      I have a loan with Oportun and they stated I was late on my payment of June 14th 2024, I received tons of phone calls and mail about the late payment, at first I didnt pay attention because I got my bank statement Showing me otherwise ,Then I called To find out what was the problem They told me The late payment was for July 12th 2024 stating my bank rejected the Payment (I have automatic payment) I requested to speak to higher management Some guy named **** stated that it was my bank and that I need it to talk to the bank but at this time I had to pay the payment and the late fees and going forward it will affect my credit if I keep being late on my payments. This is not the case Ive been with them for years, and I had never had any issues before, so for me not to affect my credit I paid supposedly the late payment for $119 But I have my bank statements With my payments are being paid on time, I dont think I owe them that $119 I would like to have my money back. After I paid they sent me a mail letter saying that they thank me for the payment and for being back on track.

      I was told by Oportun that the late payments would be removed from the credit bureaus but this has not happened. I do not have any communication with them at all, not even mail. I was also not able to get on the website. I asked them to restore this months ago and again, this never happened. I have been dealing with Fraud on ******* account for several months and I have been through 4 debit cards, along with my bank account being blocked every time. I have informed Oportun and have attempted to work out an arrangement with no contact or calls back pr emails or mail. Prior, when things starting to happen, I was not offered refinance or any other option but a hardship program, which was them calling me 10 times a day and stating they that that I was not on this program. I have since refinanced my loan and will pay this off asap., but due to the circumstances, the lates need to be removed. Particularly reporting I am late three months. I have proof form my bank regarding the fraud and blocking my account. I also have an attorney monitoring my case and communication with Oportun. This is what their website says but this was not the treatment, I received from them and was told it was not an option! *************************************************************************************************************

      I am rejecting this response because: I do not agree with your response. My hardship was never recognize by your company and I did receive calls at work and also calls after hours, time and time again, refusing to recognize my hardship program. I also asked for a written description of this program and I have yet to receive. I was not told or given documentation before. 

      I was never offered any assistance after November and was told that I was placed back in the hardship program Dec, Jan. I asked several times if there was any other forms of assistance that you provide and was told NO. I have been through 4 debit card due to fraud on my account and my account was blocked several times due to this. I have proof from the bank. This was no fault of mine and the ongoing fraud created a huge problem with paying my vendors, due to the blocks. I did inform your company and nothing came of it.

      I have had several calls with your company without getting any assistance, due to lack of knowledge of my account and refusing to send me to a supervisor, or not returning a call from a supervisor. 

      There has been constant lack of knowledge, acknowledgment, documentation of my account.

      I utize the set and save function of the Oportun app and set up several transfers on August 12. Usually transfers go through , money is pulled out of my bank account and usually same week will show up in Oportun . Unfortunately i noticed that this seemed to be taking longer than usual so I reached out just to be sure nothing is going on. Its been 7 days and my money has been held up - its pulled out of my bank account but not in my Oportun and therefore I cannot access it. I am filing this complaint becusse they have not given proper notice or eta of any issues and theres still no notice on the app or sent as an email. Oportun has no proper way to reach out via phone and trouble shoot only email. I reached out Friday August 16 to bring attention to my money not being there as it normally would hav e processed by then. I received a response stating I needed to wait 3-5 days but no issues were indicated. Reached out August 19 since still nothing has happened. Did not receive any response Reached out August 20 again asking for actual assistance and notifying I have no money. I asked for a phone number to speak to someone directly so I can get real assistance. I got a response identifying an engineering issue . This is my first time hearing about this they had not notified me anywhere else nor through the app and there is no eta on when my money will be deposited in that account. That same day I called in to speak to someone and was told there was no one to speak to but I could file a complaint. I opted not to at the time due to needing to start work I followed up twice more via the email and have not received any response at the time of sending this complaint.

      After reviewing my credit reports there are 3 billing errors that are reporting inaccurately. Under federal law 15 USC 1666b open end consumer credit plan. These errors are violating my right as a consumer to 100% accurratereoorting and fair credit practices.       In your complaint,you allege that Oportun furnished inaccurate and adverse reporting to credit reporting agencies in defiance of the Fair Credit Reporting Act (FCRA).

      We take your complaint seriously and have thoroughly investigated your concerns. We understand how important it is to have accurate information reflected on your credit reports. Our records show that a credit card was approved on November 12, 2020.When you use the card, you agree to the Terms and Conditions outlined in your Cardholder Agreement, including the Important Information About Credit Reporting. This indicates that late payments, missed payments, or other defaults on your Account may reflect on your credit report.

      Based on your payment history, you set autopay online on June 6, 2022, with a checking account ending in 3777, and the payments were drafted as scheduled from July 8, 2022, to October 8, 2022. However, the payments received in November 2022, February 2023,and May 2023 were reversed due to either insufficient funds or no account found. This led to delinquencies being reported in December 2022, March 2023,and June 2023. If you believe this is an error, please provide your bank statements reflecting the funds withdrawn from your account.

      Additionally, your monthly statements mailed to you showed that the payments submitted were returned and showed the past due amount. Therefore, we have concluded that we accurately reported your account to the credit reporting agency(s) as required by the ***** and your account is reflected as open/current with delinquencies.

      My name is *********************************.Loan number is: *******. Date of birth 04/16/80 Lamentably, I requested a loan from this company and used my vehicle as a collateral.On this month I failed to comply with my monthly deadline responsibility. Two (2) months accumulated.Once I was made aware I proceeded to make the corresponding late payment of $362.94.Next day Oportum towed my vehicle. I am writing to you to denounce, file a complaint and report the intransigence, abuse and lack of tact committed by the Oportun staff against me. Long story short, the initial debt of $6,541.63 which is paid.Day after day paid in batches of $2,000.00 this amount was paid in full. It turns out that on 09/08/24, I showed up at one of the Oportum offices in ********* with $2,544.00 in cash as final payment in full. This total includes a payment of $362.94 paid on 02/08/24 with a checking account.The online Spanish-speaking agents say that this amount of $362.94 has not yet been collected by Oportun, so, although according to my bank statement it reflects that the amount was collected. To get out of the predicament, conclude the embarrassment I agreed to repay this $362.94 in cash at the branch. Trusting on their honesty that later or eventually it would be reimbursed to me.The **************** refused to accept this $362.94 payment because in their systems the account appeared as paid in full. However, the online Spanish-speaking agents were adamant that the payment of $362.94 had not yet been reflected and even refused to receive the payment anyways, which I fear is why they did not want to turn me back the vehicle. This ambivalence makes us suspicious and afraid of the honesty of the Oportun staff, fearing that ultimately, they want to keep the vehicle to auction it.So, I ended up paying the $6,541.63 debt and them, Oportum keeping the vehicle to later on auction it .

      I got a personal loan from oportun and they offer $50 referral for a friend I referred my friend on April 25th and we were both supposed to get the $50 and told it would arrive in 4-6 weeks on 3 different occasions and still no $50 I called someone July 19th 2024 and the man said it would be here in 7-10 days 2 weeks and still nothing so I called again today and a rude lady answered and said I wouldn't be getting it because supposedly no referral code was used which isn't true I walked my friend through the process. She had no interest in fixing the issue so I did tell her I was going to contact the better business bureau because this is false advertisement what they're doing and it's wrong. All I'm asking for is my friend and I to get the $50 we're each owed for the referral. Thank you.

      I am writing to file a complaint against Oportun regarding my loan, account number *******. On April 7, 2027, I contacted Oportun to address the excessive Annual Percentage Unit (APU) of *****% and the yearly interest rate of *****% that have been applied to my loan. Both rates appear to be in clear violation of Florida's usury laws.In my communication, I requested the legal interest rate allowed by Florida law for my type of loan, a detailed breakdown of my current loan balance including principal, interest, and any applicable fees, and a payoff amount that reflects the legal interest rate and necessary adjustments to comply with Floridas laws. However, Oportun has failed to respond to my request within the 7-day timeframe I specified. This lack of response, combined with the apparent violation of state law by applying unlawful interest rates, has left me no choice but to seek assistance from the BBB.       Dear Oportun Team,

      Thank you for your prompt response to my previous letter. However, I must stress that there are several points in your reply that I strongly contest.

      Firstly, I fully dispute the validity of this loan. To be absolutely clear: I did not sign any documents or legally agree to the terms of this loan. My payments thus far have been made purely to avoid potential damage to my credit score, not because I acknowledge or accept this loan as legitimate. The fact that you assert I signed a promissory note without any real evidence raises serious concerns about potential fraud in this matter.

      Secondly, your claim that Oportun is not subject to Florida's state usury laws is highly questionable. According to my understanding of Florida law, the interest rates applied to my loan, including the *****% APR and the *****% interest rate, appear to be in violation of Floridas usury limits. It is critical that you provide clarification on the specific legal exemption Oportun is relying on to claim that you are not bound by these laws. If there is any federal exemption or alternative regulation that Oportun is using, I demand to know the precise legal basis for this position within 7 days of this letter.

      Furthermore, while I acknowledge that you provided a breakdown of the loan and the documents you claim were signed, this does not absolve Oportun of the responsibility to adhere to applicable consumer protection laws. The terms of the loan, as stated, are not compliant with Florida state laws, and as such, I remain open to negotiating a resolution that reflects a legal interest rate. I request that you provide a detailed breakdown of my current loan balance, including principal, interest, and any fees, and a payoff amount adjusted to comply with ******** usury laws. Without this adjustment, the loan terms remain legally questionable at best.

      If Oportun does not take the necessary steps to address my concerns or refuses to provide valid evidence of the loans legality, I will have no choice but to escalate this matter. I have already submitted a formal complaint with the Better Business Bureau (BBB), and if Oportun does not resolve this issue as requested in my complaint, I will immediately stop making any further payments. At that point, I will begin fully disputing the entire amount of the loan.       Let me reiterate: I never signed any documents with Oportun, and I believe this loan may have been established under fraudulent pretenses.       This is my formal and final notice regarding the fraudulent loan account in my name. I categorically reject the validity of this loan and the claim that I signed any promissory note. Despite multiple notifications, Oportun has failed to take the necessary steps to resolve this fraudulent activity. Your inaction and attempts to justify this loan are unacceptable.


      To be clear, the only reason I have made payments on this fraudulent account is to protect my credit from further damage, not because I acknowledge any responsibility for the debt. Your institution is knowingly allowing a fraudulent account to persist, and this is not only unethical but potentially illegal. 


      As a federally regulated lender, Oportun has a legal obligation to investigate and close any accounts that have been reported as fraudulent. Yet, you have failed to meet this obligation, forcing me to continue paying for a loan I did not agree to.


      I demand immediate action:
      1. Immediate Closure: The fraudulent account must be permanently closed. I expect written confirmation within 10 days of receiving this email.
      2. Full Investigation: Oportun must conduct a thorough investigation into how this fraudulent loan was opened and provide a detailed report.
      3. Refund of Payments: Since this loan was opened fraudulently, I demand the full refund of all payments I have made to date.
      4. Cease and Desist Collection: All collection activities must be immediately halted, and no negative credit reporting should be filed under any circumstances.


      Failure to comply with these demands will result in immediate escalation, including but not limited to legal action for fraud, breach of consumer protection laws, and negligent handling of my personal information. I will also file complaints with the ***** ***, and any relevant consumer protection agencies.       I am writing in response to the fraudulent loan under the name of **** ********* Abelenda. I categorically deny any involvement or responsibility for this loan, and I am demanding immediate action to rectify the situation. My identity has been used without my knowledge or consent, and your institution has failed to safeguard my personal information. This loan is a result of identity theft, and I will not tolerate any further attempts to collect on this fraudulent debt.


      It is imperative that you understand the gravity of the situation. My information was fraudulently listed under the alias Pentester, and unauthorized individuals have exploited my identity to secure this loan. I never signed a promissory note or provided any form of consent to Oportun. Your institutions negligence in properly verifying the legitimacy of this loan is unacceptable, and I expect immediate action to void it entirely.


      My email was used without my permission, and under no circumstances did I agree to any loan terms with Oportun. I am demanding that this loan be invalidated immediately. Any further attempts to pursue payments on this loan will be treated as harassment and will only exacerbate the legal consequences you will face.


      Oportuns continued efforts to collect on this fraudulent debt violate several laws designed to protect consumers from the very situation I am experiencing:


      1.Fair Credit Reporting Act (FCRA): Under this federal law, I have the right to dispute fraudulent activity, and you are required to remove fraudulent accounts from my credit report. The failure to promptly investigate and correct fraudulent information is a direct violation of FCRA Section 605B. You are obligated to block this fraudulent information within 4 business days of my formal dispute. Your failure to act promptly will result in additional legal liability.
      2.Truth in Lending Act (TILA): Oportun is required to provide clear and accurate disclosures regarding any loan, none of which I received. Any continued collection efforts on this loan constitute a breach of ***** regulations and subject you to potential fines and penalties. Any financial injury I have suffered due to this violation will be part of my legal claims.
      3.Intentional Infliction of Emotional Distress (IIED): The continued attempts to collect on this fraudulent loan, despite clear evidence that my identity has been compromised, are causing me significant emotional and psychological distress. Your failure to act in good faith and resolve this matter immediately constitutes Intentional Infliction of Emotional Distress (IIED) under tort law. Your institutions disregard for my rights has caused substantial harm, and I am fully prepared to pursue damages resulting from your actions.

      On 06/06/2023. I **************************** talked to Oportun and agreed to a settlement deal for me to pay off the Oportun Loan.Oportun explained to me that after I pay off the debt that Oportun themselves will delete this debt off of my credit report.14 Months Later After Oportun Received My Settlement Deal Payment Oportun did not follow through as they said they would, and did not delete this debt off of my credit report at all.

I have identified an unauthorized account in my credit report, detailed below:Creditor Name: OPORTUNPROG Account Number: *******Opened Date: 7/30/2021 High Credit Amount: $2,675.00 Despite filing a complaint over 30 days ago, this account remains unresolved and continues to negatively impact my credit score. I have never opened this account, and it is imperative that this unauthorized account be removed from my credit report immediately.This matter is of serious concern as it affects my financial credibility.
