I currently have a lease with Cortland Farmers Market that expires on 9/24/2022. The first notice I was given to renew my lease was on 7/13 and was sent via email by ********************* (see attachment #1). This email only stated my renewal term options and did not at any time mention that notice to leave must be given 60 days before move out date. ***** and I exchanged emails and not one time did he mention a 60 day notice was required. On 8/1 I received another notice from *************************** in which he stated I hadn't yet renewed my lease, and if I planned on leaving, then the property requires a 60 day notice (see attachment #2). I explained to ******* that this was my first time hearing of a 60 day notice. Had I been told this information prior to, I would have known it was time sensitive. I gave ******* my official notice to leave on 8/8 in which he informed me that my move out date would now be pushed to 10/7/2022. I explained to him that I never received notice of a deadline to submit a leave notice. Extending the date poses a problem as I will have to pay a very expensive probated rent fee, double the cost for my electricity since I will be forced into a month to month contract, and a scheduling conflict with work as 10/7 is a weekday. I pointed out to ******* that in the leasing contract it states "If we require you to give us more than 30 day written notice to move out before the end or the lease term, we will give you one written reminder not less than 5 days nor more than 90 days before your deadline for giving us your written move-out notice." This written notice was never provided to me by the property. ******* sent over a detailed letter claiming that it was given to me, however that was the first time I had seen it and he could not verify the date it was sent, the method in which it was sent, nor who sent it out. Had I been given the proper notice, I would not have had any problem with meeting the 60 day deadline.Business Response

All leases include a clause explaining that residents are responsible for providing a written 60 day notice to vacate and this is also explained in the standard email that goes out for renewals. I submitted an application for an apartment with Cortland ***********, but before I did that, I called them multiple times to ask questions. One of those questions was whether or not my unemployed daughter's school refunds would be acceptable as proof of income. I spoke with about four different people the day that I applied. I was able to get it confirmed that for my daughter's school refunds, I would be able to provide an award letter or bank statements as proof of income. A rep from Cortland reached out to me via email the next day and ultimately came to the conclusion that my daughter's income would not be acceptable. So $250 in app and admin fees are down the drain in a global PANDEMIC where people are already struggling because according to Cortland they "reviewed" transcripts and phone calls and came to the conclusion that I am wrong and they never confirmed this information with me. Typically, application fees are not refundable, but in this case, I'm requesting them back as I was mislead. In case they mention in their response the fact that I applied to three of their properties (although it's irrelevant), I want to explain:I applied to a Cortland property in Phoenix months ago and was approved with no issues, I just chose not to move in as I couldn't make it out to Phoenix from *****. I then applied to a Cortland property here in *********** where they wrongly declined me, but because they did, the property rightfully refunded the admin fees back. I decided to try another Cortland property which ended up being ***********, and this is where I made calls to ask if my daughters school income would be acceptable and they said YES only to later claim that they never confirmed this. For the stress and inconvenience, I am requesting that my fees be refunded back to me in FULL and in the mean time, I will submit a dispute with my bank.Business Response

I appreciate the refund. However, I received a bill via email from one of your account settlement specialists saying that I owe $300. I would appreciate something in writing via email stating that I dont owe a balance and that you all agreed to refund the fees.Business Response

I applied to Cortland Oleander today and was denied for a criminal background check. When I called she stated that they go back 10 years but then retract and said they look at the last 17 years and its a point system. I personally dont have a felony on my record at all and my husbands last case was back in 2010. I really feel Like its discrimination and a tactic to take people application fees and monitor how many black people are living at their property! I We have worked really hard to make sure We have stellar credit, good careers and to be denied based of a false point system made up by this property is very sad. It like they are attacking certain people control who lives there! I am a current home owner and never in my life has anyone denied me for a apartment! If you dont have a set time for background checks I feel you should disclosed this information so people would not not apply I have never heard any company going back 17 years for criminal background check! If she is using a point system then why my high credit score income dont put way it if the convictions was 12 years ago and no violence to another person!Business Response
