On August 17 2022 we attend a time share seminar by invitation of FORZA CONSUMERGROUP - ************************************************* to listen a presentation in our state, how to be rid of our timeshare, after hearing about the perpetuity clause and how each timeshare owner will be slapped with a high maintenance fees from Vacation Village (this was a huge lie) my wife and me decided that we did not want to die and leave our children the debt of paying dues forever and ever. At that time, we were told that Vacation Village was on board (they made many phony calls) and we ended up signing and notarize a contract as requiered for MOLFETTA LAW, and *************** as intructed, and pay $ 7115.oo to do this. We thought we could trust a LAW firm to be truthful and above board. We were sadly mistaken. Then the waiting began. In April 22 2024 Molfetta Law tell us that we would have to pay $ 2000.oo to Less Time Closing **** in order to finalize the deal. We were so upset but we were told that if we did not cooperate they would not complete this contract. After many comunications we find the firm Less time clossing dont exist and the representative ***** ***** he had disappeared, and we send many letters to Molfetta Law claim for this and they don't reply and don't give us any solution to our claim. We have all contracts and comunication with this firms to support our claim This Is why we decide to request the help of your office to find a solution to this and have our $ ******* money back.Initial Complaint

We paid this law firm $8697.00 to help us terminate a timeshare with Hilton Vacation Rentals. In our contract we were guaranteed "work until resolved or a refund"upon request in 24 months. After requesting termination at the 2 year period via a registered letter, we received no response at all.Initial Complaint

In November 2022, I hired Molfetta Law to represent me in getting out of my Timeshare. I signed a ***, which is why I haven't filed a complaint - trying to trust the process and not wanting to get in trouble. In March 2023, I sent over $47,000 to Molfetta Law as requested as they said they would pay off my ********* account. After waiting patiently for over a year and emailing almost every employee listed on the ********************** website since they were not answering phone calls for months, I was able to speak to a receptionist who said Molfetta Law was still working on settling the case and it was a "priority" for Molfetta Law. At that time (June 2023) Mr. ********************** was supposed to be meeting with the Timeshare's legal team that week. It has been two full years since that date and I still have heard nothing from Molfetta Law nor can I get anyone to return a phone call. Meanwhile, my credit has tanked due to this issue which is affecting my overall standard of living. Also, the Timeshare keeps billing me with past due statements making me believe ********************** never gave them the $47k+.Initial Complaint

On March 8, 2023 I paid Molfetta Law almost $7,000 to get us out of our timeshare ownership. They claimed they would keep us up to date every step of the way. Two years later there has been no movement. As a matter of fact, we have been calling during their business hours, leaving messages and getting no responses. I just tried to get onto their client portal and I can no longer access my account with the company. To summarize, in two years after paying almost $7,000, and after getting almost no updates, and after not being able to reach anyone during business hours and leaving messages requesting a call back, we seem not to be able to even contact them further. I question where the business is still open or if they have fled with our money and the money of many other customers. Not being able to access ********************** through their client portal seems especially suspicious. We did not file a complaint earlier is because when we could get in touch with someone, they just said these things take time and they could reach out when they had something new to share. In other words, they just kept stringing us along. Now we cannot reach anyone by phone, email, or through their client portal.Initial Complaint

We were referred to Molfetta Law by ********************* and had to pay Molfetta Law $900 separately from the $4439 we had to pay ********************** Molfetta Law initially acted like they were working on our case and working with Bluegreen Vacations on exiting our timeshare. They had us fill out a lot of paperwork and send them our contract with *********. They set us up with a client portal that they claimed would give us a status of our case. This portal has never been updated with any status and any communication we have had with then has been us emailing them for an update. Four months in they sent us an update that they had been in litigation with Bluegreen since 2020 and were past the discovery phase. Three months after that we received a *** to fill out claiming there was a settlement. A year after, we had not been able to get any response from Molfetta other then they will contact us shortly with the details of the settlement. It has now been 6 months since then and there has been no response to emails asking for updates. At this point we just want our $900 refunded due to no services actually being fulfilled by Molfetta Law.Business Response

Thank you for sharing your concerns regarding your experience with Molfetta Law. We take all client feedback seriously and would like to provide clarity on the situation.
Upon your referral to Molfetta Law in 2022, we explained that your case was part of a larger ongoing litigation with Bluegreen Vacations, initiated well before your involvement. This complex case required additional time due to the involvement of outside attorneys and the unique nature of your contract. We communicated that the process would be delayed as a result, and we did our best to provide updates as we received them.
It is true that our client portal did not reflect real-time updates due to the non-traditional path of your cancellation. However, we ensured communication whenever we received significant developments. The settlement process was confidential, and while we were informed that your contract had been labeled "inactive," we took extra steps to confirm that your obligations were fully resolved. We wanted to ensure that you were no longer liable under the contract and attempted to obtain official documentation from Bluegreen confirming this. Unfortunately, Bluegreen did not provide the requested cancellation documentation, despite our best efforts.Nevertheless, we were able to issue an exit letter explaining that your contract had been successfully canceled based on the information we received. This was within the scope of the services we agreed to provide.
While we understand your frustration with the time frame and the communication delays, we want to clarify that Molfetta Law did fulfill its commitment to cancel your contract, which was the primary goal of our representation.
We regret that our communication was not as timely or thorough as you expected, and we apologize for any inconvenience this may have caused. However, as we successfully resolved your case, we do not believe a refund is appropriate, as we completed the services for which we were retained.

We contacted the ********************* (RAG) in February 2021 to help us get out of our timeshare. We paid them a fee and they set us up with Molfetta Law Group. We began working with them right away. *** had told us that "a lot of their clients" had stopped paying on their timeshare because it helped their case look better. So that's what we did. Finally, in January 2023, Molfetta Law said they reached a settlement. This whole two years I would always have to reach out to them or I never heard anything. So their settlement said if we paid ****** we could be out of our timeshare legally. They NEVER said it was a class action. On 3/1/23, *************************, the one who had called us, said once they receive the check (made out to Molfetta), it would be resolved in about ***** days. They received our papers on 3/22/23. Never heard anything from them. I had to email them to get updates in which they always said "progress was slow." They couldn't give a definitive answer. Finally in December '23, I said we wanted to cancel our settlement agreement and we wanted our $****** back, which ********* said we could do. She suggested it. ********* said they'd have to contact ******* and get our money back and she couldn't tell us when that would be. This is the current status. I always have to reach out to them to get any report and it's always the same answer "it's pending." Meanwhile our credit has taken massive hits bc they suggested to stop payment on the timeshare. I'm beginning to think this is all a big scam and I've lost ******. Even RAG said they had heard unsatisfied complaints so I don't know why they use them, except that maybe they're in on the scam also. I would like to report this group to protect anyone else from this mess AND I'd like our money backBusiness Response

Thank you for bringing your experience with ********************* (RAG) and Molfetta Law Group to our attention. We deeply regret any frustration or inconvenience you've encountered and appreciate your feedback, which is crucial for improving our services.
We want to clarify that the advice provided by RAG regarding stopping timeshare payments does not align with the typical counsel offered by Molfetta Law Group. Our firm prioritizes transparency and compliance with legal standards in all client interactions. We do not advocate actions that could harm your financial well-being or credit without careful consideration of legal implications.
If stopping timeshare payments has negatively impacted your credit, we urge you to contact us so we can assist in addressing any resulting issues promptly and effectively.
Regarding your case, it's important to note that it was not classified as a class action but treated under a mass settlement with Wyndham, with any agreements specific to your circumstances. We apologize for any confusion and strive to ensure our clients are fully informed about their legal proceedings.
While we understand the urgency of accessing relevant documentation, delays sometimes occur due to factors beyond our control, such as third-party responsiveness. Rest assured, we're actively pursuing the necessary information from ******* to progress your case efficiently.
Regarding refunds from *******, it's essential to understand that any payment made to release you from your contract with ******* was allocated for that purpose. Requesting a refund may prolong the process, and you'll remain responsible for maintenance fees and outstanding loan amounts.
We value transparent communication and apologize for any inconvenience caused by previous lapses in updates. Your patience and understanding are appreciated as we work to resolve these matters.
Please feel free to contact us with any further questions or concerns.Customer Answer

While Molfetta may say they value transparency, this has not been our experience. *** knew we were having credit issues because I mentioned it to her and she never offered any assistance. Again, we were told that once this process was started and we paid the ******, it would only take between 60 to 90 days to complete. It was never mentioned that they would have to wait for other settlements to close before our paperwork was handled. In addition, *** never stated that it would prolong the process if we wished for a refund because we were unsatisfied. She is the one who offered that option and she never said it would take longer. Again, we want this resolved immediately by a full refund of the $10,400 that we gave Molfetta as this process has not gone the way they said it would.Initial Complaint

August 9, 2021 we signed a contract with Molfetta Law Firm to get us out of our timeshare. Our daughter had passed away in February and we wanted to ease the financial burden. We paid Molfetta $6,758 on our credit card(which is no longer available to send you since it's over 2 year retention limit) We were told it would take ***** months . Here we are 2 1/2 years later and Molfetta now says that we need to pay off our timeshare, then pay $4,400 to transfer the title before we can be rid of the timeshare. Had we known the cost of this process **** cost $11,158 we could have paid off our timeshare and taken the title transfer up with Diamond Resorts. Now we still owe $12,000 on our timeshare AND we have paid Molfetta $6,758 plus they want us to pay $4,400. Nothing has been done to help us out and we paid over $6,000 for this! The least they can do is pay the title transfer to get us out of this.Business Response
Date: 02/27/2024
We extend our deepest condolences for the loss of your daughter, and we empathize with the challenges you've faced concerning your timeshare with Diamond Resorts. Our firm has diligently pursued various strategies, including legal action against *******, as evidenced by the lawsuit that was pursued and eventually dismissed with prejudice. Regrettably, *******'s practices have posed significant obstacles for both our firm and our clients.
As conveyed in our previous email correspondences, the recent acquisition of Diamond by ****** has further complicated matters regarding the release of timeshares. While we understand the financial strain this situation imposes, our recommendation remains consistent: paying off the outstanding loan and proceeding with the transfer of title would be the most viable course of action.I understand your frustration, but I must clarify that Molfetta Law does not handle refunds for services provided by ********************** If you are seeking a refund, you will need to contact ********************* directly, as they are the entity you paid the $6,758 for their services. Molfetta Law was paid a small flat retainer fee of around $900 to be your legal representation, which unfortunately is non-refundable.

Paying an additional $4400 for a title transfer is not a viable option. We need financial assistance on the title transfer. This has been a very frustrating process.Initial Complaint

Dear BBB Representative,
We are writing in response to the complaint filed by Mr. **************************** who claims to have never received communication from our firm, Molfetta Law.
Upon reviewing our records, we can confirm that we have had multiple communications with ****************. However, it appears that there might be a misunderstanding as we do not have any record of **************** attempting to communicate with our firm.
It's important to note that **************** was referred to us by ************************ with whom we had a prior agreement. This agreement allowed them to refer clients to our firm, and in return, we would receive a flat-rate fee if the client accepted our services. Nevertheless, ************************** case originated from a previous attorney, *************************, associated with ***********************.
Given the circumstances and as a goodwill gesture, we agreed to handle ************************** file pro **** since he had already paid a retainer to the previous attorney. It's crucial to emphasize that Molfetta Law has never received any payment for our services on ************************** file, and therefore, we do not have any funds to refund him. It's worth mentioning that our association with *********************** is no longer active, and we have learned that they are no longer in business. Regarding the current status of ************************** file, we recommend reaching out directly to our firm for any updates or information.
We appreciate your attention to this matter and kindly request that you contact us directly if you require any further clarification or information.
Sincerely,

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution would be satisfactory to me. I will follow up directly with law firm to see what status is. I have always responded to requests as received and the law firm took over our case. Whether pro **** or not was not discussed with me. We paid our fee and was handed off with no results.

Attended a timeshare resale seminar sponsored by TS Holdings and Molfetta Law. After signing a guaranteed contract with TS Holdings and Molfetta Law for the amount of $9799. We appreciate your concerns and would like to address the issues raised in your recent complaint. It has come to our attention that there may be some confusion regarding the relationship between Molfetta Law and ** Holdings, particularly in the case of the transfer of clients ***** and ********************* to our firm. We would like to clarify that ***** and ********************* were transferred to Molfetta Law on January 22, 2022. Our firm and ** Holdings are distinct entities, and we were not involved in any sales presentation. If ** Holdings utilized our image without our knowledge and permission for their sales presentation, we were not party to such actions. Molfetta Law, being a law firm, does not provide guarantees, and our role primarily involves legal counsel and representation. In our efforts to fulfill our responsibilities to these clients, we have encountered challenges in obtaining necessary onboarding documentation from them. Despite making 15 attempts to contact the clients, we faced difficulties due to incorrect phone numbers provided by the client and our emails remained unanswered. Our Scope of Services clearly states that clients are required to return documentation within 6 months of receipt; failure to comply is considered a willful breach of the agreement. Finally reaching the client in March 2023, we were informed that a Quit Claim Deed had been recorded with the county to release the client from their timeshare obligations. However, upon review, we discovered that this Quit Claim Deed, created by ** Holdings, was not recorded and did not legally release the client from their contractual obligations. This matter falls under the jurisdiction of ** Holdings, and we advise the client to address their concerns directly with them.
Despite our persistent efforts, we have yet to receive the necessary onboarding documentation from ***** and **********************
Please feel free to contact us directly if you have any further questions or concerns.

I am afraid that your responses were not acceptable or accurate. Unfortunately your company name was on the guarantee and that after numerous attempts to speak with responsible parties were unsuccessful. I spoke with a person named ******* who claimed that Molfetta was not involved. I beg to differ. Your company name is on page #1.
We would simply ask that your law firm look into this matter. We were led to believe that ** Holdings and Molfetta would return our money.
There were no calls to me as alleged (15). I have attached my phone and email which has not changed since date of resale.
We are at the mercy of this so called timeshare resale company as associated with Molfetta law.
Interesting that these professional companies have disappeared and it appears that money was taken and no actions to remove us from Marriott has occurred.I have contacted the **** and ********** AGs offices for some remedy

I appreciate your message highlighting concerns about the accuracy of our previous response. Allow me to address the discrepancy in our communication and provide additional clarification on our services.
Contrary to our initial belief that the provided phone number was accurate, we acknowledge that the person we connected with was incorrect, and the phone number provided proved to be inaccurate. Despite numerous attempts, our customer service representative faced challenges in reaching the intended contact for an extended period.
Regrettably, even after persistent efforts, we did not receive any documentation from your end. It was only later that we became aware of our company's identity being associated with ** Holding. Upon discovering this, we promptly ceased all collaboration with them and requested an immediate halt to any ongoing activities.
Regarding the documents you mentioned, we were unaware that they carried our name. Had we been informed, we would have promptly notified you of the inaccuracy. If you possess the specific document in question, we kindly request you to share it with us for further examination. This will assist in clarifying any misunderstandings regarding our logo and disassociating our firm from ** Holdings' actions.Additionally, I want to emphasize that our law firm does not handle "resales," as may have been misconstrued. It's important to note that our Scope of Services, which was provided to you and is yet to be returned, explicitly states that we do not offer guarantees. The retainer provided covered our initial services, which included numerous attempts to contact you.
I sincerely apologize for any inconvenience caused by this situation. For further assistance, I recommend reaching out directly to ** Holdings. We are committed to resolving this matter amicably and appreciate your cooperation in providing any relevant documentation.
Thank you for your understanding.
