      I am filing this formal complaint against ******* ****** and **** *********** of Fidelity National Title National Commercial Services, located at 20 N. Clark Street #220, Chicago, IL 60602. Their conduct displayed gross unprofessionalism, severe negligence, and a complete disregard for proper business practices. During a transaction on 8208 Ralston Rd in Houston, TX, ******* ****** was consistently rude, dismissive, and unprofessional in her communications toward me and my partners. Despite three requests for a copy of the preliminary HUD to ensure my fee was included, she sent it to everyone except me. And my fee was not included on the HUD she sent out, which raises serious concerns about her capabilities to perform her BASIC work duties. Whether intentional or due to extreme negligence, this is completely unacceptable and appalling. Adding to the issue, **** ***********, who holds a VP and managerial role, had every opportunity to step in and correct the situation but instead chose to remain silent. Is this the standard of professionalism he allows in his office? I directly asked him if *******’s behavior was protocol, yet he refused to respond or take any noticeable action. Given that this matter involves $15,000, his lack of intervention from the very first email I sent is not just negligent—it is outright irresponsible. Still, **** has not addressed this matter at all. His failure to even acknowledge such a serious issue is deeply concerning and reflects a complete failure of leadership. If Fidelity National Title refuses to hold its employees accountable, I will escalate this complaint to the Federal Trade Commission, the Illinois Attorney General, and any other relevant regulatory agencies. I demand a formal response outlining what corrective actions Fidelity National Title will take regarding this issue. This level of negligence, lack of professionalism, and outright disregard for ethical business practices cannot go unchecked.

      Escrow company was sloppy, did slipshod work and made errors at every turn. Minimal to no accountability or brain shift when mistakes uncovered.
      1) Home closings settlements (~30) were paid from bill estimates as opposed to final statement requests as required
      2) Escrow company checked off and marked "not rental" for known rental homes in the required fields when requesting estimates from utility companies but kept that hidden until it was exposed by the utility company.
      3) Escrow's incorrectly marking properties as "not rental" on the utility bill escrow requests caused a multitude of tenant electric bills to be deducted out of seller's proceeds (and weren't caught in a 2nd chance as they might have been if a final statement request had been made). They take no responsibility of this obvious and documented error. The escrow company expects seller to correct their errors with the utility; states it's not their problem; yet they are responsible for having created a $54K loss (I call that a problem) as explained to them by the utility.
      4) The payment of tenant electric bills was so egregious that the escrow company paid a next door neighbor's electric bill (from a different parcel) out of the seller funds & unwilling to correct.
      5) Charges were assessed for "extra work". Yet, most closings were so error laden they had to be redone (mostly due to not requesting final bill statements - e.g., from property tax or utilities).
      6) Paperwork received for the closing "redo's" (two and a half months later) remains outstanding on all but two of the closing "redo's". I am entitled to this information.
      7) Incorrectly paid tenant utilities by the escrow company goes unresolved and the utility company needs them to make the corrections causing it to remain unresolved.

      I have received a check for $ 12,683.
      People at the office were very careless very unprofessional it felt like they planed this to cheat me fraud me I was showed one document saying one thing and once I pointed out their mistakes they were really not happy neither they gave me any paper work or documents to leave with.
      We can call it any charges we want but it's called con,theift, fraud.
      I feel cheated.
      The reason I tried to sell this property fast and cheap is because my mother is a senior citizen and she recently Injured her leg in an accident and now can't walk. This has really got me frustrated. I can't eat, I can't sleep.

      I am trying to understand this

      I am the seller and my friend is the buyer decided to close for $ 30,000. Buyer gets the paper work ready buyer pays all the cost

      I docu sign then closing date comes I sign papers wherever i was told about all the fees and  HOA fee

      But I was never told about marketing fees neither I signed Any paper at fedolity or in docu sign.

      How come this is not fraud. 

      I am frustrated my senior scitizen mother had an accident recenlty using a walker now

      The property I sold is because my mother can't take stairs. So I moved to ground floor.

      Anyone can just give anyone's money to anyone and anyone can take anyone's money with out their consent or with any contract. 

      What mess is this

       What is going on here 

      I have never heard or seen a closing like that.

      Are these people there to con people fraud people I mean what is this how they have a right to do such a thing.

      Misallocation of Funds: On March 11, 2022 , I engaged Fidelity National Title Company to handle a real estate transaction involving the purchase of a property. I entrusted them to disburse the funds correctly and efficiently. However, I have recently discovered that an amount of $8,629.84, intended for essential fees and payments, was improperly allocated. As a direct result of this negligence, my liability has now increased to $12,000, putting a considerable financial burden on me.

      Several documents were either overlooked or inaccurately processed, leading to delays and unnecessary complications. Furthermore, my attempts to communicate with their representatives were met with apathy and unresponsiveness.

      Lack of Accountability: Despite numerous attempts to bring this issue to Fidelity National Title Company's attention, they have failed to take responsibility for their errors and have not offered any viable solutions to rectify the situation. The company's lack of accountability and unwillingness to address the matter have left me feeling frustrated and unfairly burdened with financial liabilities.

      Desired Resolution:

      I am seeking the following resolutions to rectify this situation:

      Immediate reimbursement of the misallocated funds amounting to $8,629.84.
      Acknowledgment of their inadequate service and a formal apology for the distress and inconvenience caused.
      Waiver of any additional fees or liabilities incurred due to their errors, resulting in my liability increasing to $12,000.

      I kindly request that the Better Business Bureau investigates this matter promptly and takes appropriate actions to ensure that justice is served. Your intervention is crucial in holding Fidelity National Title Company accountable for their actions and protecting consumers from similar experiences in the future.

      I made a visit to the Lake County Recorder's office last week, while there I searched my outstanding debt records.  Records that may affect the agility to issue a clean and clear title to the home, I found a record for this HUD dated in 2021.

      Cleary there was a disconnect in the process on your end.

      The statement below holds zero validity, as I had put my trust in a "well" established company, it is also your job to ensure smooth transactions between parties. Which on many metrics you failed to achieve.

      "I have carefully reviewed the Settlement Statement and to the best of my knowledge
      and belief, it is a true and accurate statement of all receipts and disbursements
      made on my account or by me in this transaction. I further certify that I have
      received a copy of the Settlement Statement."

      In response to:

      "At no point during the
      2022 Transaction did the Complainant alert the Company of the HUD Mortgage’s existence or
      instruct the Company to pay off the HUD Mortgage."

      This again, a failure on the company's part, as it was clearly visible via Country Recorder. Failed both parties during this transaction by choosing to ignore it.

      I purchased land and also title insurance, the title company gave me a clear title but now I find out there are leins against the land. The title insurance company has stated they are at fault and the claims departments remedy is to indemnify any future title companies
      A current potential buyer for a portion of this land has been warned by their attorney and that attorneys title company not to buy the land from me until the title is cleared
      My closing agent and the Fedelity title insurance will not clear this up so I need outside help in order to be able to sell any or all of this land, as my entire property is on the market for sale, however without clearing this up I can only sell.

      In contacting an attorney they have told me that I have a good case, but they don’t work on a contingency and don’t think the title insurance will pay my attorney fees. I really don’t have the extra money for an attorney and feel I shouldn’t be responsible for clearing this up when clearly it states in their contract they were at fault and this is exactly why I bought the insurance

      I had purchased a home Dec. 2019 from a foreign national. Fidelity National Title was in charge of my escrow and ensuring proper filing of form **** ******** along with sending withholding amount ($20,200) in form of a check to the IRS on my behalf. Title company failed to send this out in a timely matter by time sensitive due date (March 15, 2020). The IRS did not receive form 8288 and check until Aug. 2020 (per post mark date on envelope). As a result of the late filing the IRS has charged me late fees to include penalties and interest totaling over $6k. I am now in collections with the IRS as a result of Fidelity's negligence and failure to exercise reasonable care when performing the duties, I hired and paid them to do. Collections efforts will continue up to garnishment and Intent to Levy if this amount is not paid right away. On July 27, 2021, Fidelity requested a review by the IRS to see if late fees/penalties can be waived and I was assured if they weren't waived Fidelity would cover them. The result of the review determined that the return and payment were received late and IRS records shows proof the envelope post mark date was Aug. 24, 2020, and received date Aug. 28, 2020. Based on this information penalties, fees and interest will NOT be waived. I have communicated all this to Fidelity, and they refuse to pay the $6,674.60 amount due good thru March 31, 2023. This amount will continue to increase the longer they sit on my grievance.

      So I’ve always had fidelity for my 401k, however I recently opened a fidelity bloom account. I rarely use this account, but planned on using it for savings. Recently I received a cashiers check from a non profit to help with rent. I drove to a branch to deposit the check, and was told the check would be immediately available for trading but for my spend account it would take 2-3 business days. After, 3 business days the app said my funds would be deposited a few days later which is the 16th, today. My funds were still not in my spend account. I called, and was transferred to a department that handles my account. I spoke with a rep named Will who left me on hold for about 40 minutes, then came back on the phone to ask me what would I be using the money for? I told him that was none of his business and thought it was strange to ask a customer that. I was left on hold another 20 minutes and then Will stated the check was altered and I would not be getting my money. I asked him if my check is altered how is it possible that the check is available in trading and showing in my account as in trading? He then tells me it’s not and my accounts will be closed. I asked him could I call the company that closed the check, I called on the 3 way and he heard the company and saw it was legit and tells me to hang up because it doesn’t matter because I won’t be getting my money and my accounts would be closed. I asked how is it possible that the money is in trading if the check is not right. The rep tells me he doesn’t have to answer me and fidelity has the right to stop communication with me and hangs up. I reach out to the non profit and on their end it shows fidelity has cashed out on the check and they have my funds. I call back to fidelity and they tell me that they don’t have any further answers for me because my accounts are closed. So now fidelity has my money but tells me the check is altered, but is using my money for trading. This is illegal!!
