I gave them a deposit for my foam insulation project . I ran into some health, mold and renovation issues. I had to cancel my order as it was gonna be atleast 6 months to recover from it. They said no problem . I never received my deposit check back . I tried contacting them an several occasions. With No call backs . 10 months have gone by after all the renovations are done . I called them again and said I either want the foam or my deposit check back . They said they would call me back . That was 4 weeks ago. At this point I no longer trust this company and just want my ******** deposit check back .Business Response

I am rejecting this response because:I will believe it when the check arrives . Ive offered to pick up a check . Because they keep telling me it was in the mail . They told me this 10 months ago . So if they sent just sent another other one in May in the mail . It's obvious I haven't cashed anything. Or the address is incorrect. Or there just giving me the run around again. When the check arrives or I pick it up then I will accept this response. At this point I don't believe this company.

I've been in contact with *********************** trying to get a refund of my deposit. We sold the home we were under contract for very quickly months ago. I let **** know shortly after we paid the deposit and we've been looking to get a refund since. We have no intention of doing any foam work in the new house and I've been following up with **** almost weekly with no forward movement. Deposit refund is now holding up some projects on the new house. I've tried numerous email addresses to the company all coming back "unknown". We paid Solar Bear (aka Inpositive Energy Co, ************), $6000, on 12/5/2023 to spray foam insulation our attic & remove existing fiberglass insulation. -Fiberglass insulation was to be pushed into eves & then foamed over making attic air tight. The fiberglass was never put into eves, as a result foam insulation is seeping through the soffit on the exterior of my house.-while they were working I heard constant loud banging on ceiling and began to notice cracks in my ceiling in numerous locations. I called one of the workers named **** into the house to look at it. He admitted that his shoes were ************* was slipping off the floor joists multiply times causing the cracks & that the company would repair it.I proceeded to get estimates from drywall contractors ranging from $16,800 -$20,000+. I called Foam Bear and spoke with the owner, Blake Ambrester. He said the damage was due to faulty construction when the home was built. He had his expert, *************************, come out & he concluded there was no faulty construction and the problem was caused by Foam Bear. Blake stated our estimates were ridiculous & his repair tech would fix it. The tech, was ill equipped and googling drywall repair techniques, using my personal tools. The job is botched beyond imagination and my home is in a shambles with drywall ************* everywhere. The ceiling is in unsightly disrepair. The repair was supposed to take 3 days, we are on day 9, living out of the master bedroom. We are unable to use kitchen, due to plastic rapping & have had to eat all meals out, another expense to us. And the company has stopped responding to us The contract that we signed had an addendum added that any damage that the company caused they would be responsible for the repair . We contacted our sales person, *******************, he has since resigned from the company due to multiple complaints from his clients due to faulty workmanship and lack of response from the company.Business Response

We have repaired and installed new drywall. The customer still owes $12,000, and until that is paid, we can no longer work on this project. The work that they were contracted for. The cracks in the ceiling were also repaired. We also agreed to have the customer remove $500 to get the house professionally cleaned so make sure all dry wall dust is removed from the home.Customer Answer

I am rejecting this response because:1. As noted in the original complaint, Foam Bear was paid $6000 at the start of the job, the remaining balance was to be paid upon completion. They did not complete the job.
2. Their attempt to fix the damage that they caused by cracking our ceilings was inadequate. The entire ceilings was clumped or humped with drywall mud, the knock down pattern did not match throughout the attempted repair area. The technician was You Tubing drywall techniques and calling his stepfather for advice on what to do while working on our house. Our home was left in a shambles with every surface covered in dust or mud.
3. We had a professional cleaner come out to give us a quote and we were told " I've never seen anything this bad. It's beyond my scope and you should hire a lawyer."
4. We hired a reputable company to come in and do the repair properly. This job was completed in 3 days.

We are rejecting the response of Mr. ********************** because it is untrue. We paid him $6000 on 12/5/2023, see attached photo of credit card statement payment to In positive Energy *** with the remaining balance to be paid upon completion of the job. The job was never completed to the specifications of the contract, see attached contract, specifically the page where it states the company is responsible to repair any damage they may cause. They did send their "expert" out to repair the damage. As stated before the expert was looking up drywall repair on ******* while working at the house as well as calling his stepfather to ask him what to do. The repair job that was to take 3 days was never completed after 9 days. The ceilings were not to the condition they promised nor to the condition prior to the damage done. The ceiling was not taped or prepped as it should have been and drywall plaster was humped and caked over the cracked areas. The knockdown pattern did not match anywhere as there was no pattern, just slung plaster. The mess that was created in our home was horrible. It was not just drywall dust we were complaining about, there was drywall plaster everywhere. I found spackle on the bottoms of brand new recliner chairs and table, see photos. Brand new appliances had spackle and dust all over them. When I say every surface of our home was covered in dust and plaster I am not exaggerating. We lived out of our bedroom and bathroom for almost 2 weeks while cleaning our home ourselves. They did offer to reduce the price by $500 to have a professional cleaning company come in and clean. We had a professional cleaner come to give us an estimate and they stated this was beyond their scope, they'd never seen anything like this and we should hire a lawyer. We have since hired a reputable company to come in and repair our ceilings properly as we asked Mr. ********************** to do and we have retained an attorney as Foam Bear has stopped communication with us.I have attached photos of the damaged/cracked ceilings also. The photos of the damage after the repair attempt will be sent in a separate email as the files are too big to attach to one.Attached is the copy of the credit card statement showing payment. We have not stopped communication. We repaired the cracks in the ceilings. When doing drywall there is a lot of dust, even when everything is covered in plastic. That is why we offered to have the home cleaned professionally. We have cleaners that specialize in construction clean up. We don't hire ***** maids and any company like that as that is not the type of work they do. The customers total was ****** for the work, we received $6000, and have not received any other money. I have attached the photos of the ceiling fix and the clean up that the customer is claiming we did not do. Its in our contract that when we install spray foam in the attic, that cracks in the ceiling can happen. Especially in older homes. In the contract we state that we are fully responsible to repair any damage. We have dry wall repair techs on staff that handle this specifically. Nov 8th, 2023, I requested to cancel the foam spray service in my home because my son in law. Had this service done by the same company a week before and they did a really bad job that they damage his AC Unit and I did not want to risk my home with their bad service. So, I reach out and canceled it. I also reach out to the lender Good leap and they informed me that foam bear was already paid for that service and that Foam bear had to refund me the money for the service I did not accept to get. I reach out to ***** from Foam bear after several attempts she finally answer me and told me that she was going to confirm with her management about the refund several weeks past again and I reach out again to the lender and spoke to *****. Regarding my issues with Foam bear regarding my refund and she reach out to foam bear, and they confirm with her the amount of my refund that is $3600 and they opened a complained. to foam bear until they pay me out. But that has not happened. On Dec 8th I called and finally got a hold of ***** from foam bear, and she stated that the refund was sent but today is 12/18/23 and still no check. FOAM BEAR has not reach out to me they do not answer my calls or emails I call every week to get an update and no luck. I emailed Blake Ambrester, ***************************, ***** my last email to them for an update was on 12/14/23 and still no one has called me or replay to my emails.I want my refund sent to me which they are aware of it and confirmed that I Have a refund for $3600 for the service they got paid for but for a service I did not get due for them being unprofessional on how they do their jobs.Business Response

In September 2023 I contracted with the company Foam Bear to remove the old insulation and re-insulate our attic, Prior to the work starting I was to receive a phone call confirming the date and time, that never happened. This was the start of poor communication from this company and a sign for the thing to come. I called and the confirmed and the work started without any issues in the insulation removal. 2pm the second day the team came to install the foam insulation, they worked throughout the day without any issues or so we thought. After 2 days the fumes and smell had subsided and we were able inspect the work that was done. Upon entering the attic we found that our a/c handler had been completely blocked off and the light that we had in the attic had been buried in insulation. We immediately called the sales rep. and he stated, sometimes that happens and if we wanted for an additional expense, we could have them come back out and create an new access entry point somewhere in the home. We explained that that would be unacceptable and wouldnt work as the insulation wall made it impossible to remove the filter or have any access to the drain pan. He told us that there was nothing they could do, so I called the company the next day . I received the same response from the company, so I requested that a manager or the owner call me. I wanted to have someone to come see what had done. After 2 weeks and several phone calls, they scheduled someone to come out, not to inspect but to move the wall. I still have not received any communication from the company, My complaint is this, the insulation was not done and sealed over the all of the interior home as told contracted, because of the position of the A/C unit. They should have known this was going to be an issue upon their initial inspection. when they inspected home prior to us signing the contract. I should have to pay work not completed as contracted and I should not have been deceived in the process and work to be completed to sign a contract. At this point I have still not heard anything from anyone at the company. This is an unregulated industry and this company is clearly after your money and not the results. We are not charging the customer for installing the scuttle hatch. This is needed when there is only one attic access in the garage, and when the ** is in the attic. We have to seal off the warm Unconditioned garage from the rest of the house because if we don't, it allows warm air to mix with the cold air in the attic and that causes moisture ( condensation) and eventually mold. This is a normal part of the install process and we will not charge the customer for the scuttle hatch if they allow us to install it. This will solve this complaint.
