Elbaz construction was hired to complete remodeling work on my house. The project was set to begin on August 12 and to last 10 days. There were multiple delays from the company and disputes with multiple contractors hired by Elbaz and the company . Upon sharing our concerns with the owner, ****, he ensured the work would be completed and properly. On September 6th the work was completed however it had poor workmanship, multiple items that had be advised would be taken care of were not, and the owner stopped responding after insisting we pay him. Since the completed work we have had to call out a plumber multiple times, again due to poor workmanship and had to hire another company to complete the work Elbaz failed to complete like promised. We sent a letter requesting this to be resolved by the company by reimbursing us half of the amount we paid them( we were attempting to be reasonable even though the cost to correct their work would be double what we were requesting). The owner responded he would look into it yet it is a month later and we have still not heard from anyone in the company. At this point we are seeking reimbursement for the amount paid for the work immediately.Initial Complaint

I hired El Baz Construction Company April 3, 2024.We signed a proposal/contract for $7,000 for the architectural/permit process.The proposal included 2-3 layouts of the proposed designs and also a 3D rendering of the approved design.Never received those items.April 25 signed a kitchen remodel proposal and gave a deposit of $7,436.The permit was entered on May 21. Permit denied on June28. By Aug 26 the corrections hadnt been submitted.On Aug 27 email was sent to the owner of the company,****.Said we were unhappy with the slow progression of the permit process and lack of **************** response.Aug 30 I was told the permit was submitted to the city.Sept 3 the city advised the permit hadnt been submitted.Sept 4 my wife emailed City Permitting Manager about what was going on.He advised on Aug 30 the permit was submitted to the wrong section and couldnt be reviewed.The permitting manager sent an email to **** explaining the error and how to fix it.Sept 5 still hadnt heard an update from contractor.I told the project manager we no longer wanted to continue the remodel due to lack of communication and excessive wait.Said i wanted the deposit to the kitchen remodel refunded $7,436.I was told "compromise" would be established.Sept 9 I received a text from **** saying he will call.On Sept 10 I hadnt heard back and sent a text advising I wanted $7,436 refund. **** said "rest assured we will come to a resolution and at the end of the day I will never keep money that I don't deserve or haven't earned."On Sept 16 **** said he would come to my home and deliver the refund. He rescheduled for Sept 19.On Sept 19 **** was no longer able to come.I advised I would come to his office on Sept 25. **** provided the address.On Sept 24 I sent a text to confirm and he did.On Sept 25 **** asked if i could come later and i could not.He said he hadnt dropped the check off yet but I told him Id wait.Eventually ****** wife met me at the office and said that a refund would not be issued.Initial Complaint

The contractor, *********************, took an $8000 deposit before doing any work and then another $8000 the day they started removing water damaged drywall. He completed the tear out and we discovered a very obvious 4 foot by ************************************* the ceiling. We called and asked him to remove the wet drywall and insulation. After the tearout, he presented us with a $2500 change order that he wanted paid by cash or *****. We did not agree with the change order. That is $28.40 per square foot to tear out and replace drywall, about five to six times the going rate. My wife met with him on 11/17 about the change order that we didn't approve and suggested maybe **** should return our deposit and we part ways. He became angry and stomped out of the house and refused to return any money to us.Business Response

Our sales rep ********************* signed an agreement with the customer ***** stating the work to be completed, and the payment terms which were agreed upon by both parties. In the contract the owner approved to the payment terms that were laid out and explained to them. The client was advised of the costs to do the work well before any work began. Once the work started the client claims they received other bids for the same work for a cheaper price and did not want to proceed with the contract he initially agreed on and signed for.
We are happy to continue working and remove the extra drywall and insulation as a part of the initial scope of work and explained this to *****, however he insisted that he could get the work done for a cheaper price and wants a full refund on work that has already been completed which is not possible.

I am rejecting this response because:
These are simply lies;1) I received the bid form the other contractor to teat out the drywall before I ever met *********************. We simply wanted a General Contractor to coordinate all the work. Have a dated bid as evidence.
2)I never stopped the work. *********************** presented us with change order for $2500 to tear out 88 square feet of drywall, a change order that was never negotiated or approved. When questioned about it he was indignant and stomped out. Later sent us an email saying it was best if we parted ways. I have the entire string of emails.
3)They never offered to continue and remove the drywall and insulation as part of the initial scope of work. I have the change order as evidence.
4)I have never asked for a full refund. I only want the unearned portion of my deposit returned and am happy to pay a reasonable amount for the work that was completed.
5) ********************* took $16,000 to complete work that was already bid by another contractor for $4500. Just want the $11,500 back.

We preformed the work outlined in the contract that you guys agreed upon. You requested that we open up more than what was listed on the scope and we sent you a written change order for it as stated in the contract. You declined the change ordered work and then kicked us off the job. The fact that you found a price you claim is $4500 for the same amount of work is not sufficient enough to breach our agreement. We did not force you to hire us and we laid out the scope of work and cost of the work along with payment schedules, which you agreed too. Half way through the job you decided to terminate our original agreement and breached the contract.Customer Answer

I am rejecting this response because:Elbaz Construction & ********************;performed part of the work agreed upon - the tear out only. After tearing out the ceiling, it was obvious there was wet insulation and we asked that you tear out the wet insulation and Sheetrock. Change orders should be agreed upon prior to submitting a change order. You cannot arbitrarily send change orders without customer approval. The $4500 price you refer to was submitted to us on October 25, at least a week before we met you. As a matter of fact, you came off your price $4,000 when we showed you the estimate. Please see attachment.
When I called you to discuss, you became angry and belligerent and told me you had $100,000 jobs and didn't need this. You took $16,000 for the tear out only. According to your contract the $16,000, was to include tear out, drying out and applying antimicrobial on all wood and walls and ceiling, (you used bleach only) installing new drywall by code, skimming and coating all drywall.
You walked out on the job. The fact is you took $16,000 and performed less than 15% of the entire job. We expect to pay you for the work you provided, but we expect a refund for the cost of sheetrock and installation as indicated in your contract.
