On July 1, 2022, a salesperson from CMK, came to our residence to give us an estimate to remodel a shower. She gave us an estimate of $19,385.01 with a July 4th promotion of $1200 for a final price of $18,158.01. She assured us that the discount would be honored through the following 4th of July week to give us time to visit the showroom. On July 5th, my wife talked to *******************************, the salesperson, on the phone. She told her that she could not visit the showroom that day because of a church event , but she could pay the deposit and sign the contract the following day, on July the 6th. As agreed, my wife visited the showroom on July 6th, liked the materials available, signed the contract and paid the deposit. It was not until September, 2022 that we realized that CMK was billing us the whole $19,385 and was not honoring the July the 4th discount. Apparently there was an expiration date of July the 5th, (the day my wife talked to ********************) and we had missed it because it was in fine print. At the time of signing, we thought they would adjust the final price after making the first payment. In summary, we were denied a $1200 discount because we were never told it was going to expire the following day! If ******************** would have informed us about it, we would have found a way to meet the deadline. I talked to a CMK manager, *****, on October 6th, 2022. He was not moved by the fact that we had a verbal agreement with their salesperson and that we were not aware of a specific expiration date. I told him that my wife had talked to Ms. ******** on July the 5th to let her know of our intentions to put a deposit the following day and during that conversation there was no mention of an expiration date. He said it would be "favoritism" to give us the promised discount. I asked to talk to the owner or somebody in upper management but he said he had the last word.We feel like victims of an unfair business practice and believe numbers were misrepresented!

We are sorry that ************ was confused, but on his image 3 it clearly states he received a $1,200 credit for the July 4th promotion and a additional $500 for being a medical professional.  The contract he signed and paid the deposit on was issued on July 1st and included the discount.  If CMK hadn't honored the discount his contract would have increased by the $1,200.  Honestly this should be reviewed by the BBB and removed as a formal complaint since it doesn't have any merit.

I am rejecting this response because:

That is completely false and the salesperson would have a difficult time supporting  it in a sworn statement.  The truth is that the salesperson stated that there could be only one discount, not both. She offered the July 4th discount and not the professional discount. Their statement only demonstrates how ambiguous and misleading  their contract. was.  So now they are saying that they gave us both discounts. That makes me believe that their pricing was really inflated. The company is basing their response on what they see as proof disregarding completely what the salesperson actually said. My intention was to upload 7 pages including the page where the salesperson wrote the actual numbers. I just noticed that I have a 30 minute deadline to complete this so I am wrapping up and will attempt to upload the missing page. I already faxed it to BBB yesterday. Please look for it. Thank you very much.

    Sincerely,
