Both ******************************************************. Driveway previously gravel w/industrial PVC drainpipe for water drainage. When it rained the gravel driveway would slightly wash out to road, always fixable/drivable for over 10yrs. We partnered together w/Almar Paving to pave driveway & fix water drainage issue. Signed contract in place with 1yr warranty. Contractor is not warrantying work & refusing to repair/replace/refund when he confirmed he would fix. Contractor lied throughout entire job & very unreliable, we just want the work completed he was hired to do. He blames the town, weather, state, environment etc. Contractor ripped $500 stairs off my porch, ruined front lawn adding inches of rocks & tore out large sleeping willow ***** Contractor confirmed to put same PVC drainpipe that was in place for 15+yrs in that they took out, they installed weak gardening drainhose not strong doesn't hold & already exposed itself several time since job complete. Contractor rerouted entire water flow worsening situation. We asked if engineer was needed and informed no, denied showing proof of insurance. He encouraged us to use milled asphalt advising its essentially the same as asphalt when applying sealcoat & charged extra to sealcoat. He confirmed when applying sealcoat milled asphalt would ****** like a rock with similar results as asphalt. Per the contract the work is warrantied for full year from date of service. Work completed 9/21/23, driveway began falling apart 10/10/23, fully falling apart to what is seen in the pictures by 12/11/23, 3mos after work completed. When it rains driveway washes away pushing gravel & remaining asphalt in the road making driveway completely undriveable/unmanageable where we can't access our homes. Contractor came back to push rocks back up to the driveway from the road twice making driveway temporarily drivable but is ignoring us now & wont honor contract/warranty. Neighbor paid $8000 upfront; I'm paying $300/mo payment paid total $2000 to date.

    Customer Answer

    Date: 03/21/2024

The contractor has begun to send threatening messages that he will take me to court, his lawyer will be contacting me, for me to get a lawyer etc. He blames the town, rain environment etc for the driveway falling apart. However the attached pictures are from 10/10 just 3wks after the driveway was installed. This was just by driving or walking on the driveway. The driveway has slowly been falling apart from the beginning. The rain worsened it washing the driveway in the road as my previous pictures showed.

Good morning, this is a return answer to ******************,

this complaint is fabricated by her saying the driveway was inadequate but it was due to a natural disaster with 6" of rain in 3 hours of time and not only washed out her driveway but also washed out local bridges and many other driveways and roads, she used this tactic to stop paying as her shared driveway neighbor paid all of his share for driveway and also wrote a nice ad on ******** saying we did a great job. I had to put a mechanics lien on her home as well as sending her to small claims court, was also contacted by another contractor that she did this to them on a landscaping project on her home as well. I have since returned the driveway last week and regraded and added ******** to the driveway at my own cost. But yet haven't gotten a thank you or payment.
