectations in this area, and for that, we apologize. Our commitment is to consistently deliver precise and timely information at every stage.
     
    Regarding the outcome and progress of the *** process, we recognize and empathize with your concerns. We strictly adhere to established protocols and deadlines to ensure the smooth progression of each claim. However, certain aspects of the *** process, such as decisions from the **** are beyond our control.

    On the matter of response timeframes, we acknowledge your perspective on the perceived disparity. It was never our intention to make you feel rushed or that there was an imbalance in the process. Your feedback is invaluable to us, and we will always strive to ensure a balanced dialogue.

    However, regarding the fee refund: we genuinely believe we've met our obligations as per our agreement. As such, we won't be issuing a refund for the fee portion. While we respect your viewpoint, from our perspective, we've upheld our commitments throughout the process. We discussed the filing and resolutions at length but to no resolve.

    Thank you for your comments on your response, we take your time and response very seriously, although we understand your point of view about the situation, we are not satisfied, and we do not agree with you decision.

    With all respect there are factors that are not being taken to consideration such as the promises given in our agreement.

    We differ very much from your concept of service to mention one example, as of today we still do not have an explanation, status or step of the *** process, farther more, we have not had the service mentioned to understand the process Adesso is currently conducting.

    We thank you very much for your response, although we try to understand your point of view about the situation, we would like to comment that, we feel that we have not got the service promised on the *** process and we do not agree with your conclusion and response. We see factors that have been overseeing and that were not followed up.

    We will be including more information about our difference of opinions. Due to our difficult schedule, it is hard to communicate in a speedy manner. We ask for your support and understanding.
