    On August 30, 3023 I received a call about a water leak at our property, which is operated as an AB&B. When I arrived there was a water leak and 3 potholes had been drilled at the location. No one was present but the 3 safety cones identified AGL as the company that had drilled the holes. One of the potholes was drilled into our waterline. I first called North ******* ***** and Sanitation. I was informed by NLW&S that the Contractor AGL, working on behalf of Denver ***** had caused the damage to the waterline. It should be noted that neither Denver ***** or AGL had provided prior notification of their plan to do any project on our property. The residence (AB&B) was occupied by a guest at the time of the damage. Due to the water being shut we were forced to reimburse the guest. Additionally, a new guest was scheduled to arrive the following day. We were forced to refund that guest because it took 2 days to complete repairs. We spent many hours getting estimates for the waterline repair and stood by more than 12 hours during actual repairs. After repairs were concluded, I contacted Denver ***** attempting a reimbursement. Denver ***** assigned a case # and a point of contact person. I spent 2 and a half months communicating with Denver ***** to no avail. On 11/12/23, Denver ***** provided me contact information for AGL, and said I should provide AGL with the invoice. I called AGL and left messages for one week with no response. Our losses and damages amount to $18,396.00. I will file a lawsuit for this amount and Denver ***** will also be named in the lawsuit, because AGL is their contractor. AGL entered our property without prior notice, caused major damage, and thus far has not even responded to numerous requests to settle the matter.

    AGL Construction Company apologizes for the confusion regarding the water leak at *****************. AGL Construction Company was completing a pothole on the public side of the water line on August 29th, 2023, while completing work our crew noticed a pre-existing water leak that was coming from the private side of the line. This leak was not caused by work completed by our company. Upon discovering the leak AGL immediately notified our customer,Denver Water, and we were told that the leak was the responsibility of your local water district. In September, we visited **** Pecos and replaced asphalt milling in the driveway. Our personnel documented speaking to the property owner and received no complaints or concerns. We are happy to discuss with you the work we performed that day and answer any questions you may have. Thank you.

    I am rejecting this response because:

    AGL did in fact enter our property without prior notice and did drill into our waterline, thus causing a leak. The leak was not pre-existing. I have witnesses and photo documentation to prove these facts. AGL did also enter our property to restore the asphalt driveway after our complaint. No prior notice was given to us, but we do consider the repair satisfactory at this point. Since AGL did not respond until a complaint was filed with the BBB, I must assume that a legal recourse will be required to recover losses and damages.

    I stand by the facts outlined in the original complaint. This company did enter our private property without notice and cause the damages stated in the original complaint. I am currently seeking an attorney to *** for the stated damages.
