      Date of issue: March 30, 12:02 am The lot in which my vehicle was threatened to be towed, but hooked and loaded WHILE being present, is a shared lot with 5 businesses including ************. There was a sign in the parking lot that only stated this was a private parking lot, indicating anyone who wasnt a patron/customer would be in violation of this. There were also YELLOW concrete barriers indicating where Waffle House customers COULD park but not specifically labeled. One could just assume that these indicated to park here based on the same brand colors. Upon exiting the restaurant, I was approaching my vehicle and the tow driver saw me approaching my vehicle and proceeded to back up to it. I knocked on his window indicating that this was my vehicle and I was indeed a customer, WITH a food box in my hand. He told me this was for Waffle House and that was incorrect. He then started to load up my vehicle as I unlocked my car to enter. I was then told it would be ONE HUNDRED AND THIRTY DOLLARS to drop it. I had no choice to pay as he completely blocked me from exiting. I contacted an attorney this morning and was advised that according to Rule 515-16-15.04, vehicle shall not be towed upon operator returning with key to said vehicle. Before this results in legal action, I am demanding a refund of $130 immediately in addition to filing a complaint with the better business bureau for incompetence. Including receipt of food bill from restaurant ON SITE!

      I did an extensive investigation into the circumstances involved in this call. Upon speaking to both drivers on scene, the complainant was in fact NOT a patron of the Waffle House. She was a guest of **************** (which she included in her pictures). We have an active non-consensual contract with the Waffle House (see attached) to remove cars that are parked in their lot, but are not in their establishment. We received a call that night from Waffle House security to come out and remove 2 vehicles. The security guard was on site when we arrived and dictated which vehicles should be removed. We are very aware of the laws and statutes that surround non-consensual towing. Yes, when a driver presents themselves on scene with a key and the vehicle is already in our possession, we are authorized to allow them to pay the drop fee of $130.00, which we did. There were multiple individuals on scene that night (per complainants photos) and the driver would not have been able to decifer the vehicle owner until direct contact was made. Once that occurred, the drop fee process was initiated. I can understand that a situation like this can be frustrating, and we apologize for any inconvience, but we followed all of the regulations stipulated by the state.       I am rejecting this response because:

      1) this parking lot does not indicate that it is solely owned by ************, nor does it provide any specifics for drivers to park in specific spaces that do not belong to ************. Again, this is a shared lot with multiple businesses INCLUDING the one I provided a receipt for / the one mentioned in their response. 

      2) while Im not familiar with the correct name for the tools used during towing, I want to explain that the bar used to place my vehicle in the air was still on the ground when I notified the driver that I was the owner of the vehicle. The tow driver , who lacked any type of customer service or communication skills, proceeded to then lift the vehicle up. So it was in fact NOT in their possession prior to knowing who owned the vehicle. The vehicle was lifted AFTER being notified that I was the owner.

      There was a security guard on scene for ************, (an of duty sheriff) who advised you not to park in that location if you were not a patron of ************. We were backed up to the vehicle and hooked up upon notification of ownership. Again, we apologize for any inconvience, but we followed the law to the letter,

      I am rejecting this response because:

      This is completely untrue. When we arrived, there was a parking space almost directly in front of Ronde Voo. As I was pulling in, a security guard for the pizza spot next door placed a cone there. I asked him was he saving it for valet, he said no his security partner needed to park there but we could park anywhere else that didnt have a cone and thats exactly what I did AND advised the security guard at ************ when I approached my car upon exiting that I was told that I could park there. He told me that security must have advised me incorrectly. So this response is totally false and if anything, the complete opposite of what took place.
