I am writing to file a complaint against HIWA regarding their failure to provide the hurricane windows I paid for and the lack of communication from their end. The details of the situation are as follows:On March 28, 2022, I entered into a contract with HIWA and made a down payment of $4443.93 for the purchase and installation of hurricane windows at my property. At the time of the transaction, I was informed that the supplier had the windows on back order, and an estimated installation date was not provided. I was advised that the windows would likely arrive around September.Since then, I have made multiple attempts to contact HIWA to inquire about the status of my order and to schedule the installation. However, despite numerous phone calls and messages, I have been unable to reach anyone at the company. Not only have they failed to answer my calls, but they have also neglected to return any of my messages.Due to my concerns and the lack of responsiveness from HIWA, I requested my brother to visit their storefront on my behalf. To my disappointment, he reported that the business appeared to be closed.Considering the circumstances, I believe I am entitled to a full refund of my deposit of $4443.93 as HIWA has not fulfilled their contractual obligations by providing the product or service within a reasonable time frame and by having a failure to accept or return phone calls.I kindly request the Better Business Bureau to intervene in this matter and assist me in resolving this issue. I signed a contract with ******, the salesperson of HIWA, on July 9, 2022. That day he came to my house and picked up the check for a $7, ****** - 60% deposit for three impact doors. The contract entailed getting doors from **************, pulling the permits, and installing them. He told me the doors were on backorder. The doors would have been ordered by October and I would have them in December. Each time I called the office, they would tell me the doors were on backorder. Recently I have been able to leave only a message on the voicemail and the office is closed. I have left countless messages on his phone, **********, and sent emails, but he has not responded. I see that he reads the messages but I have not received a response so far.I contacted ************** and they reached out to me yesterday. While they provided the order invoice, they were not paid for the order and the order was not submitted. However, last year I received paperwork from ***************************** entitled "Notice of Commencement." thus far, there are no doors or communication from ***************************, the contractor, ************************* -the salesperson, or ***********************-owner of HIWA. I have contacted ****** and ****** several times but to no avail.Please advise me. I need my refund or my doors.Initial Complaint

April 25, 2021 signed contract with HIWA. Per the contract payment - 60% deposit upon sign contract, 30% due upon delivery of windows to property, 10% due final inspect pass. I paid $14,077.68 on 4/25/21 per contract for installation of 14 impact windows, 1 impact front entry door/sidelights, 1 impact slider door. The company delayed install until 3/14/22 saying delay was due to manufacturer. 3/14/22 company came to install and I was expecting complete install. I paid per contract $7,542.24. At that time the entry door/sidelights, sliding door and 13 windows were installed. The 14th window was not installed because the company measured too small. They said it was my choice to have the smaller window installed at that time or they could order the correct sized window which would be ready by June 2022. I opted for the correct sized window install. The job was never finished.Since 4/25/21 when the contract was signed and the first deposit paid, I have made numerous inquiries by phone and email asking when the work would be done. I was told the delays were due to the manufacturer and I patiently waited. In January 2023 I went to the store and spoke with ************************* who is father of the business owner ***********************. I was told the business was suffering hardship but ****** assured me the company was going to complete my install. He said my window was in their inventory since 11/2022 but they lacked the manpower to install and they were working on resolving. Today I went to the business which was closed up with paper on the windows. It seems HIWA is out of business. At this point I realize this business I trusted took my money and failed to keep their contractual agreement. I'm left with an unfinished job, no final inspection and unfinished stucco and drywall in my home.Initial Complaint

I signed a contract with HIWA to replace my windows and doors at our house. I paid $13,524 as 60% deposit on June 4, 2022. The seller required I paid that amount as initial deposit. The seller was supposed to finish the project, which means buying the doors and windows in the contract, delivering them to my house, and installing them by September 2022. Since then, the seller kept giving me excuses to delay the project. Up until Oct 31, 2022, they sent emails to inform me that the products estimated arrival was extended due to manufacturers delay. That was the last email communication I received. I emailed them to ask about the project but never got any answer. I constantly called them (every week since November 2022) to inquire about the progress, but the sellers representative kept giving me excuses and extensions. They kept saying the products would arrive next month every time I called. Then in March, they said they would schedule for me in April. But since then, I could not contact them anymore. I called several times every single day and sent emails and texts. The calls were never picked up by anyone. The emails went unanswered. The text was not answered. Their ****** profile has now disappeared. The seller never delivered anything for the project and now cannot be contacted. They scammed me of the deposit we paid. On November 17, 2022 I signed a contract with HIWA and gave them a check for the 60% deposit of $8228 to install 2 sets of French doors, a front door and two windows. All to be Hurricane impact glass. As of today April 24, *********************************************************************************************************************************************** all together on February 27, 2023. They do not answer any emails or calls and their business is boarded up. I want my deposit back ASAP. They had another company at this same location and apparently shut it down and then opened HIWA now according to Dade county records and Sunbiz they have formed Zombie windows and Fixify. ************************* and *********************** are swindlers. Date of Transaction: 11/14/2022 Amount paid to *************************: $2,461.07 in cash The business, Hurricane Impact Window Authority (HIWA) guaranteed that if I pay 60% of the original cost of the transaction($4,101.78) as a down payment it will secure the installation of hurricane impact front door and two hurricane impact windows. Then the other 40% will be paid after the installation. The dispute is that the hurricane impact windows and front door were scheduled to be installed in my private residence on February 2023 with a tentative date. I contacted the business owner on February 22, 2023 and he answered and reported that " he will find out what happened with my order and will call me back". He never called me back and I attempted to call him several times at his personal phone *************) and business phone *************). I am unable to leave a voice message. I contacted him via text message and he has not responded. On 3/9/23. I visited the business's physical address and it was closed for business. I spoke to neighboring business and was informed that he closed his business two weeks ago and that three other customers who did business with him were also asking for him. I also emailed him ******************* and ***************** on 3/9/23 stating that I visited his business and I just want my money back and I still haven't received a response. The invoice number is 2201-2214-3460-1 issued on 11/11/23 and paid on 11/14/23. I would like a full refund sent to me via cashier's check. In January of 2023 the owner asked for over $4k for permit fees and an upgrade. The owner has lied to us for the last six months and has not placed our order. The owner and father are not answering their cells and the business line disconnects when selecting an option to speak to a sales representative. I visited the business and it is closed. Brown paper now covers the store ************* office furniture has been removed. The businesses on either side have not idea where the owners are. I called the suppliers and one of the suppliers never received our order that should have been placed six months ago. The other supplier is cleaning up the outstanding orders with the customers directly. Nothing but lies.Initial Complaint

Ordered impact windows from HIWA and gave a deposit of $5,950.00 check dated June 17, 2022. The President is ***********************. Sales person ************************* (father) was the person I gave the check deposit to. The windows were never installed!!! After many attempts to have my deposit returned, they have not complied. Went in person on March 8, 2023 to HIWA and the office its dismantled, gone. Called their number and ******, employee, answered saying they are working from home. Went to Hectors wife, *************************, place of business ****************** located at ******************************************************** since I had not received responses to my emails to ***** and ******. The few responses received during the entire time has been we will check on your order tomorrow, with no follow up. Their lack of communication/status updates and UNETHICAL business practice has left me writing to you for a resolution to have me deposit returned. In addition, the permit expired and I have received 2 letters from Miami-Dade. Please help have my deposit retuned as they are untrustworthy! As well as permits closed and Im writing from Miami-Dade, which ***** and ****** need to handle. If this is happening to me, they must have many more clients in the same situation. On January 22, 2022, I paid HIWA a deposit of $6,661.80 to order and install three custom impact doors at my property. Since sending the deposit, I received a multitude of promises that the doors would be ready and completed in 2022. On March 5, 2022, I was notified by ****, dont worry you will definitely have your doors in time for hurricane season. Then, on May 16, 2022, I was advised that one of the doors would be ready mid August. On June 16, 2022, I received correspondence that the order I placed was sent to the manufacturer. HIWA notified me on June 28, 2022 that the front door should be done around the end of August. On August 22, 2022, I was notified that the two side doors were complete. On November 7, 2022, **** advised me that the ordered doors had had been completed, and that I was on the list for installation. Since that time, I have received no further communication, I have not received any of my new doors, and I have not received a refund of my deposit.
