As described in the two uploaded letters sent by my attorneys, in winter 2023 a
Riverside agent showed me a written quote for credit card processing services for my
small rural grocery store, Gorge Goods. After I agreed to the quote the Riverside agent
had me fill out an application on the spot. I was not given a copy of the quote or told me
that Riverside would enter service contracts with third parties on my behalf. I did receive
an email on March 3, 2023 saying I would pay $249/mo.
I am now being billed by Riverside and two related companies, Cascade Equipment
Leasing and Finova Capital, for credit card processing services/equipment leases.
I have had many issues with unfair and deceptive billing practices and failure to provide
me with correct services. This includes: (1) Riverside telling me they accidentally
created two equipment leasing accounts for me but not fixing the issues; (2) Originally
being billed by just Riverside and Cascade until after Oct 2023 when Riverside switched
me without notice or approval to Finova (and Cascade keeps billing me); (3) Having
    multiple unexplained charges of various amounts each month by the three companies;
    (4) Being billed noncompliance fees for things the companies set up incorrectly; and (5)
no one will provide me with invoices and a billing explanation despite me and my
attorneys asking repeatedly. As of 8/29/24, I was overcharged by approx. $14,618.67.
This number has only grown since Riverside, Cascade, and Finova keep charging me.
My attorneys told Riverside, Cascade, and Finova about the above issues and
requested termination of my contract and a refund for the amounts that I was
overcharged. No one would terminate my contract or provide me with a refund for the
overpayments. They also wouldn't provide any invoices for what they are charging me.
Instead, they are asking that I buy-out the different contracts with them for thousands of
dollars. The attached emails between them and my attorneys discuss this.

    Good Morning ******,

Thank you for contacting Cascade Leasing.
Cascade acts as an equipment broker and is not involved with your merchant processing. Based off our findings, please refer to your agreement with your merchant processor. If you have a special condition agreed at the time of signing with Riverside Payments, you must contact your merchant processor’s representative to discuss the terms of your merchant processing arrangement.

The agreement signed through Cascade Leasing was initiated in February of 2023 and is set to complete in February of 2027. This is a non cancelable lease for the full term under the conditions of your agreement.
We appreciate and value your business, please give our team a call directly if you would like to discuss this further.

    Sincerely,
    Cascade Leasing

Cascade Equipment Leasing via Evergreen (1) fraudulent misrepresentations, misleading tactics, unethical practices, false statement to persuade us to enter contract; (2) forged signatures. It was not explained that multiple companies were involved; and still not clear how each of these companies relates to the business relationship our company was “sold” with Evergreen. Ended business relationship July 2024. Reps state several times FREE equipment and $0 expense to our company. After multiple requests for copy of documents plus monies deducted from bank account, we discovered 48-month Equipment Lease with total payment over $20,000. One unit needed, received five. Told since FREE equipment, keep them in case unit breaks. Charged for five units. Requested return address for equipment, told “stuck with them”, no return address provided until lease is paid. Unreasonable AND gross proof of unfair lease to force customer to pay over $20,000 for $500 worth of equipment. Evergreen/affiliates are party to document fraud. ******* ******** (Sales Rep) said “here let me help you” quickly clicking document fields. No proof contract electronically signed by CJ, in person, physically clicking fields – No proof sent to valid email address or opened by CJ. Audit Report has unrealistic times and incorrect/invalid date. We have undeniable proof signature forged on agreements and data on forms is inconsistent. Unethical business practices are concern for consumers and need be reported. Complaints are in process of submission to applicable local, state, and national consumer agencies, as well as blasted via all social media and consumer services outlets. The SCAM of Evergreen and all affiliates must be exposed. We ask our company be released from all contracts/agreements with Cascade Leasing with no cost to our company AND monies paid to all parties by our company refunded in full to avoid further action in this case.

I have reviewed the response made by the business in reference to my complaint and have determined that this does not resolve my  issue.  For your reference, details of the offer I reviewed appear below.Bottomline, Cascade Leasing is ignoring our company's claim of their acceptance of an agreement with fraudulent and forgery actions within it... although we have provided proof of our case. If Cascade Equipment Leasing permits
Evergreen Payment Solutions to represent them in formalizing contracts, then
they should also be held accountable for the unethical conduct committed by Evergreen Payment Solutions.
I have included "Attachment #2" as detailed response.

I am reporting about this business after finding out about the scam they are running with Riverside Payments and hurting small businesses like mine. I no longer want to be a part of their business and I no longer want to use their services, but they are telling me that it will be thousands of dollars to cancel my contract. They are telling me that it is a “non-cancelable” contract, but I was not informed of that until I tried to cancel their services. They are trying to charge me for equipment that I am willing to return to them in the same condition that I received it in. I wish I would have seen the other customer reviews before agreeing to use them for my small business because they are doign this to many businesses and putting small businesses in danger of going out of business. They did not tell me that it was a “non-cancelable” contract when I signed. I am willing to pay their restocking fee for the equipment but I should not have to pay $6000 for a piece of equipment that I am going to send back and that is not worth $6000.

For our business, we chose to lease Clover POS system. In the lease agreement explicitly stated that I retained the right to terminate the service as needed (see attached file named **********_MEAT_Agreement.PDF). Despite this, they proceeded to sign a non-cancelable lease agreement for 48 months without our consent. Now, they insist that we are liable for the remaining months. We seek clarification on how the company could sign without our knowledge and why we are being held responsible.

Furthermore, we have provided both the original documents we received and the allegedly forged document from Cascade Equipment Leasing (**** ***** Meat LEASE_Forged.pdf, **** ***** Meat AUDIT_Forged.pdf).

Despite our request to cancel the service, they continue to charge us every month for the equipment. We have also requested a return label for the equipment, but they have failed to provide one.

Here is the rephrased version of your statement:The Lease Agreement with Cascade (**** ***** Meat LEASE_Forged.pdf) was never sent to us via DocuSign by BPO Bench or Cascade. We received and signed only one document with BPO Bench i.e., **********_MEAT_Agreement.pdf. We suspect that BPO Bench may have forged our signature without our knowledge. As a result, we were unaware of the Equipment Lease that requires a 48-month payment. The only document we received was (**********_MEAT_Agreement.pdf).
    Attached both documents.

Cascade Equipment Leasing did not inform us how to use any of their products and neither them or the company that they worked with called Northwest Payroll solutions ever called to help us with the machines that were mailed to us without any explanations or any technicians to do installation or any customer service support from across the country. It took them 7 months to apologize that they had done nothing other than mail the equipment machines to us. Terrible company and terrible customer service. Northwest payroll finally agreed that they had done nothing to help us, but Cascade Equipment is continuing to give us no help and sending monthly bills. They also told 2 of us who both attempted to contact them totally different explanations and answers every month that we attempted to call them. We had to get our bank to get some of our money refunded to us. Our bank which had excellent customer service and understood exactly how we were fraudulently treated by Cascade Equipment Leasing helped us to stop payments after 4 months of automated payments. I hope no other small businesses use any of their equipment or experience their terrible customer service.
