      Termination of Agreement and Demand for Refund Due to Breach of Contract, Fraudulent Misuse of Funds, and Non-Performance This letter serves as formal notice of termination of our Service Contract, executed on February 5, 2024, due to material breaches of contract, fraudulent misuse of funds, and non-performance of agreed-upon services. You have failed to fulfill your contractual obligations under the Agreement, including: 1. The design, implementation, and management of my online store across platforms (Amazon, eBay, Walmart) as outlined in Article 1.1. 2. Delivering the guaranteed annual profit commitment of $31,996 as stated in Article 1.2. 3. Eliminating the “Ecommerce” Approach originally signed up for before your company changing direction to move to “Brick & Mortar” type retail selling & stores Additionally, I have reason to believe that the $31,996 fee I paid was misappropriated and used for purposes unrelated to the services outlined in our Agreement. Such misuse of funds constitutes **fraudulent behavior** and a direct violation of our contract. Demand for Refund and Compensation Due to your failure to perform your obligations and the misuse of funds, I demand: 1. Immediate refund of the $31,996 fee. 2. Compensation for lost profits and damages resulting from your breach. 3. A full accounting of all financial transactions related to my payment. Failure to comply with these demands within ten (10) business days will result in the initiation of legal proceedings to recover damages. This includes filing a fraud claim, pursuing arbitration as outlined in Article 3.1 of the Agreement, or commencing litigation. Legal Action Notice While I remain open to resolving this matter through non-binding mediation, I will proceed with arbitration or litigation if my demands are not met. Additionally, any attempts to enforce the non-disparagement clause outlined in Article 3.3 will be deemed unenforceable due to your material breach of the Agreement.

      I purchased the standard Amazon package from BMB Matrix LLC for $14,995. The package included services to manage my Amazon and eBay stores, with the promise of handling product sourcing, shipping, and overall store management. However, the products that were shipped through this service were used, damaged, and of poor quality. Consequently, these products were returned by customers, resulting in losses that BMB Matrix LLC promised to credit back to me, but I have not received any such credit. The situation escalated when products were not being shipped to customers as promised, leading eBay to permanently block my account from selling on their platform. On Amazon, similar issues occurred with products being either not shipped or of extremely poor quality, which severely impacted my account health. Despite repeatedly contacting BMB Matrix LLC, the company failed to provide adequate service or resolve these issues. As I was not making any money and faced a lifetime ban from eBay, I requested a refund. The company issued a termination letter stating that I would receive a total of $15,648.56 in monthly installments of $1,738.72, beginning June 11, 2024. However, as of August 2024, I have not received any payments. I have tried to contact BMB Matrix LLC through various means, including phone numbers and email addresses provided by the company representatives, but I have received no response. After leaving a negative review about my experience, I was contacted by Xavier, who apologized and attempted to persuade me to remove the review, promising that my check would be sent and that he would follow up. When I refused to remove the review until I received payment, Xavier threatened that the company’s legal team would block my check, effectively preventing me from recovering my funds.

      Business advertises a return on investment in the 1st, 2nd and 3rd months. This does not happen. They do not deliver items when 0, they miscalculate credits, expenses charged by Amazon are not accounted for. The promised 30% return on investment does not happen on average for all products sold, neither does it happen on many individual products sold. This all amounts to stealing as you are paying for these goods upfront for them to be shipped off, and instead the goods remain at their warehouse. Many customer complaints about bad products or not receiving their items. The poor management of tye stores results in them being shut down. They will breach your contract and when you want a refund will only offer it over 1 year period.
