Toyota of Clovis, a Penske Automotive Company, advertises online on autotrader.com as well as *******************************************. I want to buy a 2007 Tahoe advertised online. I have offered the full asking price of $14,900 plus $1,214 to cover taxes and title fees for my zip code for a total of $16,114. I have offered $1,000 to be charged to my **** credit card with a cashier's check for the remaining amount when I come to Clovis to pick up my vehicle. ***** person I initially contacted was not aware of issue re: out of state. See email attached. I was referred to the Gen ***** Mgr who told that Toyota of Clovis does not sell to out of state customers due to past issues in filing paperwork. There is no written policy. I am a ******* resident. I went through the entire Toyota of Clovis's own SmartPath process of buying a car online. I set up a SmartPath account online and answered all questions honestly. My full price offer was accepted even after my Georgia zip code was entered and the SmartPath system correctly added all the appropriate fees required by Georgia, thus proving that the their computer system was intended for sales outside of **********. However, the State of Georgia allows me to pay taxes, tag and title fees, etc. here locally. The dealer need only give me the title and a bill of sale. I assume there is a reciprocity agreement between our two states. If there are any specific fees California requires that cannot be waived, we can discuss adding them to the sales price. Toyota of Clovis does not indicate in any online advertising that they do not sell to out of state buyers. Absent any such disclaimer, which I believe they are legally bound to document, and given a full price offer and being accepted by the Seller's own SmartPath online process and my offer or $1,000 ******* money with the rest of the owed amount secured by a certified bank check hand delivered by me when when I come to pick up the vehicle, my offer should be honored.

Unfortunately, is has become too complicated to do business across state lines.  We have decided to avoid this type of transaction.  We apologize about any inconvenience this may have caused.

    Customer Answer

    Date: 05/21/2024

I am rejecting this response because:
    1.  In the absence of Toyota of Clovis  modifying their advertising in Autotrader.com to stipulate that the their offer to sell is limited to **********, their existing ad is a legal offer to sell to anyone responding to the Autotrader ad in any state.

    2.  In addition, their own SmartPath software is designed to allow the buyer to accept the purchase as advertised and  accepts out-of-state zip codes and correctly computes the tax and fees and demonstrates that their offer extends to other states.

    3.  Truth in advertising is NOT a disputable thing, it is a basic ***** of business.

We appreciate your interest in this vehicle, but it has become too complicated for us to do business across state lines.  We have decided to avoid this type of sale. We do apologize for any inconvenience this may have caused you.

There is no debt required to be paid to Toyota of Clovis nor is our business pursuing any payment.  However, you did submit a credit application to Toyota of Clovis which does allow us to do a credit inquiry.

**** ****, one of the finance manage told me that my personal check for $16,000.00 will be return to me via mail. I already gave him another check for the full amount of the purchase, for the 2022 Toyota Prius Prime. However, this did not happen. Toyota of Clovis end up cashing my personal check and my other check. This is very poor business practice and lack of attention to details. Someone somewhere in this process made this error and I want this business to pay for all my bank fees related to this transaction.

    Business Response

    Date: 08/15/2022

Toyota of Clovis sincerely apologizes for cashing both checks.  There was a breakdown in our communication regarding your personal check and the second check.  Our staff has been instructed to pay for any bank fees that are related to this transaction.
