On July 18th, All Inclusive Property Restoration LLC signed a contract with Mrs. ****** ***** for both the interior and exterior painting of her home. We were excited for the work and provided a discounted rate for both jobs together. We did do a separate contract for interior and exterior painting jobs due to her financial situation as per her request. She asked us to start working in November when she could finish paying the deposit requirements with several payments made between July and November.
In November, she completed paying both deposits in full so we could start work right away. We purchased all of the materials for both jobs/contracts and mobilized our crew of painters for this large job to go to her house for prep work. After working to complete the interior contract, she decided to cancel both contracts suddenly. She accused my crew of damage to her property and we have photos that all furniture and floors had been properly covered before work began. She has requested a full refund which was stipulated in her signed contract that the refund was non-refundable. We tried to work with Mrs. ***** to resolve this matter but we could not come to an amicable resolution. Our goal as a company is to make sure each and every customer is satisfied with our work.We will attach copies of both contracts.

In response to all inclusive I did not pay a deposit in full for the interior painting the amount that was paid was upon all inclusive request to pay for the exterior painting as you will see in the documents that I sent that the interior painting was not agreed upon we had a communication problem And I had admitted that I was in a bad place with all the things that had been happening in our home that I went ahead and paid him early for the exterior painting Mr. ********* and I had an argument over the damages I had kept him posted as to what was going on And because he called me a liar and I had witnesses especially over the years of living here for 9 years have witnesses to the wear and tear of the house I told him that he was fired He informed me that it was not one contract but 2 totally separate contracts and I said fine paint the outside of the house is not painted he has not responded to me anymore and I want my full refund initially I had told Mr. ********* that's fine keep the 3000 I know that's in the contract refund me the rest of the money he wouldn't do that either so he has all of my money and the outside of my house has not painted I am not asking him to pay for the damages that he did inside I just want him to be gone he has no integrity and he has done nothing to reach a middle ground with me because I even told him over the damages inside that I would pay half if If he would pay half so the inside is a stalemate you have the contracts you have the copies of the checks when they were written when they were cashed and all the other information none of it has to do with the inside nowhere in the contract does it talk about giving me a discount For doing both jobs inside and him the requested money for the exterior painting now that he has not done anything he has not contacted me he is not responded to me I just want my money back so that I can pay somebody else to come and take care of the job that's it and things can be over and done withBusiness Response

All Inclusives ************************ comments below please:
In response to all inclusive I did not pay a deposit in full for the interior painting the amount that was paid was upon all inclusive request to pay for the exterior painting as you will see in the documents that I sent that the interior painting was not agreed upon we had a communication problem And I had admitted that I was in a bad place with all the things that had been happening in our home that I went ahead and paid him early for the exterior painting
This is just not a true statement.
She is admitting she was in a bad place with events that did not concern All Inclusive and it must be causing her to completely misunderstand both interior and exterior painting contracts which she DID SIGN. With that said, she just cant argue with basic math.
Please see both signed contracts which state amounts owned for Interior and Exterior painting.
On the Exterior contract, there are 4 payments written out the customer agreed to make, 1 payment per month in July, August, September, and one final payment upon starting the job. The interior contract states 1 payment amount. Please see details below:
Please see 2nd page of Interior Contract, it says Deposit to be paid is $5,565 (Balance $9k left owing)
Please see Exterior Contract, it stipulates $5k Deposit to be paid with the following payments (Balance $6,500 left owing):
7/18/2024 $1k
Customer made this payment in July
8/1/2024 $1k
Customer made this payment in August
9/1/2024 $1k
Customer made this payment in September
Upon starting $2k
$7,365 check was paid, Dec. 22nd 2024 #***
Customer made a payment for the remainder of the Deposit owing which was $7,565 (Interior balance of $5,565 and remainder of Exterior balance which was $2k).
She accidentally wrote the check for $7,365 which was $200 short. She apologized and asked for direction if she should pay the $200 now or later in text messages I will supply screenshots of.
This is her obvious attempt in good faith to pay for the full Deposit amounts combined for both the interior and exterior painting contracts as stipulated in each separate contract.
Mr. ********* that's fine keep the 3000 I know that's in the contract refund me the rest of the money he wouldn't do that either so he has all of my money and the outside of my house has not painted I am not asking him to pay for the damages that he did inside I just want him to be gone he has no integrity and he has done nothing to reach a middle ground with me because I even told him over the damages inside that I would pay half if If he would pay half so the inside is a stalemate you have the contracts you have the copies of the checks when they were written when they were cashed and all the other information none of it has to do with the inside nowhere in the contract does it talk about giving me a discount For doing both jobs inside and him the requested money for the exterior painting now that he has not done anything he has not contacted me he is not responded to me I just want my money back so that I can pay somebody else to come and take care of the job that's it and things can be over and done with
These statements are not true.
She has admitted she was in a bad place with events that did not concern All Inclusive. We reviewed her claim and determined our crew was not at fault for the pre-existing damages to her piano and floors.
We also cant refund me the rest of the money since it is all a Deposit which is clearly written in both signed contracts. This mitigates our losses; it does not make a profit.
The damages to her piano even looked old, please refer to the images. The wood exposed is not fresh wood, they look like old scars. The scratches on the floor were old cat scratches, not fresh, new scratches, again, please refer to images. We have photos that all floors and furniture were covered for the entirety of the job.
Mrs. ****** ***** called and asked us to switch to the exterior painting contract that had been agreed to and signed for and she would not be continuing with the interior contract any longer.
She then requested we continue talking after the holidays. When that time came, we did not come to a resolution since we concluded that there was literally no possible way the damage was caused by our crew after reviewing her claim and evidence.
She subsequently cancelled our contracts so, of course, we kept the Deposits because this was clearly stipulated in both contracts which SHE SIGNED.
We left the premises and left full supplies for both interior and exterior painting contracts that had already been purchased there.
She did send another text message asking us to come back to work on the exterior painting. Of course, we advised her that she cancelled her contracts already.
We keep the deposit because we have to pay our crew for the work completed as well as have already paid for the entirety of the supplies for both contracts.
We arent making money off Mrs. ****** ***** we are trying to break even just on our actual costs, not including our financial losses in terms of all of the time that was spent working with her. That is the entire reason to collect a Deposit in the first place.
The discount for doing both jobs was a verbal conversation, we didnt write that on the contract per say. It doesnt mean that wasnt a point of conversation obviously.
Of course we didnt finish the exterior painting, she cancelled the contract. We will no longer be doing business with Mrs. ****** ***** since we no longer feel comfortable working for her. We pride ourselves on customer satisfaction and word of mouth referrals. She is no longer the type of client All Inclusive loves to partner with.
