      Complaint Regarding Unauthorized Tree Removal by Southern Turf ****On January 16, 2025, Southern Turf **** arrived at my property in response to a request from my neighbor to trim branches from my trees that extended over their property line. Prior to the work beginning, I spoke with ******, a representative of Southern Turf, who assured me that the work would be limited to trimming branches at the property line. Trusting his assurances, I returned to my work as an online ********** my shock, while I was at work, ****** and the crew from Southern Turf went far beyond the agreed-upon trimming and completely removed two trees on my property: a healthy rubber tree and a Ficus. Only the stumps of these trees were left behind. Additionally, other landscaping elements on my property, including plants and ceramic planting containers, were damaged during their work.These trees were healthy, mature, and integral to my property. I estimate them to have been 25 years old, providing privacy, shade, and sentimental value. In particular, the rubber tree held great personal significance, as it was grown from a potted plant gifted to my wife by her grandmother. The loss of these trees is irreplaceable, and their absence will likely lead to higher utility costs due to increased exposure to sunlight.The actions of Southern Turf **** were unauthorized and directly contradict the verbal agreement I had with their representative. Their carelessness caused not only the destruction of valuable property but also emotional distress. I expect Southern Turf to acknowledge this unacceptable behavior and to take responsibility as well as correct their actions. I was not a customer of **************** and before they showed up and destroyed my backyard, I had no previous business with them.

      Dear *** ******************************** submits this response to your demand letter dated February 14, 2025, regarding the removal of trees impacting the property at *********************************************. This letter is to formally reject all claims asserted in your letter and to clarify factual and legal inaccuracies contained therein.
      I. Justification for Tree Removal Under Florida Law
      The trees in question posed an imminent danger to *** ********* property, as documented by a certified ISA arborist's emergency assessment, which concluded that their roots were actively causing structural damage to her homes foundation, creating an urgent risk to life and property.
      Florida law under Fla. Stat. ******* explicitly provides that a property owner does not require a permit to remove a tree if an ISA-certified arborist determines it poses a risk. The report and accompanying photographic evidence show:
      Cracked and failing foundation walls due to invasive root expansion.
      Severe structural damage, including water intrusion, caused by root movement.
      Broken windows and compromised structural integrity directly related to tree growth.
      As such, *** ******** had full legal justification to remove the hazardous trees from her property.
      II. No Trespassing or Unauthorized Action
      Contrary to your letters claims, Southern Turf did not enter *** ****** property nor perform unauthorized work beyond the property line of *** **************** ******** engaged Southern Turf to remove hazardous tree growth that was directly impacting her home, including root systems that had already caused severe damage. At no point did Southern Turf intentionally enter *** ****** property. Any assertion of malicious trespass is unsubstantiated and legally frivolous.
      Further, your claim that a Southern Turf representative assured *** ***** that only branch trimming would occur is baseless hearsay and is contradicted by the emergency arborist report.
      III. Misrepresentations in Your Legal Demands
      Your letter makes numerous claims that misrepresent the law and seek damages that are neither supported nor recoverable under Florida statutes:
      Tort Recovery Issues You attempt to claim aesthetic damages, increased energy costs, and property value lossnone of which are recoverable under Florida law without statutory backing. Further, your demand for $25,000 in damages is entirely speculative and lacks any legal foundation.
      HOA Violations and Legal Costs Florida law does not allow a private party to recover legal costs for alleged HOA violations. HOA matters must be resolved through the associations internal administrative process, and your attempt to claim damages related to an HOA violation is legally unsound.
      Malicious Trespassing The claim that *** ******** or Southern Turf trespassed is without merit. The tree was encroaching on *** ********* property, and Florida law grants her the right to mitigate damage caused by an invasive tree. Your letter fails to provide any legally valid basis for a trespassing claim.
      Mediation Requirement Under Florida law and HOA governance policies, this dispute is subject to mandatory mediation before any legal proceedings may be initiated. If your client refuses mediation, we will immediately seek dismissal of any claim on the grounds of failure to exhaust administrative remedies.
      IV. Pattern of Bad-Faith Claims by *** *********** has come to our attention that *** ***** has a history of making baseless legal threats against neighbors in an apparent attempt to extract meritless financial settlements. This pattern of conduct will not be tolerated. If he continues this behavior, we will document these incidents and take appropriate legal action to prevent further harassment and bad-faith claims against *** ******** and others.
      V. Property Violations by *** *****
      Additionally, Southern Turf has identified multiple violations of property boundaries by *** ****** including:
      His fence is unlawfully encroaching on *** ********* property.
      Irrigation installed by *** ***** or his contractors is impeding the property line.
      Should this matter escalate, we will petition the appropriate authorities to enforce removal of these violations at *** ****** expense.
      VI. Legal Harassment Against a Cancer Patient
      It is particularly reprehensible that your firm chose to target *** ********* who is undergoing weekly chemotherapy treatments while battling cancer, rather than addressing this matter through the proper legal and HOA channels.
      This appears to be a deliberate strategy to pressure a vulnerable individual, assuming she would lack the energy or resources to defend herself. If you continue this course of action, we will seek legal sanctions for filing a baseless claim in bad faith.
      VII. Resolution Proposal
      Southern Turf is open to a reasonable discussion, including the planting of a replacement tree of equal or lesser size and species, but we will not entertain excessive, speculative claims. If this demand letter is not withdrawn within 15 days, we will proceed with all available legal defenses and counterclaims as outlined above.
      This is our final communication regarding this matter unless legal action is initiated.

      We hired this company on May 26, 2024 for the following job on 3 acres of land. The site was visited 2 times and a written contract with detailed scope of work and specifics of the job written in a three-page contract detailing the following:1 cutting down all the trees and mulching them down to the ground up to 1 inch size for all the trees less than 8 inches in diameter 2 All tree stumps and roots to be off the ground and buried on the side and closed 3 Any tree trunk more than 8 inches in diameter will not be mulched 4 Digging a pond 50 feet wide and deep enough to head and Aquafer for natural pound with 4:1 grading of the slopes.5 All the aggregate excavated for digging the point to be spread and used for leveling the surrounding property After 2 site visits and negotiating for external labor the initial contract of $18,000 was readjusted to $19,500.Our whole family had an international travel booking and where promised the project would be completed prior to our departure and under our supervision.The project start date was not met supposedly due to machine failure and started just a day prior to our ************ per our contractual agreement, we paid 2 out of the 3 checks prior to our departure and the third was handed over to our elderly neighbor to issue it upon my clearance after completion of the work.After returning from our trip we assessed that major items of contract where left unfinished and all the payments where taken from my *********** seen in the pictures, we have 2 big piles of uprooted trees and stumps at least 20 feet high and 70 to 80 feet long which should have been mulched.The pond does not have any water but only a steep pit with no grading.After failing to convince the company to return and fulfill the contractual agreement, I was forced to send demand letter through an attorney.The written response does not address any of the above breach of *********** attorneys see your intervention prior to filing a lawsuit.

      I am rejecting this response because:

      This response includes only an inflated list of time and machinery used.
      We never asked for that, the question that needs to be answered is the failure to fulfill the contractual obligations as per scope of work defined in the contract and the evidence provided in the pictures attached
      I have detailed text messages and emails sent to me from my neighbor who was responsible for issuing the last $7500 worth of check.
      He was falsely convinced that the remaining work was not in the scope of the contract which we later found out after returning from my travel
      This company has failed to respond to my specific questions about the failure to complete the work and has indulged in digressing and refusing to answer specific questions in the face of evidence provided
      I seek SPECIFIC RESPONSES IN THE LIGHT OF THE SIGNED CONTRACT to the following questions 

      #1 the contract was to mulch all the trees less than 8 inches in diameter, when concerns were raised by me, I was assured that all the the trees are being mulched to the ground to less than 1 inch size mulch as per the contract -text messages assuring me of the same claims they were mulched "thousands of times" --based on this reassurance we released the check which was later found out to be a blatant falsification as evident in the pictures.
      if the trees were emerged "thousands of times" why are the 2 piles of the trees still remaining and where is the mulch? (Can send pictures of the text messages) -- BBB pls allow me more space for additional evidence.

      #2  If the large trees and roots were to be excavated off the ground and buried on site, look at the pictures and answer why there are numerous trees stumps still waiting to be excavated?  


      #3  All large diameter trees where specifically to be buried in the ground by digging a pit as per the contract --- that was never done -- i walked all around to see --if they  claim please tell me where it was  dug and where where the stumps buried? --That is clearly falsification because I have tree stumps that are at least 6 to 8 feet tall still lying on site as seen in the pile (can send additional pictures) --if BBB allows me to post additional pictures, it would be very helpful to substantiate the immense size of the trees, root stumps still left .

      #4  If the pond was appropriately dug and would hold water, why is it not holding even in November?(Have a text message from site manager claiming it due to be" dry season now but will fill up the pond in rainy season") --please allow me to send more attachments to prove his false reassurances and leave the project with a clear breach of contract.


      Without a specific and acceptable responses to the above questions, all their explanations is to be regarded as digressing from the facts, hiding the truth and blatant breach of contract.
      I request BBB to review these questions in the light of the contract and evidence provided and I am open to providing further evidence in the form of text messages, emails to further substantiate my claim.

      these concerned where raised by my neighbour ** ***** who refused to release the check until these was addressed -- the owner and the project manager sent me additionla txt messages and then came to the site,managed to convince ** ************ citizen) and took the last check of $7.5 K -- had it to been for false arraunaces and wrong textss from them,i would have not allowed that amount to be released.

      Pls have them answer the question SPECIFIC TO THE CONTRACT scope of work and the pictures/evidence attached.

      They have dodged answering these questions to my attorney too -- pls refer to the response to my attorney.

      this is the left over work still on site -- the company has dodged the answers even to the attorney letter -- there responses do not address the issues raised.

      All I seek is implementation of the contract -- nothing more. If it was not necessary, why would it be outlined in detail in the ***** OF WORK?

      As mentioned in the response, the had "machinery failure"  prior to coming to my site which  obviously had "domino effect"  on the timeline/job deadlines with there prior commitments -- since my site was "unsupervised" by me due to travel everything was "short changed" -- see the the shoddy and poor quality of work. Read the outrageous claims about the pond not holding water or mulching done, etc 

      They are resistant to accept this fact and yet holding themselves to "high standards" despite me and my attorney presenting evidence to the contrary.

      They are obviously trying to avoid this issues for lack of appropriate answers in face of the evidence.

      Hello,Im doing a follow up for my  Complaint ID: ********

      I was requesting a resolution to this after failing to have the company Southern Turf,INc to respond and resolve this issue -- as disccused earlier,I was requesting a BINDING ARBRITRATON since they have failed to complete the items in the contract and did not explain anything to address the issues i have been raising.

      This issue has raised another problem now i.e CODE ENFORCEMENT has sent me a certified letter to clear the debris .Most likely the complaint was lodged to code enforcement by the neighbours due to the massive pile of wood piled up along the property line.

      I request you to aggressivley intervene and set up an arbitration which would be binding with the condition that the company would now be liable to all the consequences arising from this code enforcement issues ie penalties and/or court issues due to this.

      Pls contact me and the company at your earliest.

      Signed a contract with *** at Southern Turf a few weeks ago to 1) Trim Bushes, 2) Remove Tree, and 3) Grind *****.After approximately 1 week, had to call *** and prod him. Crew came out next day and performed 1) & 2). *** said they would be out the next day to grind the *****. Over the last week, have heard "Today", "Tomorrow", and "Within the Hour" several times each. Texted *** Friday mid-day and told him I was out of patience. Told him if it's not done by Saturday noon, I'd retract the good review I gave him. Now Sunday afternoon and ***** has still not been ground. Check has already cleared the bank, so I cannot put a stop to it. I still need the contracted work completed.

      I paid this company $6250.00 on 9/21/23.
      The job was not done completely, I put a dispute to my credit card company on 10/11/23…reversed the dispute & it was resolved 10/18/23.
      Southern Turf insists they do not have the money, however they do and will not finish the job, fix leaks OR even return my calls, texts or email.
      The contract states they will fix leaks until 3/2025.
      I am at a loss of what to do! I want to dispute some of the charges again, however, it just messes up everything on my credit card end. I would like $1250.00 refunded to cover the expenses I have had to put out to try to get things repaired.

      Mr. ********** You asked us to build a pond for you which we did. We agreed to one thing and you kept adding more and more which we also did for you. There was a leak and we sent our guy out to fix it. You paid us $6,250.00 on 9/22/23  and then you disputed the payment and it came out of our account on 10/18/23. The work was done, we did everything you asked us to do and you still disputed the payment. The Payment has not yet come back to our account even know you keep saying it has. The payment should have never been disputed in the first place considering the work is done. You made several rude remarks to our staff and are trying to get out of paying for the work. You told us that you did the same thing with your pool company.

      We did agree on something, a WORKING pond, with no leaks, etc.There is the contract, from your company, signed/dated. The contract states your company will do the pond and honor leaks up until March ****, per the contract. While I did have ideas/suggestions, so did YOUR employees AND anything I suggested was approved by your employees. I have no control if you approved or not. You sent ***** and ***** did what he was told or okayed to do.That is a whole other issue not worth dealing with here. 
      The leak you mentioned, your guy did NOT fix it. He continued to tell me to fill the pond, that was not going to fix a leak.
      YES,I paid you $6,250.00 on 9/21/23 on my Apple card. The dispute went in & was retracked immediately. Per MY documents, it shows the $6250 taken on 10/11/23 & returned on 10/18/23. AND that is what it also looks like on the duplicate documents you sent in. It literally shows 'Bill ******** $6250.00 10/18/23. It does not show a negative anywhere.
      Not sure what the point of sending a confidential document was!?!? That has peoples FULL names. Not professional at all. If I were one of them, I would be very upset. Do you realize how easy it would be to contact them to let them know you shared their business?  
      the work was NOT completed.... so many issues with the whole process. Seeing it was your company's first ever pond, I see why now. I trusted your company to do the right thing. If your company was not equipped to do something like this, you should have been up front about it. Now look where we are at.
      You need to let go of saying I should not have disputed. You are a business owner;you should know any consumer has the right to dispute a service. That is business.
      Speaking of rude remarks. They were all over. I take ownership of mine. It is over &done now. Let's move forward, give me what I requested to cover what I have now had to invest in due to the poor workmanship. My wife was extremely professional on every call or text or email she made. It was your employees that gathered around her in the office as intimidation. She was fine and trying to get things resolved. She is also trying to convince me to not go for more money. However, if I do not get the $1250.00 back, I will look into pursuing for more. Not a threat,just business. And who cares about the pool situation, you are pulling at straws.       I do not understand why I keep getting the same message over and over that the case is closed. Southern Turf did not live up to the application. They are the ones who screwed up their QuickBooks stuff. I did absolutely nothing wrong. I just honestly do not understand why I keep getting messages from the Better Business Bureau. If the case is closed, close it. That business is horrible. I lost out! End of discussion because theres obviously nothing else I can do.

      Southern Turf was hired by my neighbors, the **********, to perform tree trimming and removal work on their property. On November 15, 2022, the date the work was performed, one of Southern Turf's employees drove a heavy piece of equipment over the curb and crushed the water meter box for our house. Southern Turf called Seminole County to come out and shut off the water to the house. I was home with a stomach virus and noticed that we had no water. The Seminole County water employee who was called out to investigate came to my door and informed me of the issue and explained that there was a break in the pipe on the homeowner side (in other words, not something the county could fix) and Southern Turf would have to be responsible for the repair. I called Southern Turf's offices and they seemed to be reluctant to call someone out for a same day repair due to the additional cost of an emergency/same day repair. I was upset and asked about being reimbursed for a hotel stay instead (I have three children and each is in school...we couldn't cook, bathe, etc), and finally Southern Turf agreed to send someone to fix the break. They told me by phone that it would be one of their irrigation employees. That individual did come on the evening of Nov 15 and appeared to have fixed the pipe. On July 5, we discovered that the repaired pipe broke and had been leaking into the street. I called a plumber to investigate and fix. The total cost was $1620. The plumber indicated that the first repair was not made correctly. He documented that the wrong materials and incorrect glue was used. I reached out to Southern Turf for compensation and spoke to their office manager who said that she would have to work with the owner for some sort of reimbursement. After several days of not hearing from them, I called back on July 12. They stated that they are refusing to pay anything toward the repair and since it has been 9 months, don't feel responsible for the issue any longer.

      Hello Mrs* ****, After one of our guys realized that they hit the water meter they called the county to have the water shut off right away. After you contacted the office about said issue we weren't being reluctant we used the proper protocol and needed to make sure we were contacting the right person for the right the job. We then had someone come out as soon as they could which was the same day the incident occurred and they fixed the issue. Since our guy came out and fixed the issue in the same day we did not feel that a hotel was necessary since they turned the water back on and everything was working properly. This incident as you stated happened on November, 15,2022. You contacted us on 7/05/2023 letting us know that the pipe broke and stated that it wasn't repaired correctly. When we spoke you said that you want us to pay for the plumbing bill that you got from the person you called out to investigate the situation which was $1,620 and asked that we pay $500 towards your next water bill. We did exactly what we needed to do as a business to get the situation fixed when it first happened and unfortunately there is no warranty on plumbing services.

      I am rejecting this response because the business owner is misrepresenting their eagerness to assist and as well as the qualifications of the individual contracted to repair the damage made by their negligent employee on 11/15/2022.  Via phone today (7/12/2023) with Payton (office manager), I requested a copy of the invoice for the plumbing job that Southern Turf alleges they paid for on 11/15/2022.  In my conversation with Southern Turf on the date of the actual incident (11/15/2022), Southern Turf indicated that they were sending a "family friend" to do the emergency plumbing work. When I asked whether the individual was licensed, they admitted that he was NOT. 

      Please forward, as requested earler today, a copy of the invoice for the plumbing work performed on 11/15/2022 by the "licensed plumber," along with the name of the business and the contact information for that plumbing business.

      Furthermore, BBB should be aware that I was not permitted to consult on the contractor for the emergency plumbing work, nor did that individual communicate with me when they came to complete the plumbing work.  I contend that it was Southern Turf's responsibility to hire a qualified and licensed plumber to perform the work.  And therefore it is also Southern Turf's responsibility to ensure that this repair is made properly.  I am an innocent party who is now out nearly $2000 due to Southern Turf's negligence and refusal to accept responsibility for their employee's trespass and destruction of my property.

      The quality of the work performed by the "plumber" on 11/15/2022 is consistent with Southern Turf's original admission that the individual tasked with the job was indeed a "family friend" and was not licensed.

      We started the process for Mr.******* with an estimated amount of $35,000. This was an overall coast of job and not an itemized amount.
      Mr.******* paid a deposit of $20,000 before the job was started. From the start of the project, there were a handful of additions or changes. We did struggle finding Cocquina boulders the appropriate size for Mr.*******'s sea wall. About mid-way through the project, Mr.******* came into the office to pay another $10,000 for more material added.
      Once Mr.******* had a meeting with the owner of Southern Turf, a mutual decision was made. Travis Ingalsbe was going to cover the cost of more shell and coquina boulders to make the customer content.
      We delivered the shell, which Mark stated he'd spread himself. The coquina boulders were still attempting to be found, as Pebble Junction (the recommendation from the customer) and other distributors within an hour radius, did not have the size of coquina needed.
      Before we stopped looking for coquina boulders, we received initial communications for legal action. At that point, we cut all communication with Mr.******* and did not show back up to his property.

      There were no additions to the project. They did not complete the project. The second payment of $10,000 was made when the business owner (Travis) called me, indicated they had found the rock needed, and they wanted the money to make the purchase. The rock was never delivered. I started doing the work myself because the 2-3 week project was already taken over 3 months and I was tired of my front yard being mud (which my dogs then tracked into the house). The coquina rock is available, I have purchased several tons to complete the project. I have had to buy my own fill, coquina rock, trees and sod. All of which I had to do the labor myself. All I am asking is for a refund for materials paid for and not delivered. I was given many promises from Travis the owner, of which none came to fruition. I was charged $11,000 for coquina rock, and received less than $3000 in coquina rock from the business. I have supplied a large part of the material (coquina rock, crushed shell, trees and sod), done a large part of the work, while Southern Turf and Travis have kept my money. I not only supplied labor, but also had to supply a tractor for most of the work, since this business did not have the right equipment available. I am just asking for a refund of monies paid for labor and materials that were not delivered.
