    I entered into contract with Presidential Pool Spa to construct and install an inground pool at my home. It was discovered by the newGeneral ******************** that the grading/elevations were calculated incorrectly as my property has a downward slope and the worry is that overflow from rains/storms will breach the pool. Now the design is having to be altered. The correction they presented aesthetically looks awful. I asked that it be tweaked to look better & be safer.Their correction had a small lip/indention that I believe is unsafe (I have young children) as well as visually unappealing. After arguing with the supervisor, I contacted the owner. He was kind enough to come out to personally inspect it with the manager of sales. Upon his review of the structure he agreed that it was poorly designed and was unsafe. He assured me that he would make the corrections and that there would be no additional costs to me as this was a design/construction error on their part and he gave me his word it would be corrected. I was satified with his description of how it would be corrected.A couple days later the crew came back out. The supervisor again told me that they were going with the "lip" they had started to install and not the corrections that the owner and I agreed to, a design improvement that I was willing to go with. I told him I did not understand how the owner could tell me one thing and then he was coming to do the work and would not live up to the expectations that I had after meeting with owner. They have now sent me an amendment to the original contract to charge me to correct their mistake/bad design by over $5000 additional. He has also threatened to "break off" the "lip" that they started to install to try and correct the elevation problem if I don't agree to pay the additional charges, leaving it as it was with the elevation issue and he further stated that they "would not be responsible". I would like the verbal agreement I had with the owner be honor.
