Company does not appear to be advertising in an honest matter and operating in compliance with the advertised rules of conduct for Accredited BBB listed companies. This is very clearly written."Follow established legal and ethical advertising and selling practices, including, but not limited to, the BBB Code of Advertising."29.2 Puffery may include statements such as best food in the world and we try harder as well as other individual opinions, statements of corporate pride, exaggerations, blustering and boasting statements upon which no reasonable buyer would be justified in relying. Puffery also includes general claims of superiority over comparable products that are so vague that it can be understood as nothing more than a mere expression of opinion. 30.1.6 It is not clearly stated that the endorser, associated with some well-known and highly-regarded institution, is speaking only in a personal capacity, and not on behalf of such an institution, if such be the fact;In this regards Improovy is advertising all over the ********* market that they are 'The #1 rated painter in the area' but not only provide no proof of having been given this rating or designation by anyone but themselves but most available ratings also seem to disagree with their assumptions. The company advertises repeatedly and even clearly on their own website:#1-Rated ******** Painters Improovy Painters ******** is here to make painting your *********** house, condo, or apartment easier than ever before. We are a top-rated and locally-owned ******** painting company There is no proof of this anywhere. The company has decided these things and even though the rules of accreditation clearly show this is puffery the company has decided to do it anyway. This should not be allowed under any circumstances as the rules are clear about this type of conduct. In fact the entire main page of their website is all puffery.***********************************************************************

      Business Response

      Date: 12/30/2022

We're happy to change anything on our site.

To be fair, we have worked tirelessly to become of the best rated painters across all locations in the 3 years we've been in business, accruing more 5-star review than any other painting company in the Chicago-St Louis ***** area in that time span. We can show data to prove this and our claim. We are also happy to share data regarding the ease of working with us as a consumer per our in market research as well as our mobile estimation and booking process.

Holistically, If you search for painters in any geography the first listings that show up are the 10 best rated painters from Yelp, *****'s list, HomeAdvisor, expertise.com, etc. Given that their top 10 lists for best painters on their platform are largely based on which painters pay the most for advertising with them, how are companies like improovy supposed to compete in any market where these lead aggregator sites dominate first page results? Given that they are not responsible or accountable for the work performed by any of the painters listed on their site, how is this fair and how are we supposed to compete in the market against these legacy directories?

As a painting service platform responsible for the work performed at consumers homes, I really don't understand why we are held to a different standard than them. If we are not able to freely compete in the market per our BBB certification, We are happy to cancel our national accreditation membership and perhaps should request a full refund of all payments made to the BBB. It is hard enough for us to compete against these billion dollar aggregators, why does a startup company have to sacrifice being able to freely compete in a market because of a claim by a person who may or may not be a competitor trying to spam our listing?

Happy to discuss further with our national account representative on the line as well.
