    Asphalt Paving & Chip Seal Company performed a chip seal project on the driveways for my two adjacent properties on June 15, 2022. As per the invoice included herewith "all work come with a 5 year written warranty..." The chip seal did not hold up well over the winter of 2022-2023 with numerous depressions and pot holes developing (selected pictures attached herewith). Beginning in the Spring of 2023, I made several calls to Mr. R****, most of which were not returned however, I did have at least two conversations with him in which he rudely assured me the company would honor its warranty. I also emailed him the attached pictures of selected pot holes and requested him to repair them and other deficiencies and providing my contact information. Mr. R**** has not been in touch and I am planning to initiate an an action in Small Claims court to seek a partial refund and/or to compel him to perform.

    I was approached by ******* ***** *** that they were doing some chip seal work on neighbors property and had left over material and would make us a good deal if we wanted our driveway done. It was getting later in the evening and so they returned the following morning to do chip seal. We were repeatedly promised by ******* ***** *** a 5 year warranty. When work completed they asked for check to be made out to ******* ***** not Asphalt Paving and so my husband did. When we did not get a receipt for work I called on 9/2 and no answer on either phone number but left a voice mail with no return call. I called my bank to stop payment on check but it had already been cashed. I went on ******** page of Asphalt paving and started a live chat and was promised resolution to the unsatisfactory work and would hear back no later than 9/6. No return call. Left review on ** page 9/6 and got a nasty call from ******* **. but no offer of resolution. Got a text message from ******* *** 9/7 asking for my email address and no response when I provided this to him. Don't get return calls, email does not work and phone number on website different as well. The work is poor and will not hold up on the first snow plow of the year. I paid 5500.00 for a very poor job of seraling and leveling of driveway.

    Settelment: 1 Contract, 2 receipt ,3 seal driveway to hold up to plowing. or Refund 5000 for poor work.

    This business provided chip seal driveway paving for myself and a neighbor. We were both promised a receipt and a contract after the work was done. We have not received either. We were also promised a 5 year guarantee and have called and texted the business phone numbers multiple times to remediate some unsatisfactory areas of our driveways and have not received any response. Instead, the owner chose to argue with us. The workmen also sprayed tar on our electric box and electric meter which are located at least 6 feet from the driveway. The workmen had multiple arguments during the work and were very careless. We have multiple phone numbers for the business, as follows:

    We paid $8,000 after the work was completed by check made out to William R**** Jr. I have looked on the Colorado state website and cannot find a business license registered in the state of Colorado for this company.

    I spoke with the client I was out of town for several weeks I did not have a chance to respond but I told her I will gladly fix whatever needs to be fixed The problem Will be resolved as soon as possible I haven’t even had a chance to look at the driveway never even had a chance to fix it we guarantee all our work I’m very sorry for this issue but it will be taken care of

    I am rejecting this response because:  The work was performed 4 weeks ago yesterday.  We were told by William R**** Jr. that we would receive both a contract and a receipt via email.  We HAVE NOT received either document. 

    William R**** Sr. called me This past Friday evening, September 30th, and was extremely nasty on the phone call, claiming that he had been out of town because his father was on life support.  His prior excuse several weeks AGO was that he was out of town for a funeral.  Having worked in business for 41 years, both as an entrepreneur and a Chief Financial Officer, I am rejecting his excuses and his demeanor because 4 weeks is plenty of time to respond to my request for a contract and a receipt, as well as to let me know that he will follow up with an inspection of the driveway when he returns to town.  You don't ignore your business even in a family emergency.  You take your computer with you and do the required work so as to satisfy the customer.

    Monday, September 26th, I received a text message from William R**** Sr., as follows:


    William R****: "If you could please take me off the Better Business Bureau tell him that you spoke to me and We Are coming out to resolve the problem I would appreciate it."

    My text response:  "I am waiting to receive the receipt and contract so I can report that you are showing good faith in responding to my complaint"

    William R****: "I am going to have my guy stop by this week because I'm Trying to get it all straightened out for you"

    My text response: "Thank you"

    I am still waiting after 4 weeks to receive a contract and a receipt.  It remains to be seen as to whether someone will inspect the deficient areas of the driveway.  Thankk you.

    Please keep this complaint open.  As of today, October 3rd, 2022, we have still not received (1) a receipt, (2) a contract and (3) a visit from someone from Asphalt Paving and Chip Seal regarding the deficiencies in the driveway.  Tomorrow will be 5 weeks since the work was done, certainly enough time to at least provide us with a receipt and a contract.
