    on 9/8/22 Mr. ****** was paid 350.00 to file a guardianship paperwork at kings county superior court. I contacted the court in November because i hadn't heard anything and found out the paperwork was never filed. I called Mr. ****** and told him since he didn't file my paperwork to not file and to refund me the money i paid him. I have tried calling him because i never received my refund. It's now December 26th, 2022 and he's still has not refunded me, He only gives excuses and avoids me.

    As this person states, I was paid $350 to create documents for a guardianship.  This person signed the documents, so she cannot claim that the work was not done.  I had a few issues when I first attempted to file the documents but it was my full intent to refile again, once I spoke with this client.  When I called this person to advise her of the situation and that I would be resubmitting the documents, I was somewhat taken aback by her response.  She indicated that she discovered an opportunity to become the foster parent of the child in question.  She clearly stated that she could make money off of serving as foster parent, something she could not do as guardian.  Hence, she had changed her mind about the guardianship.  I've pondered this situation fully.  As I did the work in preparing these documents and her complaint has various false statements, I will NOT be giving her a refund.  I still retain her documents as proof that I did the work.  She cannot pay me to do work (which was done), change her mind, AND expect a refund.  As stated, I still have her document and am fully willing to submit them to the court at any time in the future.  There may be a small charge if some forms have become obsolete.  Additionally, the person states that she had trouble getting in touch with me.  However, I retain a record of calls on my cell phone that prove I tried to call her and she did not answer.  I think what the person is doing is despicable both in trying to force me to provide a refund she does not merit AND the fact that she would rather be foster parent instead of guardian of her own grandchild.  Is that what family is about?  Making money off of our grandchildren?  As stated above, I retain the documents this person requested and signed.  Further I am fully willing to provide them as proof that I did prepare the guardianship documents.

     I am rejecting this response because:
    It’s a complete lie.   Will be taking them to court.  They were recommended by some i work with. I never received any paperwork and got nothing but excuses.I have a receipt and no paperwork I will take it all to court.   Beware do not use this person.

    Everything in my response it true.  Yes, she did pay me to complete guardianship documents, yes I completed them, and this person did sign them.  As previously stated, I retain the original, signed copies as evidence.  This person informed me that she would prefer to serve as foster parent to her grandchild, rather then guardian because it was financially advantageous.  This person never received her "paperwork"  because she told me not to resubmit due to the foster parent angle.  I am more then willing to resubmit at any time.  The work of preparing documents was done and that can't be denied.  I can finish the task at any time but this person told me not to.  I can offer evidence of what I am saying to BBB, can this person?

    I was never given any paperwork whatsoever.  I am filing a complaint with the district attorney’s office.  Yes I am a foster parent to 
    My granddaughter it was court ordered through the district attorney’s office. I was under the assumption he was a paralegal my paperwork was supposed to be filed on Friday September 9th 2022 and no later the September 12th 2022.  I only have a receipt showing I paid for him to do my paperwork which was never submitted nor do I have copies.   Nothing was ever done he agreed to send me a refund since he was told sick to do anything.  As far as the district attorney is concerned it’s fraud.

    I believe there may be a misunderstanding here.  I did submit the signed documents through the drop box in Hanford.  After now receiving the documents back in the mail, as I requested, my intention was to resubmit with the second copies signed by this person.  When I called to apprise this person of this fact, she stated that she no longer desired the guardianship due to the fact that she preferred serving as foster parent.  I was very ill at the time I last spoke with her and wanted to avoid any conflict.  I can't stand conflict with an unhappy client.  I've thought about this quite a bit.  If this person would have allowed me I would have finished this job as was my intention all along.  I was NOT too sick to finish this job- she no longer wanted it done.  My being sick, as well as my helper caused our follow up with the court to be late.  I don't think it's fair that I created the documents, had someone meet with this person, took the documents to court and am expected to provide a refund.  As far as fraud, I don't see how that even enters this conversation.  I have not defrauded this person.  I did all of the work she paid me to complete and something went wrong at the court.  As stated above, I was more than willing to finish this job and still am, as I retain the the second copies she signed.  I hope this person can see my side of this.

     I am rejecting this response because:


    i am done with this.  i contacted him in november and nothing was done.  i am tired of his lies.  There is no misunderstanding.  I have written everything out the district attorney.  i didn't find out about his business name until i decided to google his name and found the complaints on the better business webpage.  He accuses everyone of lying about him.  I was given his name by someone at work.  i had no business card or nothing.
    as far as o knew he was a paralegal not a document writer.  I went against my better judgement and this is what happens.  It's too late we agreed he would pay me back.  I've given the district attorney copys of what i have and his response to the better business bureau.  He's insinuated people are stupid and don't know the law.
