I applied for an auto loan with this company, the process was completed June 1, 2023. The agreed upon payment price was what i was expecting to pay in full, but every form of payment available to me has an additional charge tacked onto it which I was not made aware of throughout the filing process. This business practice seems to me to be deceitful and I want to know if there's any form of restitution I can take in dealing with this business?Business Response

It’s been over a month since I received a call from Beneficial state bank, the ###-###-#### number the fraud investigator told me to call him anytime at NEVER answers, I’ve left 8+ voicemails and have tried calling multiple departments. This is all cause of a ASPIRATION/BENEFICIAL STATE BANK fraudulent account. They don’t take responsibility for anything and sent me a packet that wanted me to send back my ID/SS Card.. yes cause that’s what someone who is dealing with fraud wants.. more personal identification documents in the mail. I sent back a legal letter addressed to their fraud department notarized with my ID and their packet, along with the FTC & CFPB statement that they are neglecting.... AVOID BSB AT ALL COSTS!!!! They allowed fraud to occur and now make it hard on me..

I am writing to you regarding an issue that has come to my attention. It appears that an account has been fraudulently opened in my name with your bank without my knowledge or consent. This is a serious matter that I need to bring to your attention, again.
As a victim of identity theft, I urge you to take immediate action to investigate and resolve this fraudulent activity. I have not authorized anyone to open an account with your bank in my name, and I am concerned about the potential risks that this situation may pose to my personal and financial well-being.
I would like to request that you provide me with all the necessary information related to the fraudulent account, including the account number, any transactions made, and the identity of the person(s) responsible for opening the account. I also demand that the account be immediately closed, and any unauthorized transactions reversed.
If this matter is not resolved in a timely and satisfactory manner, I may have no choice but to pursue legal action against the bank for the damages and losses I have incurred.

We understand that Identity Theft can be a very stressful situation but please be assured that Beneficial State Bank took the necessary steps to correct all unauthorized charges that posted to your Aspiration Zero Credit Card.
As required by law, we have reviewed our account records. Upon receiving information from you related to Identity Theft, we conducted an investigation, updated our records and closed your account. We also contacted the credit reporting agencies and furnished the updated information to them. Please allow 30 days for the corrected information to reflect on your credit report.
For your protection we suggest that you place a fraud alert on your credit reports and review your credit reports. Fraud alerts can help prevent an identity thief from opening any more accounts in your name.

I’m writing to you because I noticed that my most recent credit report contains a charge off. I am not seeing when and if the account has been sold, which is completely illegal. BENEFICIALSB is a misrepresentation of the account status, therefore I am requesting you to delete the account immediately. Also I have noticed the following account has a discrepancy in the payment history section of the listing.
This charged off account is reporting payment history each month when it should not since that account has been charged off. This is falsely manipulating the statue of limitations which is a FCRA violation ** *** * ******* * Billing error resolution.
(2) Adverse credit reports prohibited. The creditor or its agent shall not (directly or indirectly) make or threaten to make an adverse report to any person about the consumer's credit standing, or report that an amount or account is delinquent, because the consumer failed to pay the disputed amount or related finance or other charges.
DELETE THIS ACCOUNT IMMEDIATELY!
IRS defines a charge off as gross or ordinary income. Income does not get reported on the consumer report. Once the account is charged off that means they wrote it off as a tax write off and took the loss. Which means it is now considered income. "Canceled debt income," often called canceled or forgiven debt, is something anyone with unpaid debts but not gifted should be concerned with. The IRS considers this income.
I am going to report you for tax fraud! You have already written off the debt. So legally you aren’t suppose to be reporting it as negative item to the three credit bureaus. I am demanding a ***** form so we can audit you to make sure you is in compliance. You’re in violation of **** ** *** ****** for reporting information that is not 100% accurate.Business Response

This company has been terrible to work with. I have over $500 of fraudulent charges on my account and have been on the phone for hours and all the sudden they tell me my account is closed- and it had been closed a month ago- I received NO notice of this account being closed. I need these fraudulent charges to be addressed- the dispute company needs the account to be open in order to address the charges. They don't even let me speak to the people who address these issues. We have been having issues submitting payments through your system for 4 months and after complaining last month of the same issue we were not able to submit the payment via the designated cc on file and the payment went throught the bank ach. This resulted in a late payment being placed on my credit report that i have asked to be removed as the account is current and this was beyond our control. We were told that the bank attempted to make communication with me on the 14th of September. I have no missed calls or voicemails, I do have Scam calls blocked on my phone though as i was receiving multiple a day. I want this late payment removed from my credit report.Business Response

I am rejecting this response because: I have no voicemail from any missed calls. I have my phone set to auto reject scam callers. If your numbers come up as scam likely it will auto reject. Please call me off a regular number. I have also filed my paperwork with the relevant Creditr beaureas and sent an email to the CEO of Benefitial, no response.
