On 06/07/2022 I was involved in a car accident. Ocean harbor casualty ( pearl holding group) was my insurance company. I had insurance with them from September/21 until September/22. I filed a claim and was given total loss package paperwork on claim: s3260442-01-7350. The company appraised a settlement of $1962.90 after a $1000 deductible. I did tell them I wasn't satisfied with it and was told I had to get my own appraisal. I tried and wasn't finding anyone to help. I contacted a lawyer ( at first to try to get something from the uninsured driver who rear-ended me), but asked for help with that also. I thought they would have their own appraiser. I was wrong and after a month was told they couldn't help me with either situation. I filed the paperwork for the total loss last month. I mailed it and my title to the insurance company. I haven't heard any response about that paperwork and have been trying to get in contact with them. It's difficult. I did get some emails form someone there, but it wasn't my original adjuster. I mailed ,faxed, and emailed another copy of the paperwork last week and have had no response. This accident has really put me in a spot. Now I need the settlement more than ever and have not been contacted.

My daughters car was hit in a parking lot by a woman. Instead of doing the right thing, this woman reparked away from my daughters car then got scared and left. My daughter had an eyewitness who took a picture of this womans car and plate. My daughter immediately notified the police and a report was made. Well after no one bothered to call my daughter back I got involved and a letter and email was sent from pearl holding company stating the thier client was never in an accident so the claim will be denied. Um hello? There was an EYEWITNESS and my daughters car has damage. I appealed this and it took them 3 weeks to respond to me with a statement that ***** insured was never in a wreck. Im looking into taking legal action against this shotty company that should not even be in business. Its called a claim for a reason and it needs to be looked into and investigated.

      Dear Sir/Madam:

I must respectfully submit that Ocean Harbor has deemed **************** vehicle to be a Total Loss.  We accept 100% of the liability and property damage to his vehicle regarding this loss.  Enclosed is a copy of our offer sent on 07/17/22 of $3,270.70, for the pro-rata share of the $10,000 property damage limit of our insureds policy that ************** is entitled to as a result of this loss, provided that there is no cost to pick up the vehicle. This offer was based on a pro-rated amount of the value of **************** vehicle of $7,437, based on the enclosed CCC, plus $210 added for loss of use of 7 days at $30 per diem, to the total amount of all losses, which was reduced from $7,647 to $3,270.70 due to the $10,000 property damage limit on Mr. ******* policy, as we attempted to make a global resolution on behalf of our insured.  The damages to all the vehicles resulted in total damages of $19,955.79, exceeding the $10,000 limit of Mr. ******* policy.  A breakdown of the pro-rated amount based on the Total Loss value of **************** vehicle is enclosed in our offer.

Regarding the value of the vehicle, the CCC report is a report that is standard in the industry and has been recognized by insurance companies as a tool to determine the true market value of the vehicle. The ********** of ********* Services has accepted its use as a tool for insurance companies to determine the market value of a Total Loss.

Settlement was delayed as a result of not receiving supports from all of the claimants.  This loss involved several vehicles, and we attempted a global resolution on behalf of our insured.  We needed to evaluate the damages to all the vehicles as the result in total damages exceeded the limits of the policy.

In accordance with Statute ******, the insurer, Ocean Harbor, must apply for a Certificate of Destruction.  Ocean Harbor is unwilling to apply for the Title in its name without having possession of the vehicle (as it is a dangerous instrument).

Once we obtain possession of the vehicle with keys, a Property Damage Release will be sent to ***************  Upon receipt of the executed release, along with properly completed Total Loss documents, a lien-free Title, we will issue payment.

      Respectfully,

I do not have possession of that vehicle the accident was on 10/07/21 it's almost a year and trying to communicate with this company as being a nightmare from the beginning. I have my title and a certificate of Destruction. Now they want to pay me less than half of what my car is worth and what it to be contingent upon picking up a Vehicle almost a year later.

I filed a property damage claim with them after being in an accident with one of their insured, in which my car was totaled. This accident happened on June 17th 2022, and the claim was put in the following day. My car was appraised on Saturday June 18th. They have had a pending payout amount since then. This is all the information Ive been able to get from them. I do not know the amount, all I know is that there is a payout pending. I have not heard from the adjuster even once, although I have reached out to her directly with her phone extension and email. I have only heard from other people in the company, about 3 times total. My totaled car has been sitting in my yard since the day of the accident, for over 3 months, which is far from ideal.

I submitted a complaint to this company due to a car accident. Their customer/client crashed my car. I have a police report. This company sent me a letter/docusign to my email with my last name spelled wrong. I'm not in agreement with the first paragraph in where the company states that they are not responsible for the damages. The terms in the letter are not clear. If they don't respond immediately, I will take legal actions.

      Business Response

The letter ****************** is referring to is our Mitigation letter.  It states we are not responsible for any property damage, loss of use, storage charges, or rental expense incurred as a result of his failure to mitigate his losses.  This is in accordance with tort law.  The claim is currently under a Reservation of Rights due to our insured's lack of cooperation in the investigation of this loss.  If ****************** has a copy of the police report he should send same to us as it will expedite the investigation of this loss.
