    Dear ****** ********,
We have received the letter on the complaint Mr. ******** *****-***** has filed on our school. Mr. ***** is claiming he didn’t received training, we did not notified him about moving locations and he would like a refund. Mr. ***** enrolled 7/19/22 and started school 7/27/22. He paid $3500 for 160 hours of training, 2 times a week. He first paid $2800 and had a balance of $700. When he initially attended class, we gave him the training he needed to acquire his driving permit. Once he had his permit, we gave him the training for the actual license. Mr. ***** stopped attending class for a certain time and he knew the hours would still count as stated on the contract that he signed. When we moved locations we notified every student, if Mr. ***** is claiming that we did not notify our students our class would have been empty. We had every student accounted for besides him after the move. After we have moved Mr. ***** did show up to our new location and we continued with his training. Mr. ***** had a balance to pay of $700, when Mr. ***** paid the balance we explained to him he only had 8 days (40 hours) of training left. Mr. ***** understood the balance of his hours and continued the training. Mr. ***** had 20 hours of training left as of 10/31/22 his last day was schedule to be on 11/12/22 which would equal 160 hours of training, 2 days a week (10 hours a week). We never told Mr. ***** he was out of hours. However it came to our attention that Mr. ***** paid to go to a different school therefore his hours have been forfeited. We cannot issue a refund as it states in our contract. Mr. ***** knew of our policies for hours and refunds and he signed the contract by his own means. I will include a copy of his contract. If you have any further questions or concerns please contact me or my son, ****** ********* ###-###-####. Thank you.

I am rejecting this response because:

They should be some type of form showing the hours of attendance through some kind of documentation. All Mr ***** or **** are saying is here say but nothing supports what he is saying. He REFUSED to train me. He just took my $3500 and took advantage that I am a Spanish speaker and he refuses to train me or give me a full refund. He took my money under false pretenses and he refuses to resolve this matter. That's why I'm reaching out to bbb for help

Hello ******. I am responding to Mr. ****** response. He is now claiming we don’t have a attendance sheet and we didn’t train him. I have attached a picture of our excel sheet showing Mr. ****** attendance and hours. He is highlighted in yellow. Every time the students comes we put a date and hours of training. I also attached his contract where he agreed to come to class 2 days out of the week. In our contract we let our students know if they do not show up to class we will still count the hours as if they were here unless the students provide a medical note or a family emergency to excuse their absence. Mr. ***** failed to mention to you that he he didn’t show up for many weeks. When he did show up he had a balance to pay and he paid it willingly and continued his training. I have also attached a picture of our material that we give our students to study. We did not take advantage of Mr. ****** inability to speak English fluently. We advised Mr. ***** the training will be done in English and that is something we cannot change per the law in California requiring all drive test to be in English. We didn’t take his money, he paid for a service that was issued to him. Mr. ***** also dropped from our school and attended a different school as per our contract that he signed any student that drops will not receive further training or their money back. Thank you

I paid the business for truck driving school, 120 hours to be exact and 3 trips to the dmv. Upon my first trip to the DMV on August 19, 2022, I committed a mistake that caused a bit of damage to the tires. I went back to school the following Monday on August 22, 2022 hoping to come to a resolution on how I would help him pay and not only did he send me home but he demanded I pay him for the tires in full. Now the business is withholding my hours and trips to the DMV until I pay them what claim they “paid” for the tires which was $1400. There is no contract in which it states that we, the customers, have to pay for damages for his equipment. Not to mention I almost felt as if I was being extorted at that very moment. I told the business that I have no extra money as I have bills coming up and they basically said then it’s over. All I’m looking for is to get my three trips to the DMV and my full hour's worth, the school itself wasn’t cheap, it was $2500. And if the business isn’t willing then I’d like to see which other routes I can take. Attached are both and the only contracts that the business makes you sign upon starting.

Hello ******, my name is **** from On The Move Trucking School, we have another compliant from a student and I am responding to that complaint. Mr. ******** is claiming we are withholding training hours from him and also that we are charging him for damages to our truck. Mr. ******** paid $2500 for 120 hours of training and 3 opportunities to test for his license. Mr. ******** started on 7/18/2022 his last day was 8/19/2022. 120 training hours is equivalent to 4 weeks and 4 days or 24 days. His schedule was from Monday to Friday from 8:00 a.m. to 2:00 p.m., 5 hours per day, 25 hours per week. We are finished with his training hours. Mr. ******** damaged our truck by not releasing the brakes and drove on a major street dragging the tires. This caused extensive damages to 4 of the trailers tires. The threading of the tires was completely removed leaving the tire bare. We cannot operate the truck with tires in that condition so we had to fix them. Just like any school or training if the student damages the equipment they will be responsible. We paid $1400 to replace all 4 tires, we told Mr. ******** he would have to pay a portion of the damages he caused to our equipment. We told Mr. ******** he would have to pay $800. He believes we need to take him to the DMV 2 more times per the contract however we spoke to the supervisor from the DMV and she said Mr. ********** mistake of not releasing the brakes is a danger to himself and the other drivers on the road. We cannot risk any more damages to our equipment but more importantly the safety of Mr. ******** or other motorist/pedestrians out on the road. If Mr. ******** would like to continue his training he would have to pay $800 for the damages plus more training hours to ensure he does not commit another mistake that can cause harm. We also do not offer refunds once training begins and Mr. ******** signed the contract where it is stated. We are trying to be fair with Mr. ******** and not charge him the total of $1400 but he needs to be responsible for the damages he caused to our vehicle. If you have further questions about this complaint please feel free to contact my self at ###-###-#### or my father ***** at ###-###-####. I will send the copies of the contract and the receipt for the tires.
