      My husband and I went to daum construction to build our dream home, we entered into contract on Feb. 10th. Per our contract builders mtg was to take place within 30 calander days. Our mtg took place on March 6th. Our contract stated they would put on mls, they never did. Our contract price after upgrades was $620,860.00. Through the building process we tried to sell our current home and to this date are still trying to sell. On Aug 1st we were told they needed to move our close date from Sept 8th to September 27th. Our realtor asked them several times if they would work with us if we didn't have our current house sold, they said they would work with us. We went to the house on October 2nd, saw a sold sign and that electrical work had been completed after the fact. They never notified our agent that they had sold our house, now they won't refund us.

      In February 2023 the parties entered into a written purchase agreement with respect to the construction of a custom home. The closing of the sale was set for September 8, 2023.  The pre-construction meeting was properly held on March 6, well within the stated 30 day period. On or about August 1, the parties voluntarily signed an addendum extending the closing date to September 27. Daum Construction, through their agent, advised the Buyers to drop the listing price of their current residence to help facilitate a sale before the closing date. Daum Construction subsequently completed the construction of the residence in a timely manner. On or about September 20, the Buyer's realtor communicated that he Buyers were not yet able to sell their current residence, thus they would not be able to close on the September 27 closing date. The Buyer's realtor inquired as to whether Daum Construction would be willing to again extend the closing date. Daum Construction indicated that they may be willing to consider another extension, yet requested that the Buyer's provide a written addendum to that effect. The Buyer's failed to ever submit any such addendum. Daum Construction was informed that the Buyers' current residence was not under contract and that no closing was expected in the near future. Daum Construction informed the Buyers' realtor that Daum Construction had expended significant funds to construct the residence and that it was unable to indefinitely delay the closing. The Buyers were also informed that the subject residence was being listed for sale due to the Buyers' failure to close and failure and refusal to provide a written request for an additional extension of the closing date. The only monies being disputed by the Buyers were explicitly identified in writing as non-refundable and were primarily the result of specific custom upgrades/changes requested by the Buyers. Daum Construction would have preferred to allow the Buyers to purchase this custom residence, yet the facts of this matter clearly indicate that the Buyer did not perform, and were not able to perform, their contractual and financial obligations required to close. At no point did Daum Construction fail to meet any of its contractual obligations owed the Buyers.

      I am rejecting this response because:  we were never told of any of this information.  Our realtor told us they would not extend. The house never was  listed on the mls till Oct 10th in which on October 3rd we were informed it was under contract. The only way we found out was we drove by saw electrical work had been added and there was a sold sign. The house closed on October 26th. So with a 30 day escrow, how did they close if we were technically under contract till 9.27.

      I have a blockage in the down spout that is causing flooding. I contacted **** Homes for assistance 2 years ago to no avail. My home was built on 2020. My problem remains and even though I paid for it to be cleaned out there us still a blockage under ground that **** and or contractor cannot tell me where the drain drains too.. **** has been Negligent with his product of building homes even though my house is only three years old the cement is also cracking as well as other homes in the neighborhood. I dont know what my other recourse is? Thank you for any assistance and/or thank you for just being there.

      I had *********** come out, at my expense. They located  where the drain is buried Under the ground. The drain is either broken ( Has been) or the contractor did not finish extending the pipe. There is no way too tell until the ground is dug up. Either way I still have a non functional drain and there is a sink hole where the drain is under ground (non Visual) Insufficient  and Negligent work provided by the contractor hired by ***********************) hired for the placement of the drain that extends from the downspout. I am requesting  **** homes, *********************** To except responsibility for this damage line and have  it repaired by the contractor who installed the drain pipe or hire another contractor to repair damage.  I have made calls to the lead ******* for **** homes and the contractor who laid the cement and installed the drain, no return calls from either to date.

      7/24/2023. I am still waiting since this date for any resolution from **** housing.
