    In June of 2021 I returned a car to this dealership due to a lease starting in 2018 that had ended. I agreed to lease a new car there, agreeing on a monthly charge, a $5000 down payment, and the dealer agreeing to pay any outstanding monies due to ****** ******* that relate to the 2018 lease. About a month later I received a call from the dealer that there was a check for me there, due to an over payment when I agreed to take on the new lease. Soon after I started to get notices from ****** ******* that I owed them monies due to the 2018 lease. I called the dealer on numerous occassions asking them what was going on, and they told me they would contact ****** ******* and straighten this out. Many calls between us ensued, and they insisted the payemt I received was an over payment on the 2021 lease. In oct ****** reposessed the car. I found out soon after that Darfars never paid ****** the monies they contracted to pay ****** ******* to close out the 2018 lease, and that is why they reposessed the car. I also found out soon after that the monies sent to me were monies that should have paid ****** *******. When I contacted ****** *******, they only agreed to let me purchase the vehicle at a much higher price than originally quoted when leasing the car. I refused. Now they have been chasing me for the monies they did not recover, when selling the repossessed auto. As far as my damages, they have ruined my credit, and the dealer not only has taken no but they also still have my $5000 down payment. I called ****** ******* and agreed to settle what they consider the past due, if they lease me another car, they refused. The dealer wants no part of this and clearly where making this transaction, committed fraud in what they contracted to do, and when made aware of the problem, did nothing to resolve, and after repossession was not interested. Up until after the repossession, Darfars insisted the monies given to me were an overpayment.

    CRM Sherlene L****, followed up with ***** ****  11/2/21 - Mr. ********* was given a check from us for $2,700 dollars which he deposited into
    his bank account, this was to cover overmilage and damage on his
    previous lease.  He was to pay ******** financial that money when they
    sent him the bill.  He never paid them and instead kept the $2,700. 
    Onto his repossession he never made a payment on his new lease. 
    ******** would not repossess the new lease based of a balance from the
    previous lease, the two are not connected in any way,  We have tried
    multiple times to explain this to Mr. *********,
    we have contacted ******** ********* but he needs to reach out to them
    directly as he was given the money to pay off his old lease, but for
    whatever reason has not made that payment or a payment on his new

    The texts below in green are mine and in white are the dealer .  I would like to reopen the case . There were many phone conversations previous to this and the answer they gave is totally untrue . They did not tell me that the CK belonged to ****** ******** until after the repossession and regardless contractually it was there responsibility 

    As far as not making payments on the new lease ****** continued to deduct monthly payments until they reposted the car. The end result is Darcars has my $5000 down payment, they destroyed my credit. And I am without a car. , and lastly ****** ******* is pursuing me on an unpaid debt they incurred selling off the car.  Hope you can help

    nothing to do with the old vehicle.  For the vehicle customer turned in dealer
    agreed to pay customer the $2600 in remaining payments that were left on customer
    lease, which dealer sent  customer a check for, and customer cashed and then went and
    spent the money instead of paying ******** *********. Dealer claims this case closed at this time with no further action at this time. Thank you, Sherlene L****

    understanding 

    I am rejecting this response because:   

    When signing the lease for the new car, I was told that Car Dealer would take Care of all payments regarding the old lease, and I would have no further obligation re the 2018 lease.   I started receiving collection notices from ****** Infiniti, which I had no idea of why they were being sent.   I sent text messages to the dealer, as well as calling him on the telephone,  where I am asking the dealer why ******  twas  trying to collect money from me, and it clearly states that the response I got from the dealer on   10/20 was the following   

    " I called 3x to Infiniti. They won't talk to me I will send an email to my contact at ****** to see what is going on"

         This response came from the dealer.,   Previous to this they just consistently told me the check they had for me was an overpayment.   Why wouldn't'   the dealer just have told me, on the many occasions  we discussed this after  they sent the check, that this was supposed to go to ******.   Why would the dealer be responding to me in Oct over 3 months after taking on  the new lease, that he was looking into it and would try to find out what is going on from ****** Infiniti.  Later that day I texted the dealer again 

    "I   think you should find out what the check was that was refunded to me after the deal was done."

    He response in the text was   "OK" 

    Does this sound like someone, who had been questioned about this on numerous times over the months, that the check they sent , was suppose to go to ******.  It clearly does not, as they told me on various occasions that this was an overpayment.  If the dealer in error did not pay ****** $2700, then why when I repeatedly asked them about it did they consistently say they would look into it. 

     

     Four months after the contract was signed i Think his response clearly shows that he had no idea of what the check was  that was sent to me,   I had no idea that ****** was owed monies as that was not what was told to me when I signed the lease, nor was it communicated to me through the many conversations I had with the dealer over the four months.   I don't think this can be disputed based on the chain of text messages.   Soon after the car was repossesed.   How is this not the dealer's fault
