      Community Property Management used a palm tree on our patio to retaliate against us three times for requesting repairs as a homeowner in good standing. The first incident occurred on 04/13/17, after we appealed a charge from North Star Roofing for services that we did not receive. CPM followed up with a palm tree violation on 11/16/2017. January 23, 2020, we reported to CPM that someone broke into our mailbox and received a palm tree violation on 02/03/2020. On 08/22/24, we reported cracks in the stucco on an exterior wall that required patching, and there is a tree owned by CPM in our front yard with roots clearly growing under that wall. Although it appears it is their tree causing the damage, they sent an employee to find a violation on our patio and followed up with an order to have our palm tree removed on 9/17/24 at our expense, clearly ignoring the tree that they own causing the damage. The palm tree was here when we moved in more than twenty years ago, there have never been any complaints from other owners about the tree and there is no damage to the property near our tree. This has become a pattern of retaliation, harassment, and selective enforcement of the CC&R’s. For this reason, CPM is in breach of contract when the management company’s responsibility is to ensure the owner’s quiet enjoyment of the home. CPM does not appear to find us in violation unless we contact them first to report an issue. We have RING video evidence of an HOA employee looking for violations on our patio. CPM is trying to force my wife and I to move out through a documented pattern of harassment. I contacted Tami C. of CPM years ago to express my concerns, and was told, “This is community living. If you don’t like it, maybe you should go somewhere.” Removing this tree will present a financial hardship that I believe the Association should assist with, but I believe by causing a financial hardship, they hope to put a lien against my property.

      This property management company refuses to assist with my concerns. They either ignore issues I bring up that need to be resolved, or just respond with some crazy excuses such as: They cut down my 7 feet privacy bushes to the stubs. When I asked them to replace those in order to return the property look to the way I purchased this property, they replied with: "these bushes will spruce back up before summer (in the next 4 months!)" . I've spoke to a dozen of gardners and even a 6 year old will know that dead stubs can't spruce back up into bushes!!. Other outrageous replies by the dozen. They collect fees from me every month but refuse to provide service. Refused to provided debris cleaning when common area trees fell on my property and many other incidents.
