      June 30, 2022 they placed a $50 charge on my account without any explanation as to what is for. Condominium Associates didn't become our property management company until July 1, 2022. I paid the previous property management company Terra Management, by the due date. I also would like to file a complaint against *************************** due lack of response and communication when I have tried to reach het on several occasions.

      Condominium Associates neither charged the fee nor benefits from payment therefore this a misdirected complaint.   As noted by the complainant, Condominium Associates became the Management Company for the Association effective 07/01/22.  The complainants ledger supplied by the previous Management Company indicated there were two late payments resulting in late charges of $25 each on 05/16/22 and 06/16/22 (please see attached ledger).  Therefore, the complainants account had a $50 previous balance and was not charged $50 by Condominium Associates.  Late fees are accessed per the direction of the Associations established policies and when collected become part of the Associations operating funds for the benefit of the community.  As a result, only the ***************** can make decisions regarding the waiving of any charges.   Boards do not take this responsibility lightly as they have an obligation to the entire community.   Thus, they take time to deliberate and once a decision is made need meet officially to pass a resolution to waive fees.   *************** Manager assisted the complainant, and the complainant completed the appropriate fee waiver request form.  *************** Manager submitted the form to the ****************** ********* approved waiving the $50 fee at their 09/15/22 Board Meeting.

      I purchased a property which required the seller to obtain an Estoppel certificate for property closing through ******* Title Agency. The management company contracted by the **************** Owners Association, Condominium Associates (CA), provided the Estoppel Certificate and hand wrote at the bottom of the certificate for the Title Company to charge Buyer $150.00 payable to CA for recording the transfer.
      - When a fee reference was requested, the CA representative incorrectly cited FS Chapter 718 for Condominium Associations.
      - The $150.00 Transfer fee has not previously been charged to buyer's purchasing property within the *********** community.
      - The HOA Disclosure document signed as part of the Buyer sales contract cited "no Buyer fees" applicable.
      - The Townhome was purchased from the Vice President of the HOA, who confirmed no "Buyer/Transfer Fees" applicable.
      - When questioned, the President of the HOA confirmed no Buyer/Transfer Fees applicable.
      - The existing governing HOA documents do not address transfer fees, only Estoppel fees.
      - FS 720, The Florida Homeowners Association Act, does not address transfer fees. The most widely accepted legal view is that these fees must be set through the HOA governing documents.
      - Section 689.28, Florida Statutes, declares transfer fee covenants violate public policy by impairing the marketability and transferability of real property. However, section 689.28(2)(c)7, Florida Statutes, allows a homeowners' association to charge a fee only if the governing (HOA) declaration allows such a charge.
      - The recent contract (of which it's content is not public knowledge within the HOA community) between *********** HOA and Condominium Associates addresses a charge of "$35.00 per applicant" for the "Sale/Lease Application/Registration Processing if allowed by HOA governing documents, but no discussions have occurred to address inclusion of these fees within HOA governing documents.

      After reviewing the circumstances and chatting with the complainant, we will be resolving the situation as requested. Our management company was in the process of taking over administrative duties for the Association and the online estoppel service had yet to be set up. As a result, the way it was handled created understandable confusion for which we apologize. Therefore, although the charge is legitimate, we will be sending complainant a check for $150.
