On 6/27/2022 myself, ****** ****** and ******* ****** went to Gold's Gym to inquire about membership in Pocatello, ID. A young kid showed us around. I told him I had the year before had a problem with VASA Fitness out of **** and that they did not honor their monthly charge. The kid told us that there was no enrollment fee and that the monthly rate was $9.99 per month and no contract and that it was month to month, quit at anytime. I questioned him because I did not want another situation like I had with VASA Fitness. He confirmed that it was $9.99 a month, no contract quit at anytime. I tried to get ****** ****** and ******* ****** to join but they wanted to look at another place. I told the kid I wanted to join at $9.99 per month. He then started getting paperwork together which was on a tablet. I told him I did not have my reading glasses. He said he would explain everything to me at which time makes it a verbal agreement. I received a copy of the said contract. Reading glasses or no reading glasses the font is so small that it can't be read, again making it invalid. Gold's Gym did not provide the service they stated they would provide. In July I discovered they were trying to charge me $63.55. Again violating the agreement. For health reasons I needed the use of the gym but I refuse to participate with a company with low morals and ethics. I then got a notice from a collection company *************************. I exercised my rights under the ***** and disputed the debt to never hear from them again. I just recently discovered that they failed to comply with ***** and went ahead and tarnished my credit report. Under normal circumstances the statue of limitation has expired but I have checked and discovered whereas I just found out about the fraudulent report on my credit report that can be adjusted to when I first discovered their wrong doing. I am in hopes that this will be resolved without further escalation.

I am rejecting this response because Gold's Gym is responding solely on a contract that is completely unreadable  even now with my reading glasses and a magnify glass.  At the time of joining the gym I informed the little boy they employed to show the facility and get people to enroll, that I did not have my reading glasses and I could not read the contract.  He said he would just tell me what it said making it a verbal contract.  He stated it would be $9.99 per month.  The two others that were with me almost joined whereas it was a good deal.  Like the saying goes, "if it sounds to good to be true ....."  Gold's Gym refused to honor the verbal agreement made and after the fact want to use a written contract that is unreadable.

    Sincerely,

    ****** ********
