Near October of 2021 I had Sunergy Solar out to give me an estimate on solar. I was not planning on purchasing and explained several times i am looking into it and have no plan of doing this now. Maybe if we decided to keep the house we might but no way now. I was in the middle of refinancing my home to a lower rate and i said after that all goes through we may reconsider. They had me sign a few docs. Even a notice of commencement that i do not recall signing. Anyway they left i thought nothing more about it until we called out banker to move forward with the refinance and the purchase of a second home we found a deal on in ********* **. Well the banker came back and said we couldn't do either one because Sunergy Solar now has a lien on my home for ****** for restocking of panels. Well we never got panels yet never heard from them again until our lawyer contacted them. They said they would settle for$ ***** and i am not paying someone for something i never agreed to or got. They cost me money when i now couldn't refinance And we couldn't purchase our dream beach house. This has Caused me a lot of heartache now financial pain as well. Customer ******************************* signed a binding Install agreement on Sept 4, 2021 for a 30.94kW solar project, with a new Hot Water Heater and a ************* box, payable in cash. The total for the project was $114,320. There was a cancellation clause on that signed install agreement, giving the customer 3 days to cancel with no penalty.
*************************** site survey for the project was scheduled Sept 7, 2021. At the initial Site survey, *********************** signed the Notice of Commencement and Notice of Termination. Those are both legal documents that are needed to start a construction project, and to finalize the project at the end.
Upon the engineers review, a second Site Survey was requested later that same day. The second Site survey was scheduled for Sept 13th @ 10am. On Sept 14th a third Site survey was requested, as some of the pertinent pictures were blurry from the second visit. The customer was aware of each visit, and aware of the purpose of each visit. The visits were indicative of a project moving forward.
The plans were completed on Sept 27, and the Permit was submitted to the building department for review the same day. On Oct 13th, the permit was approved and we paid the permit fees due for this project.
On Oct 13th we called the customer to schedule the installation. *********************** communicated that he was waiting for the funds to be available and that he would have this available in a few weeks. At such time we put this project on a financial hold.
We followed up with the customer on Nov 11th, no answer. We asked the sales rep to reach out on Nov 16th, Dec 9, January 4 2022, January 12, March 22. Around the end of march we received notice the permit was going to expire in 30 days if this project did not move forward.
On April 7, we received a lien release request from *********************** Title for this address. We let them know, this was an active solar project with an open permit, so we could not release the lien hold till the construction was completed.
On April 11th we sent the customer a cancellation invoice for the amount due.
The title company asked again if the lien could be released on April 12th, At that time we informed the representative that there was a balance due, and upon payment we would sign the release.
On April 14th is when the customer responded again, claiming that he didn't know he signed a contract, he thought he was getting an estimate. We let the customer know that he absolutely signed an install agreement, also a NOC and NOT, and also scheduled three different site surveys for the engineering. That is when the customer threatened to get a Lawyer. We advised him that he could do what he chose, but the cancellation fee would stand.
On April 18th, the Customer's assistant "****" called in, and we agreed to reduce the fee to 5%. The invoice was updated and resent.
There has been no further communication since that time, till the BBB complaint.
The customer chose to enter into a contract. It is apparent at some point he changed his mind, but chose not to notify Sunergy. There is a penalty for cancellation as we have extended resources, time and funds to get his project completedInitial Complaint

We got our solar panels installed on Jun 24th. It's now August 25th and we still have not got all the inspections needed for the *** net meter installation. Just talked to a manager at the ******* office and told me he personally did an installation in January and the customer is still waiting for the city inspection, blaming Miami Dade county for the delay saying "they are the worse". I am rejecting this response because:We understand that you are taking care of our solar bill, but still, it is not clear to us for how longer we will be in this situation. You mention "they are working on that", but who is working on what? what else need to be worked at? A detailed schedule of how long with specific dates for remaining work is needed for us to be fully aware of the longevity of this situation. We have personal needs at home that require more energy consumption, and this delay is making our electric bill from FPL still coming high because of this delay, this is still being paid by us from our pockets. On September 8th FPL was supposed to be here to install our net metering but that was canceled, I guess because of the aforementioned upgrade to the electric panel, but since then we haven't got any other updates.
Please, let us know in writing to our emails and give us a call with detailed schedule and dates for remaining work.

Hi ******,
It looks like you talked to **** yesterday. We are scheduling the pre-release inspection required by FPL, for next week. After that inspection passes, then we can schedule the Main Panel upgrade appointment with FPL. That appointment requires coordinating schedules with the ************** the inspector, the electrician, and the homeowner (yourself). We can usually get that appointment date confirmed within the next 2-3 weeks. After the main panel upgrade is completed and inspected. Then the Final inspection can be scheduled for the following day. After the final inspection, then the passing result documentation is added to you existing FPL net metering application. That is submitted for review. FPL will then review and approve the application (***** days) and reprogram the meter to a bi-directional meter. At that point your solar has "PTO" Permission to Operate. I understand the frustration of having panels and not being able to use them yet. I want to make sure that your project progresses as quickly as possible so that you can see the benefit of the solar project.

I am rejecting this response because: we just drop off a phone call with Miami Dade County ******************* after getting the attached letter notice from such office, saying our permit will soon expire. Miami Dade County ******************* checked our case and said Sunergy Solar LLC requested first permit since May and to date they have not got any other request for the electrical inspection from Sunergy Solar LLC, clarifying that inspections are only available upon request either from the owner of the property or the solar contractor (Sunergy Solar LLC in this case).Apparently Sunergy Solar LLC has not requested any remaining inspection visits to the Miami Dade County ******************* to our property. Miami Dade County city permit advised ** to give Sunergy Solar LLC this phone number ************ (also written down in hand on the attached letter) so they can request for the remaining inspection visits. Miami Dade County city permit office says visits are immediately scheduled and usually ready to visit within few days after the formal request by the solar contractor has been made.
In conclusion: It seems that Sunergy Solar LLC has not made any request to the Miami Dade County ******************* for the remaining inspection visits to our property, therefore the delay.
We want:
1- That Sunergy Solar LLC do what it has to do to get the job 100% finally done.
2- Get notice by phone/email *********************** *********************** of when the remaining Miami Dade County City inspections will occur.
3- When is the *** scheduled to visit after remaining inspections have passed.

When we get all remaining steps complete and the installation is 100% up and running we will withdraw this complaint.

I am rejecting this response because: One of the remaining inspections was scheduled for yesterday (10/19). Then, it was re-scheduled for today (10/20). Today this inspection was done, but apparently there are more to come, so still we are having uncertainties about how much longer is this work going to take. We are currently waiting for solar bill reimbursement from September. Next solar bill (October) is due next week, for which we expect the reimbursement if installation is not completely done by then.In conclusion: Complete installation is not yet up and running, therefore our complaint remains.

I am rejecting this response because: Inspection went and did not pass. The Sunergy technician told to us: "Have a few problems going on with the inspection going to get with my manager to see when we can get back out to fix the problems and get a final inspection done".We don't understand why there are still "few problems" with an installation that was supposed to be done correctly by Synergy by now. Our complaint remains since we are again back to uncertain prospects about when our solar system is going to be 100% up and running.

We signed a contract with Sunergy July 06 2022. They failed to explain the overall charge and kept relying on a tax credit that's not 100% factual upon doing further research. We canceled with the sales rep and another rep in the company. The rep then threatened us with a cancelation Invoice stating that because we canceled after 3 days, we owed them a cancellation fee of $12,162 because they had already invested towards our project - the SS, Engineering, and all the permitting. No one ever came to do measurements. We contacted both the city and ***. There's an issue with our deed so there's absolutely no way that they issued the permit and the *** states they were never contacted. No one ever followed up throughout this process except for when we were ready to cancel once we found out about the hidden fees and read about the company. We also contacted Good Leap, which is the finance lender and they stated that there will be no penalty for us canceling because no project has been initiated. The company does not fully understand the tax credit and if we would've moved forward, we would've had to pay double our current power bill - which would make no sense for us to go through with. When we told our rep that we we're adamant about canceling and we were going to complain to the BBB, he responded with the cancellation fee and stated that we can complain all we want but we still have to pay the fee or it will be sent to collections. We are first time home owners and we've worked hard to keep our credit at a good standing. It's so unfair the way they knock on people's doors and sell something that's so unrealistic and lying about fees and a tax credit without full knowledge about it. We are hoping to get some assistance in waiving this cancelation fee over a scam.Business Response

I called ********, I let her know that I was sorry for the way she was treated by the Sales Representative. Her project was in process from the time she signed the install agreement. I offered to reduce the penalty for cancellation. I also explained that I cannot dissolve the penalty, as work was performed for her project up to the cancellation point. ************** was not aware of the site survey that was performed, I sent her the pictures per her request. ************** was not aware of the loan that she signed for, I also sent her documentation on that portion. Customer was not happy with the resolution, but I cannot change the cancellation policy, as she cancelled outside of the three day window per her contract.

I spoke to **** and recorded the call with her consent. Although she did apologize, we did not come to a resolution and in the beginning of the call, she was speaking over me and questioned my research sources stating "I should speak to a professional". I spoke to 4 different accountants about the tax credit. Although you could be eligible for Solar, the amount of reimbursement is not factual and we would end up paying way more than our FPL bill. Their presentation stated we would be paying way less which is why we signed up. **** stated that she cannot waive the fee because money has been invested towards engineering. When we spoke to GoodLeap - the financial company - they stated that they have not funded the project and let us cancel with no issue. When I asked **** for the pictures, she stated it "was irrelevant". I expressed concern because the pictures were taken when we were not home. You can tell because our vehicles were not on the driveway. I was only aware of the picture that was taken of the attic. In my last email with ****, I requested to see how much was truly invested in engineering. It's difficult to understand how so much money was invested into a project when the city was not even contacted to approve it. Our names are not on the deed. GoodLeap also stating that the project was never funded which also makes me further question the integrity of the company. I have compared my experience with other consumers and it's devastating to see how similar it is. I understand a contract was signed but it was signed under false pretenses. I've attached the voice note and screenshot of the emails. They're invoicing a $6k penalty for work that was never even funded. It is beyond shady and unethical.
