    We hired ******** Accounting to file our 2022 business as well as personal tax return. Upon completion of our business return we turned our focus to our personal returns. We uploaded all of our personal documents to the client portal for processing of our return. On March 9 we emailed **************** asking for confirmation that the business taxes were filed and if he had everything he needed to file our personal taxes. On March 29 he responded with a copy of our business taxes at which point we asked if he was ready to file our personal taxes and he responded with "not yet". On April 13 we asked for an update with no response. On April 18, due date for taxes, we called and emailed asking for another update and advised that we were concerned. No response. On April 19 we again emailed and called **************** with no response. By May 1st after checking with IRS and being told that they could not see an extension filed we decided to go to another firm. I then texted **************** asking for confirmation that they extension was indeed filed so that our new accountant would know what to do and he responded to my text stating that "all extensions profiled in my system". After receiving a penalty of and non-filing fees of over $7000.00 we reached out to ****************** again hoping he would do the right thing and cover the fees he caused us to incur but all he did was deny that he was ever supposed to file our personal returns. However, I have emails and texts to the contrary. I am happy to share them if asked.

    This client paid for Corporate tax services,  which was filed on time.  The client wanted to proceed with personal tax filing, they uploaded the information on the portal, but then I received a message that the client did not want me to process their personal tax return.

    I did not know to what extent this client would owe the government or if this client had paid any quarterly taxes for that tax year. The client never informed me that they would owe taxes and they would not be able to pay for their tax obligations on tax deadline.

    The client could have went to the *** website and filed extension and pay tax liability in order to avoid any other penalty. The client is looking for my company to be responsible for their personal tax liability penalty which was never communicated to myself or my office that they would owe the ***.

    I am rejecting this response because: I have back-up documents to confirm that ****************** is not telling the whole truth when he says that he received a message from us indicating that we did not want him to process our personal tax returns.  For ****************** to say that he did not know to what extent we would owe the government or if we paid quarterly taxes, he would have known this had he done the job he said he did or returned phone calls and emails.  And to say that we could have gone to the *** to file for an extension - we would have done so if ****************** hadn't lied and told us that he had filed an extension on our behalf.  The attached documents represent the following:

    March 29 2023 Correspondence - On March 29 we asked ****************** if our personal taxes were ready to file yet and he responded with "not yet"

    April 13 2023 Correspondence - On April 13 we sent an email asking for an update on our personal taxes but never received a response.

    April 18 2023 Correspondence - On April 18 we sent another email asking for another update and expressed our concern that the deadline was near.

    April 19 2023 Correspondence - On April 19 we sent another email stating indicating that we had called and left several messages as well as sent emails with no response and we were concerned since we had never filed late before.  We then received an automatic email reply stating that all extensions had been filed.  Also showing in this correspondence is that on April 20 we sent another email asking what steps we now needed to follow and advised that we were concerned because we had never filed late or had an extension filed on our behalf.

    After still not receiving a response I proceeded to call the *** to confirm if indeed an extension had been filed.  The *** indicated that they didn't see one on their end but that if it had been filed on the 19th as ********************** automatic response indicated that it likely just isn't reflecting in their system.  So we just continued to call ****************** leaving messages begging for an update.  ****************** finally called us back on May 1 and said he had a family emergency but assured us that the extension had been filed. It was only at this time that we told ****************** we would be taking our needs elsewhere because the lack of communication was no excuse.  We immediately reached out to another tax service who asked me to confirm with ****************** via text that the extension had been filed - see attachment titled *************************** Text.
