Auction.com has our house listed as a foreclosure going to auction. This is not valid information. This information is then being passed along to Zillow and out house is labeled ********** in big red letters. This needs to be removed. Every week they update the sheriff sale to the next week and there is NO DATE. This is false information that needs to be removed !Business Response

Thank you for bringing this to our attention. Auction.com is a marketing platform and under contract with foreclosure firms and banks selling distressed assets. As such we take the direction to market assets from those entities. We are also unable to remove an advertised asset because an unverified claim is made. The house located at ************************************************* has a tentative auction date of April 24th, 2023. ***************** Page on Auction.com indicates the house is not yet cleared for auction, however. Final clearance would be provided by the Foreclosure Firm handling this asset. ***************** Page on Auction.com also lists the forclosure firm, and directs borrowers and homeowners to call them directly. We suggest reaching out to them directly to hopefully resolve any concerns, and then the firm will direct Auction.com to remove the home from marketing as needed. The firm information provided on Auction.com lists The ******************, LLC as the firm, and a telephone number of **************. Auction.com does not provide information to any other web based platform. Auction.com is aware that Zillow pulls information listed on Auction.com, but Zillow is an entirely separate entity. Hi good morning my name is ******* property owner of ************************************************, this company listed my property on there website for auction on April 19,2023 but there is no a judgment and also in the website of the court my house is not listed, and also I have contacted the law firm and they said the same there is not a judgment and the law firm never contact auction.com. Please contact them asap because I have sent email to get this removed because people coming to my property taken pictures calling and also knocked my door to see the property at 9-9:30pm night time.Business Response

In December of 2022 I used Auction.com to bid on a bank owned house at ********************************************************************************. Although I was the highest bidder, 8 the system indicated that the reserve was not met. I contacted Auction.com and was advised that my bid was near enough to reserve that I should fill out the contract and send my escrow payment. I performed a wire transfer of $4,938,20 on December 30th 2022.I did not hear back from Auction.com so I contacted them and was advised that the Seller did not accept my offer. They requested that I submit a best and final offer. The sellers desire was to receive $117k for the property. I submitted my best and final bid of $101 k on January 11th. I called Auction.com customer service and was advised that the Seller turned down my offer. That is up to the seller. Now to my concern. I have been trying for over 30 days to have my escrow money returned to no avail. I have contacted Auction.com via phone and email on numerous occasions. They keep telling me that they will look into the matter, but I have not received a response when I will be refunded.I contact Auction.com on 2/13/2023 and asked for an update. The rep informed me that they had received the email that I sent last week.She attempted to contact a supervisor for assistance, but none were available.I asked the representative what I needed to do to motivate Auction.com to return my escrow. I asked if I needed to contact the BBB, or if I needed to take legal action. The representative informed me that since I mentioned legal action she had to disconnect the call. When I questioned this policy she proceeded to hang up on me.All I want is my escrow money returned. They have kept almost $5000 of my money for over 30 days.Business Response

I have reached out to this company by email a total of six times. I have called and spoke to someone who assured me my issue would be handled quickly but it's been weeks. I want the internal pictures of my home at ********************************************************** taken off their website. My home is not for sale and I have a realtor that told me the pictures were taken off the *** but homes.com refuses to take down the listing or pictures of my home. They keep telling me someone will reach out and nobody ever does. This is a breach of my privacy and this company doesn't own the pictures they have of my home on the internet.Business Response

We appreciate you bringing this to our attention. We looked into the concern, and determined that the house located at ****************************************************** is not one that is listed on Auction.com. We also looked for previous email communication, and do not see any emails sent to Auction.com about this situation. Auction.com is not related to or affiliated with Homes.com. After conducting a ****** search online, we did find the house on real estate websites Redfin, Trulia, Zillow and Realtor.com. All of those sites list the house as off the market. Those sites do list a contact for the listing agent, however. A further search also found the house listed on Homes.com. The listing on Homes.com did have interior photos, and also included contact information for the listing agent. Further searching on the Homes.com website gave contact information for them. We wish we could be of more assistance in this matter, but as stated previously, Auction.com is not related to Homes.com.Customer Answer

Thank you for bringing this to our attention. Auction.com was hired by the controlling Foreclosure Firm to market this asset through an auction scheduled for 12/29/22. We have forwarded this new information to the Foreclosure Firm. The Foreclosure Firm has reached out to the appropriate parties and is pending receipt of the Payoff Funds to cancel the sale through auction. Once they receive the receipt, they will review in order to cancel the sale. The Foreclosure Firm will direct Auction.com to stop marketing the asset based upon their review. The Foreclosure Firm is aware of the urgent need to review all available information to prevent further frustrations, especially if there is a clear title in place. Foreclosure Firms are unable to remove assets from the foreclosure process simply because someone makes a claim that there is a clear title. That and all claims must be verified in order to maintain the integrity of the foreclosure process. The statement made by the claimant that the Firm or Auction.com knew about the title issues and were still pushing an auction is not true. The Foreclosure Firm and Auction.com acted in good faith, and in accordance with all applicable laws, to validate the claim as soon as both were made aware of the issue. As of yesterday afternoon, 12/19/22, the auction for 441 ***** has been canceled. The Foreclosure Firm was able to validate the claim, received the correct receipt of funds, and sent Auction.com notice to cancel the auction marketing for this asset. This can be validated that as of yesterday afternoon the Auction.com website shows the auction as canceled. Again, thank you for bringing this to the attention of Auction.com. The following statement from auction.com is false: "The statement made by the claimant that the Firm or Auction.com knew about the title issues and were still pushing an auction is not true." When I contacted Auction.com REFUSED to validate the issue stating there was nothing they could do and put it on me to go to the legwork. This is assumed guilty until proven innocent!!! Refusing to investigate is knowing of the issue but still publishing the house is forsale! I was also told "this happens from time to time"
I had a contract to purchase the home in place 45 days PRIOR to auction.com getting involved. I transferred 100% of the sale price to the title company that was handling the title sale of the home even one day early. However, the same day I transferred the funds the property was posted as up for auction! There is obviously a gap in the process which auciton.com is using and they are closing their eyes to the issue and refusing to look into their internal processes to ensure it doesn't happen again.

The auction has been closed for several days and the link says I may have won on some of my item. *** tried contacting the auction dealer by email and phone. How or what do I do to find out if I won? My home at *************************************************** is listed on Auction.com for sale. My home is not in pre-foreclosure or foreclosure. This false advertising is causing me harm as people have been knocking on my door asking to come in and see the property, talking to my neighbors about me and the neighborhood and my house. I filed an initial complaint against Zillow.com who replied that they are advertising information from Auction.com and that they could not correct the false advertising unless Auction.com corrects it.Business Response

We can certainly understand your frustration. This property was in our inventory with a foreclosure sale date of 7/5/22, however, we were notified on 7/18/22 that the foreclosure was cancelled and the listing was removed from our site. At the time of this response, the search result on Zillow shows the last sale date as 2019 with no active sale listing. If you have further concerns, we encourage you to reach out to your lender to ensure they are not giving direction to anyone to list the property, or you can reach out to ********* at ************. I won the action on a property on 9/21/2020. The closing date was extended several times with no communication from auction.com other than the paperwork for the extension being sent. When I asked for an update they informed me in 2021 that "Closing has been delayed pending the *** deed recording and sale ratification. Which are both being held up by the pandemic and national mortarium that is expected to expire on 6/30/21 if the government doesn't extend it. " 1/5/2022 update - "The update as of this morning from the closing office: ETA pushed to February/March 2022 - ** not yet ratified. They are following up regularly. The City is still backlogged on recording documents. "3/29/222 update - "are still pending sale ratification. Per the ** attorney: "I checked the court docket, the ratification order has not been entered as of today; our office filed a request for ratification on 3/3/22."They have not responded to any of my recent emails.Business Response
