One time sports spoke to an office staff person in my medical practice to obtain sponsorship and finalized a logo sponsorship without getting the business owner's approval or final say. They are calling our emergency patient line incessantly trying to obtain payment for something that was not even approved or requested by an individual in the business capable of making final business decisions.Business Response

I am rejecting this response because: I reached out to administration at the school that this company was allegedly working with, and they have no record of this company relationship. They spoke to the athletic director, looked at all their ledgers, and have no relationship documented. We have major concerns about this companys behavior. I have spoken to them personally and have had no confidence in their ability to resolve this matter. I want no contact from them.

I am rejecting this response because:
Administration office was not aware of this contract. Again, I am the business owner and the only one capable of making business decisions such as this. I did not approve drafts of the work. I did not approve the work. When we called around to assess the legitimacy of the business, we did not get confirmation from speaking to area high schools that this was a legitimate business. You are not working within guidelines set in the state of *****. I have submitted a complaint to the Texas attorney general office. I do not want any more contact regarding this issue.

One time sports are bullies and have horrible business ethics. I am the owner of a business and they cold called my secretary while she stated we were very busy. They then said they had a deal with our local high school sports teams and we should advertise. My secretary stated that we may be interested but we are very busy right now and the doctor would have to get back if they would just email information to him. We later explained we could not advertise with them at this time due to funds from moving into a new place. Thats when the harassment and threatening started from One Time Sports. They illegally recorded my secretary without her knowledge first of all. They stated the voice recording is like a signed contract when I never saw and paperwork not signed anything. In early December, 2023, my business was contacted by On Time Sports concerning placing an ad on the Spring 2024 shirts they were providing the local high school baseball team (Eldorado Eagles). Our interactions with the company have been uploaded. We agreed and paid $725.00 on 12/13/2023 (uploaded). They said we would receive one shirt to see what it looked like, which we did. Early in the week of 3/11/2024, we were again contacted by the company and they asked us how things had gone after the fall shirts and were wondering if we wanted to be a sponsor for the Spring 2024 shirts. This was confusing since we were originally told we were a sponsor of the spring shirts. We did not immediately agree since we thought we had already paid to sponsor the spring 2024 shirts. We also know that the high schools do not play fall ball so this was not making sense. On March 13, 2024, my mother ran into an acquaintance who was wearing an Eldorado baseball shirt. She said that her son is a senior on the team. My mother told her about the shirt I had sponsored and described it to her. She said that she had never seen a shirt like that. On March 14, my mother took the shirt to her so she could see it. She again said she had never seen that shirt. She called the head of the booster club and sent her a picture and that individual said she had never seen that shirt. The acquaintance suggested that it was probably a scam. We looked up the company on the internet and it said that it is a scam and there were many complaints similar to what happened to us. We paid money for advertising on shirts that the team never received. We would like to have our money refunded as this was obviously a fraudulent scheme.Business Response

Around Nov. 2022 this company reached out to me about sponsoring the local *********** for $399 a quarter by advertising my company on shirts. I did not seek them out or request advertising through their company. After numerous phone calls, I did agree to do so. They then contacted me again, stating they had no one else to sponsor the school and requested I sponsor it again. They offered a discount and I agreed to the $350 a quarter price. My company has since moved and is no longer in the High School's area. I contacted them personally on October 4th, 2023 and advised I would no longer be continuing my sponsorship as the business was no longer open in the local location and she stated it was too late to cancel my sponsorship as the shirts were already in production for the winter season, but she would note my account for the spring season. Reluctantly, I agreed to pay it, even though the shirts had not been produced yet and the business was closing, feeling obligated to do so. I have since been contacted again stating I have yet another invoice come due. I have confirmation my account was documented and that I advised the clinic was closed but I'm still responsible to pay another invoice as it was "not cancelled within the 72 hour policy". If it wasn't cancelled within the 72 hour policy, how is that correct? I cancelled previously more than 72 hours before the shirts were produced, as I didn't even receive a shirt until December, as well as these current shirts haven't even been produced yet. Even if they had, I cancelled before the last set were produced. I am now receiving numerous emails and calls per day about owing $350 for advertising on a clinic location that is no longer open. I feel I cancelled with plenty of advance notice before the last set of shirts shipped as I cancelled Oct. 4th and they shipped Nov. 30th, I absolutely cancelled in time for the Spring season, which is documented in the attached emails.Business Response

I am rejecting this response because:I'm sorry, but did you try and fill the spot? I am inclined to assume I highly doubt it.
The business is closed and advertising is not appropriate for a closed business. There was no contract signed for this and was an optional sponsorship that your company sought me out for. I optionally signed up for it. I reluctantly signed up for the additional seasons, personally feeling guilted into it, which is really bad business, when your sales team contacted me stating "we have no one else to do it", which in fact wasn't true. The whole shirt was filled with local businesses advertising. I was mislead, which is just bad business. Irregardless, that's only a small portion of my complaint about your business and the way you conduct yourselves. I do not want to continue with my sponsorship on the basis the business is no longer open, as was stated in my call to your company on Oct. 4th, 2023. I was informed I would not have to and gave you more than enough notice prior to production of the Spring season.

You have repeatedly that you did agree to this, and we produced the product on your behalf. Therefore, we have to do our best to resolve your account. You were only produced for one season due to your lack of payment. We produced and shipped one season with the assumption you would take care of your past-due balance. We do the sponsorship three times a year. If you had signed up for the seasons individually, the policy would be based on your invoice date. You agreed to the full year at the same time to receive the discount, so you received all your invoices on March 30th, 2023.

The company that I work for, *************** of ******** ********, was contacted almost a year ago from On Time Sports to see if we would be interested in a sponsorship. At that time, our ********************* Manager, ************************* had asked for them to send us more information on the sponsorshipfor us to review before deciding. Our team had decided not to sponsor and notified One Time Sports. We later got a shirt mailed to us with our name, among others without our official logo. ******* then reached out to remind them that we had declined sponsorship. Since that time, our company has received multiple calls and emails demanding payment for a sponsorship that we never agreed to. They claim that we agreed over the phone as all their customers and they have no formal record of our agreement.When On Time Sports was asked to provide proof of agreement they simply sent another invoice. Employee emails were reviewed to ensure no agreement was made on our end and emails to On Time Sports made it clear that we were absolutely not interested in a sponsorship. When the company was asked to stop calling and emailing due to the harassment that our team felt they declined and said that they would not stop. That process includes a manager going over billing terms, gathering an outline of what you would like on the ad, our cancellation policy and it's an opportunity to ask any questions. This is done, so we can ensure that you are aware of the commitment being made. Not only did ******* agree to the sponsorship, but she also agreed to the corporate sponsorship, which covered you for the Fall 2022-Spring 2023 sports.
At this time, we have canceled the Spring 2023 agreed upon already. Unfortunately, we have to continue in our efforts to get paid for the services rendered. As for different numbers and emails, we have many different employees working on past-due accounts.

Approximately on 12/21/22 just before the holidays I get in Invoice from OnTimeSports. I didn't look at that time, however when I did look at the invoice after the holiday weekend, it was for Tshirts I never ordered. I receive a phone call from graffics and I told him I never ordered these nor did I authorize anyone to order these. I repeatedly got phone calls for collection and I repeatedly told this company I didn't order them nor did I authorize anyone to order this product. I learned they contacted my store and they got an employee to commit to thousands of dollars. I as owner canceled immediately after seen the invoice and since the t-shirts were not printed I thought it would be an easy resolution however they refused. They've not lost any money, however dealing with OnTimeSports is like a whack-a-mole game. Over and over your dealing with different employees and nothing is resolved. It's simply a scam. They pressure, threaten and harrass for payment. They do not want a resolution, they want money even if it was committed from an unauthorized person. it's a vicious cycle you talk to person after person and you never get anyone at the top for a resolution. I told them "no one" absolutely "no one" at the store has authority to purchase anything from anyone but me. If you want to collect for something not printed yet, collect from whoever authorized it, because it wasn't me. The next day it's the same thing all over again.Business Response

When you contacted the AR department, you asked where the bill came from. We informed you that it was your GM that authorized the ad. You stated to us that they had no authorization to do so. Upon that, we looked into the sale. The recording of the sale was also shared with you. In the recording, you hear us ask for you, but your GM states that he is authorized to place the ad and he will let you know he has done so. We did not pressure him to do that. It was asked multiple times if he was authorized to place the ad. Each time, he stated he did.

When we spoke yesterday, I sent you proof of all of your agreements. You stated to our graphics team, just yesterday, that you wanted to add 5 shirts to your order for the Winter 2022 season, and approved your ad. I wouold be happy to provide you that recording of your call. Our collections rep then contacted you to discuss the bill, since you were adding the t-shirts, as well as to discuss the past due amount for the Fall 2022 season t-shirt. When this happened, you stated, "I owe you ******************'t I?" You let the collections rep know that there was confusion and you didn't want to participate in the Winter 2022 season and only wanted to pay for the Fall 2022 season we already sent you. They brought the issue to my attention and I offered to let you back out of the Winter 2022 season, contingent on you paying for the Fall 2022 season. When you were contacted back, you stated you are not paying for anything, started screaming and terminated the call. As previously stated, I have sent you all the recordings of all of your agreements. I also sent you the copy of the call where you told us you loved your Fall 2022 shirt and would pay for it. We cannot cease contact until this bill is rectified.

I had asked for a sample of tshirts for fall. Because the first campaign i did with them you could not even read the logo. It was a blob of ink. I advised them i would not be ordering again without a sample of their work for fall! Considering its just now fall when I received the tshirts I obviously thought they were for fall, as per my request. I was so pleased that they had taken my request seriously that I did say i loved them. Only to find out that they apparently ran fall without my approval and was now trying to get my approval for a separate winter campaign. This individual is wresting my words! And not sharing the entire conversation or situation! When I said i would take five more i again believed it was the fall campaign. The fall campaign was completed WITHOUT my approval and now they were trying to get me to agree to yet another campaign. 600 (SIX HUNDRED dollars worth of scamming! I am a successful business owner with a 800 credit score. If i had ordered something i most assuredly would pay for it. I ordered nothing from this scam company for fall 2022 or winter 2022. The five tshirts would have been ordered on the fall campaign had my instructions been completed as I had requested. But that wasnt possible as fall season was completed months ago per the way they handle their print jobs. I was informed no samples would be given and I definitely was not approving anything until i saw it on the shirt to make sure their screening was legible! Based on their first campaign that was not the case. Once i found out i was being scammed into the winter season i said no way! Cancel the xtra five tshirts that i thought was for fall. I have spoken with the Better Business Bureau today. You must provide a copy of our contract and all recorded voice messages. In their entirety! Also Ive spoken with an attorney and If this fraudulent charge isnt dropped I will be contacting the police and filing a restraining order! When I stated do I owe you money. I had forgotten I had already paid for the first campaign and I have that invoice and it is paid in full. I ordered and completed one campaign. We have no further agreement or contact beyond that. You have a very long line of complaints of scams that I truly wish id seen. My next report is going to be fraud at the level of the federal trade commission. All phone records and dates are currently under review.
Your submissions are also required. Ive been assured the full conversations will be transcribed.
