    Issue: Owner of business is not refunding my 50% downpayment after I cancelled the agreement on the third day after signing.

    On November 1, 2023 I signed a Climate Care LLC (*******) proposal letter online provided by David S********* (the owner) for replacement and installment of heat pumps. I provided a cashier's check to him on November 3 which he cashed the same day. On Saturday November 4, I surprisingly discovered numerous bad reviews online regarding unprofessional work. I contacted my bank to stop the clearing of the check, but it was too late. I contacted the owner and cancelled our agreement by text and voice message on November 4. He called me back the next day and tried to convince me to proceed with the project or change it, which I declined. He explained he had to cancel his order and wait for credit before he would issue any refund to me. I don't believe he had time to make that order, as it was a Saturday. He told me it would take approximately a week. I have sent him one text message every 7-10 days checking the status of my refund. He's responded twice in 5 weeks providing no transparency, simply saying "we'll have a check for you shortly". By law, I have a right as a customer in ** to cancel within 3 days even though it was not stated on the proposal. I suspect this company has no intention of refunding me and would greatly appreciate some help from BBB.

    In July I hired Climate Care to fix my central air conditioning. My house fan was working and the AC was working ok except when it was very hot and the AC worked hard, it would occasionally freeze and I would have to turn it off for a few hours to thaw and then it would work again. Climate Care said I needed a new fan motor. They worked on my AC and said they put in a new motor and on 7/21 I paid them $1,285. One week later on 7/27 told them that I noticed that the house fan was always blowing and never stopped. They came back on 7/28 to fix the issue and after they looked at it, nothing worked - no house fan, no AC, nothing. They said they would have to get the owner David to look at it. It is now the end of October and we still don't have a working house fan or AC.

    We use the house fan and the HEPA filter periodically all year round (to help when someone is sick) so not just in the summer. The owner is extremely hard to get a hold of. I've called many, many times and he's generally unavailable. Many times I'm told he can't talk to me since he's working on quotes for others (but not on a fix for me since they already have my money). They have no store front so there is no way to stop by and talk to them. When i do talk to him he promises me that he will call or stop by at certain times but never does.

    I have been extremely patient, but I don't trust them to do anything now. I called on Monday to tell them i just want my money back (even though my AC is in a worse condition then when i first called them). I was told he would call me that night by 6pm. It's now Sunday and i have not heard from them. I want my money back so that i can hire someone else.
