    **** and I entered a contract for shower pan replacement on 6/16/23, a total of $1750 with half of that $875 being due at signing -this had a TBD start date the week of 6/26/23. 6/23 came and went and I didn't hear from ****, so I emailed on 6/28 asking for an update - he changed the date to 7/10. Again, nothing, so I emailed on 7/12 and he reschedules to 7/17, then emails on 7/18 saying they had an emergency and need to delay further. I email the 7/20 for an update, no answer so I check back on 7/29 and **** replies that the emergency set them back a couple weeks and he's cleared time for me the week of 8/14. He emails on 8/14 saying they will be out that week to start work but then I don't hear from him again. I email on 8/20 requesting a refund of $875 as I have no faith they are planning on starting work on my project. **** agrees to the refund and that the refund will process 30 days from the request. 30 days go by with no refund and I email on 9/21 to check in, he then changes the refund date to 9/30. As expected, there was no refund on 9/30, and he emails on 10/2 and says it will now be the following week. I have to email again on 10/16 because still no refund. On 10/20 he asks to break into 2 payments, half at the end of the next week (10/27) and the other half the following (11/3). It's now half way through November, and I still haven't seen any part of the refund was promised. All I ask is that the initial deposit be refunded in the amount of $875 so we can put this all behind us.

    I would like to follow up on the complaint I filed against Action Shower Pan Company,  complaint #********. The owner's response was that he would work on a settlement agreement to close out the complaint, but I have not had any contact with him since the complaint was filed. I would like to update the status of the complaint to reflect that it is still unresolved and not satisfactory.

    ************************* and I entered a service contract signed, dated and agreed to perform. Due to delays in the scheduling ****** decided not to proceed with the project. That is her prerogative to do. However, the contract clearly states that all deposits and payments made are non-refundable.

    I am rejecting this response because I have email communication from **** agreeing to provide a refund and steps he said he was willing to take to pay back the deposit going as far as to begin setting up a payment plan. To agree to the refund and then rescind the offer is just bad business.

    As stipulated in the contract, ****** agreed to settle all disputes according to the terms of the contract. Once ****** decided to involve a third party into the contractual dispute, she has not kept to the terms of the contract. The contract is transparent and contains a contingent for delays beyond our control. As long as ****** was willing to abide by the terms of the contract I was willing to work with her.

    Could you please ask ****************** to provide proof that the delays in service were beyond his control as stated in the contract? I'm assuming from the lack of response on the days he agreed to begin work and never showed that he did not have a legitimate reason for not showing up. Thank you.

    As I have provided to you a copy of the agreement. It clearly stipulates that all money and deposits are not refundable. It is my position that we wanted to fullfill the contract to the full. However ************************* decided she no longer wanted to proceed with our services and decided to end the agreement.

    I hate posting bad reviews and try to avoid and resolve most of the time, but I feel the need to warn others about using **** from ****************************** Shower Company. Short Story: Took ~4 months (6/11 - 9/14) to "complete" 2/3 of a job that should have taken 1 week (small shower waterproofing and tiling project). He cancelled ***** times (multiple times he cancelled the same day he was supposed to come) with different excuses and then said he no longer could prioritize my job and put it on hold indefinitely. **** will probably point to his other positive reviews. Those may be true, if you have a large bathroom project that he will prioritize, if you have a small project - quality and communication might suffer as they did in my experience with him.

    **************** is currently under contract and is bond by the terms of the contract. Therefore as **************** has acknowledge 2/3rds of the work have been completed and paid for by ****************. The contract does stipulate for delays beyond our control and have been agreed upon. I informed **************** of the delay in schedule.

    I have been willing to work with **************** throughout this process and I am willing to settle this dispute according to my contract settlement agreement and it's terms.

    **************** is still bond to the terms of the contract and is liable for the balance to be paid in full. If **************** will not agree to the terms as promised by the agreement I will seek other measures for the balance.
