I don't know where to make my monthly payment for Nicholas Financial **** of **********..I haven't heard anything from Nicholas Financial , concerning my payment for the month of November '2022. In previous months they usually reach out to me concerning payment. They website states that Nicholas Financial *** of *******, ** is premantly closed. Our company sent each cusotmer a letter advisign them that their local branch office would be closing and informed them of the new address to which payments can be sent. Also, at this time the cusotmer can still use all other payment methods that we show on our website which includes online payments. Only the branch mailing address has changed.
The customer may mail his payment to ** at: Nicholas Financial, Inc., **************************************************************************************************, or call ** at ************ to make a payment, or log in and pay online. I encourage the customer to watch he mail closely as the account servicing information will change permanently in december of this year. Mailings will be forth coming.

I am not liable for this debt with Nicholas Financial *** and do not have a contract with them. They did not provide me with any original documents or signatures like I asked. This debt was not properly validated.Business Response

Validatin of debt rules apply to 3rd party collectors and/or creditors who were not the original creditor. The laws exist because a cusotmer may not know who the company is.
In the case of this customer's account, we are the original creditor so she is well aware of who we are. Prior to approval of the account we spoke to the cusotmer, required drivers license, copies of paychecks, copies of utility bills, personal references etc. Additionally,this account financed a vehicle that was registred to this customer, original insurance info matched the cusotmer, phone numbers used to speak with the customer match that used on this complaint. The vehicle was then repossessed from the customer after default and the credit report reflects informatoin accurately.
We welcome the customer to contact us if she would like to settle her obligation.

My husband and two of my children were involved in a car accident on March 28, 2019, in a vehicle we purchased that was financed by Nicholas Financial. Someone rear-ended the car in front of us which caused us to be hit from behind and knocked into the car in front of us. I suffered a back injury, while my husband injured his neck. Thankfully our children were not hurt. Our truck was totaled according to Nicholas Financial. We were told when we purchased this vehicle that *** coverage was included. It was not due to an error between the car lot and Nicholas Financial. During this time, my husband and I both had to attend physical therapy and I have a lifelong injury to my back. We also both were continuing to work. Nicholas Financial was paid nearly $7,000.00 by the insurance company, however, due to the lack of *** coverage, approximately $1,500.00 was left owed. Nicholas Financial proceeded to harass me daily concerning the amount that was still left owed while I was still working in order to take care of my family and attempting to recover from the accident. They were relentless and did not care about anything else. Today (10/10/22) my husband who is currently in heart failure received documents that he and I are being served and taken to court over the $1,500.00 left owed. This company is disgusting, heartless and greedy and it needs to be stopped. They continue to harass us even though they received more money then we did from the accident, not to mention the fact that they lied to us about the *** coverage. My husband is unable to work due to congestive heart failure so I am keeping everything afloat. I also have my own health issues to deal with while I continue to work. I just cannot express enough how disgusted I am with Nicholas Financial.Business Response

Tell us why here...I've reviewed the customers complaint as well as the account history, and account notes.
In looking at the retail installment contract the customer did not purchase a GAP waiver policy. It is important to understand that Nicholas Financial was the company that purchased the loan that the dealer made to the customer and plays no role in what product may have been offered to the customer. Had they chosen to purchase a GAP product it would have been listed on the retail installment contract and a separate GAP agreement would have been signed by the customer.
It may help the customer to know that even if she had purchased GAP insurance, she still would have had a deficiency balance in that GAP only pays the difference between what the insurance company pays and the balance would have existed as of the date of loss ASSUMING each and every payment been made exactly on the due date with no extra fees, deferments etc.
In this case, due to late payments, late fees, extra interest and deferments the customers balance was significantly higher than it would have been had the account been paid as agreed.
We sent the customer a deficiency breakdown and discussed it with the customers on about 3 occasions,but they refused to pay the deficiency.
Note that Nicholas Financial is not suing the customer.After the customer refused to pay their obligation to us, we sold the account to a 3rd party, and we no longer have any interest in this account. We suggest that she contact the party who sued her as they are the holder of the retail installment contract.

I am rejecting this response because: We never owed this company a debt which we stated to them repeatedly and continue to stand by. Nicholas Financial took advantage of a situation as I can see by the reviews of others has happened repeatedly. I will not allow myself or my family to be bullied by ANYONE and will continue to fight this. Whether they have chosen to sell the debt for pennies on the dollar or not, ultimately this was put into motion by Nicholas Financial. I have worked in the legal field for over a decade and am fully aware of my rights as a consumer. This company needs to be investigated and shut down for their practices. I am also taking action on my own because this cannot continue.

I'm depressed and suicidal after dealing with the unauthorized use of my personal information. Which resulted in this unauthorized item on my credit report. I sent letters over 30 days ago and they failed to get back with me with sufficient validation. I've reviewed the customer's account as well as his history and complaint/dispute logs. The customer and his wife have both filed several disputes both direct and indirect each time claiming something different.
In regard to the validation letter he references, we responded informing him that as his original creditor we are not subject to validation of debt rules. This rule pertains to 3rd party collectors or creditors as the customer would not be familiar with them. In this case we were the original creditor having financed the customers car for him. The customer included our company in a chapter 13 filing, which was subsequently dismissed, further showing that he is aware of both the debt and Nicholas Financial, Inc.
With each dispute received we have reviewed and verified that we are indeed reporting correctly. We invite the debtors to contact us at ************ if they would like to work with us in resolving their obligation.Initial Complaint

This company has employee texting their customer from their personal cell phones. Ive asked that they identity themselves but the employees refuse. *** also asked that they not text *********** me on the phone during certain hours which are my work always. I've reviewed the cusotmer's complaint as well as the account notes and history. Our records show that the cusotmer did opt in for text messsages but based upon her email I have now opted her out so she will no longer recieve them. I also see via her attachements that it was identified that the text was from Nicholas Financial.
The customer has also issued a cease and desist letter for phone calls. Now that we cannot call and cannot text it is important that the customer understand that all payments must be made on time or she will need to have called our offices during business hours prior to the due date to make acceptable arrangements with a representative. With this in mind she will want to call us immediately to make arrangments for the August payment and upcoming September payments.

I am not accepting NF response. When I asked the employee to identify themself they DID NOT! They just said Nicholas Financial. With all the fraud and security breach going on that is not a safe to communicate with a customer about an account. Also, the threat to let someone else know my account information is unacceptable. This is no way to conduct good business. All I asked was for the employee to identify themselves so that I will know that this is Nicholas Financial and not a scam.

This account from Nicholas financial has been paid in full as of 02/2018. Was opened in 2014. I've disputed this account with all three credit bureaus. Still remains on my credit. Shows up negative even though its paid. I've asked for this to be removed. One lady told me they could remove it then switched me to another person while on the phone. This happened 08/21/2022. This man was rude and initially told me they would not remove it after I told him I would contact the better business bureau. I would just like this account removed from my credit report and my fiance ********************* credit report. I have reviewed the customer's complaint and the account history as well as any disputes. The customer has disputed what is appearing on her credit report several times and each time we have investigated and confirmed that we are reporting correctly
She is correct in that the borrowers paid the account in full in February of 2022 and we are reporting as such; note that any delinquencies that occured while the account was open will stil be reported. *********** typically leave credit lines on the report for 7 years after the date of last activity at which time they will most likely delete it.

Debt validation laws exist for use with 3rd party creditors or collectors which mean companies that were not your original creditor. These laws make sense in those instances as the debtor may not be aware of who the company is.
In this case we are the original creditor not a 3rd party and as such we are not subject to validation laws as our customer are aware of who we are. ********************** financed the customer's care for him on 01/12/2019 and he made payments to our company until we repossessed the vehicle for non-payment in 2020. As such he is well aware of who were are.If he has any specific questions about his debt we invite him to contact us at ************ and we will be happy to give him any details that he needs and work with him to make arrangements to pay his remaining debt.

I tried to get a consumer loan with Nicholas Financial. They say there is no credit credit that they will use items in your house if for an unsecured bu they require your social security number anyway.
So i was told today that I did not qualifty based on my credit score even though i told the guy yesterday that my credit score was low and he told me they go throught different companies. So this is basically false adverstising. and i want to be able to get the loan i applied forBusiness Response

I've reviewed the complaint. It is unclear what she is actually complaining about. Based on the information she provided it appears that her credit score may not have met our requirements? As with any lender, there are credit, income, housing and debt ratio requirments as well as collateral requirements. All of our advertising state that all loans are subject to credit approval.

their website says they do not consider credit whan making a determination. They use objects in the home. I tole the guy when i called that i had bad credit and he said there are people that will work with me.

I am distressed that NICHOLAS FINANCIAL have included the referenced inaccurate information on my credit profile.
