President ********************************* and his company Agency of Credit Control (ACC) are engaging in abusive, deceptive, and unfair debt collection practices and has obtained and disclosed my nonpublic personal information without my authorization and consent. My failure to dispute the validity of this alleged debt shall not be construed as any admission of liability pursuant 15 USC 1692g(c) and shall not subject me to any form of racketeering activity committed by ACC. *** stated: "Agency of Credit Control (ACC) denies the consumers claim as it is factually inaccurate, and no violation has occurred." Ignorance of the laws that govern your organization is not an excuse to openly break them. I have reasonable cause to believe ACC is being willfully negligent in its compliance with federal law, openly violating the **** and FDCPA. *** also stated: "ACC received the account from the original creditor and notified the consumer that the account in question was assigned to ACC for collection on April 4, 2023, despite numerous attempts to contact the consumer, no response has been received and no communication has transpired with the consumer whatsoever." I have never had any contact with or have done any business with ACC or have I been provided any bill of assignment that proves they have a right to collect on this alleged debt. I have not been told who this alleged original creditor is. *** has admitted they never had any communication with me. This gives me reasonable cause to believe they never attempted to contact me prior to furnishing this fraudulent credit information to my credit report. *** also stated: "Thus, the consumers claim that ACC Took or threatened to take negative or legal action, is simply untrue." Furnishing false credit information to coerce payment on an alleged debt that you have no proof you ever attempted to validate or verify is, in fact, a negative action that was taken by your company and a violation of the **** and FDCPA.

Agency of Credit Control (ACC) denies the consumers claim as it is factually inaccurate, and no violation has occurred. *** received the account from the original creditor and notified the consumer that the account in question was assigned to ACC for collection on April 4, 2023.  The validation notice advising the consumer the account in question was assigned to ACC for collection and that teh consumer had 30 days in which to dispute the debt.  The consumer did not respond to this notice nor any of the other attempts to contact the consumer. Thus, the consumers claim that ACC Took or threatened to take negative or legal action, is simply untrue. Given these facts, ACC has conducted its efforts in a fully compliant manner and denies the consumers claim as no violation has occurred.

I am rejecting this response because:

This company has copied and pasted a ridiculous response and not done anything to address my concerns. I am keeping track of all of my actual and statutory damages I received due to this companys willful negligence. For this companys sake, I really hope they dont violate any more federal laws by furnishing false and deceptive forms despite receiving numerous complaints about these violations. This company has never send me anything remotely attempting to validate this bogus debt. I will be reporting them to my State Attorney General.

      Sincerely,

      ***********************

This company lies over the phone. Uses intimidation tactics to try and charge more than allowed by law. Will send court papers without any case number way ahead of time, without a case number because it was never filed. They bank on you not showing up to the court date you will never recieve. Default judgement is then sent. It's a gray area i was told by the county clerk. Don't pay anything, get an answer drawn up and fight because they will try to bully you into believing they won't take you to court but if you pay on the website, it will still go to court. Been warned.

As a matter of policy Agency of Credit Control, **** (ACC)does not comment on specific details regarding consumer accounts.  Complaints found here are not always factually accurate and are posted by individuals who are not actual customers of this business.  All collection efforts are conducted with strict compliance of all local, State and Federal statutes.
Any litigation, judgement, post judgement remedy, all forms of execution are required to be authorized and issued by the proper jurisdictional judicial system in accordance with the rules of simplified civil procedure.  Due process is required to be hand delivered by process servers as a matter of law.  Before any account is litigated, numerous attempts to contact consumers are made to resolve accounts voluntarily.  It is only when these efforts fail or attempts to contact are ignored that Simplified Civil Procedure is necessary to resolve unpaid accounts.  Complaints found here are typically a result of a lack of cooperation or refusal to communicate.
Accounts reported to the various credit bureaus are done so in compliance with the **** and any disputed account is investigated and verified in compliance with the same.  Disputed accounts are reported as disputed as well.  Furthermore, ACC is contractually obligated to accurately report to the various credit bureaus and cannot arbitrarily remove items that are properly and accurately reported despite consumersrequests or beliefs.
The account in question was assigned by the original creditor December 28, 2022. Finally after numerous attempts to contact the consumer to resolve the account voluntarily, the consumer responded by answering our call on March 10, 2023.  During the call, the consumer was informed that her account with the original creditor was assigned to ACC for collections and the bill needed to be paid.  The consumer refused to pay the account or make any arrangements to pay the account.  As a result, the account was referred to an attorney to commence litigation.  The consumer was served personally a month later and as a result, the consumer contacted ACC to pay the account.  Serving process before docketing is referred to as pocket filing and is a common practice.  The main reason is to SAVE THE CONSUMER ADDITIONAL FEES AND COSTS ASSOCIATED WITH LITIGTION.  Had the case been filed (docketed) before serving the summons, the consumer would have had to pay approximately $125.00 more to pay for the filing fee.  Thus, by serving the summons before filing the case, we were able to save the consumer an additional $125.00.  WHATS MORE, ACC WAIVED THE PROCESS SERVER FEE, SAVING THE CONSUMER AN ADDITIONAL EXPENSE OF $60.00.  ACC WENT OUT OF ITS WAY TO MINIMIZE THE EXPENSE OF LITIGATION THAT WAS NECESSARY BECAUSE THE CONSUMER SIMPLY REFUSED TO PAY HER OBLIGATION.  Of course, had the consumer paid the original creditor before they assigned the account or had she accepted our offer to resolve the account voluntarily, litigation would not have been necessary.
Given these facts, ACC denies the claims made by the consumer as they are simply inaccurate.  ACC has acted compliantly and professionally in all capacities and will continue to help the consumer any way it can.

I received notice on 03/29/2023 from my employer that my wages are going to be garnished by this company due to an outstanding debt. I had not previously been informed of the debt, but wanted to look into what this was about. The debt was from a physician's office in ******** in December of 2020. I reached out to the office and was told that the debt had been sent to this credit agency. I informed the creditor that this must have been made in error or someone must have used my name because I was not in ******** at that time. I offered to provide attestation from my employer at the time showing that there was no way I could have been in ******** at the time of this debt but was told that was not an option. My case number is: 2022C30136 Next, my wages are being garnished in a state that does not allow wage garnishment for these types of debts. ***** does not allow this type of wage garnishment. I called the agency again trying to offer to set up some type of arrangement while I try to figure out how to show that this was not my debt, as I would rather do that than have the embarrassment of wage garnishment with my employer over a debt that is not mine. I was told that there are no options for payment plans at this time. I am trying to get someone to help me delay this garnishment until I can learn the steps that I can take to prove that this is not my debt. I can provide whatever documentation is needed to show that I was not in ******** on these dates or whatever else may be needed. I do not understand why I was not notified of this court order, but my job was notified and I had to find out from my employer which was very confusing and embarrassing.

The account in question was assinged to ACC in August of 2021, and numerous attempts to contact the consumer were made by telephone and **** mail.  The consumer acknowledges that she was aware of the debt as she contacted the original creditor about the debt and was told the account was referred to ACC for collection but the consumer did not reach out to ACC to resolve the matter.

The consumer faild to respond to any of our efforts.  The consumer was served due process personally at her residence in October of 2022 and still the consumer faild to respond.  As a result, default judngment was entered by the court.

Given these facts, ACC denies the claims made by the consumer as they are simply inaccurate.  ACC has acted compliantly and professionally in all capacities and will continue to help the consumer any way it can.

      Complaint: 19875389

I am rejecting this response because: I do not understand how reaching out to a medical office to enquire about a debt that is not mine and reporting such adds cause to continue with garnishing my wages. I responded to this agency as well reporting that this was not my debt and offered to show that there was no way I could have been in ******** as I was working and offered to show proof of this but was not given that chance, instead this agency did not offer any alternatives and went straight to my employer to garnish wages. I have reported this to the ***** ************************ as well as this is not legal in the **************, especially when it was not my debt.

      Sincerely,

I have a debt owed to **************************** one in the amount of 545 the other for the amount of ****** . I paid one off ****** and have the receipt it was also removed from my credit report. Which left one on my credit the debt amounting to 545. Keep in mind when I paid the ****** I was not told that a bill amounting exactly the same was still owed. I called to pay the final debt of 545 and was told **************************** no longer was collector of the debt but the law firm called ******************* law firm owned the debt and I was taken to court without my knowledge lost the case who now says I owe both debts amounting to *******. I tried to fight it and asked for proof but they said since they won in court they had no need to show proof. I am not fighting that I owe any money I am fighting that I owe a bill amount of ****** twice I will pay the 545. I believe a clerical mistake and fraudulent reporting is happening here. If ******************* owns my debt and they do not report to the credit bureaus why does **************************** still reporting to the credit bureaus I owe them collections when they sold my debt or no longer the collector of it. I have kept the email from ******************* law that saying I lost in court and that they do not need to prove anything to me just to show how much owe. Even though I had a receipt saying one of the debts was paid off they were not hearing it. I felt intimidated into agreeing with it but I can not afford to pay for their mistake nor can my credit.
