On 1/25/25, I scheduled a tow for my vehicle due to the brakes on my vehicle going out. E&R Towing did send a driver to meet me at the location I had requested to pick up my vehicle up. The driver loaded my vehicle onto the bed of his tow truck. The bed of the tow truck was almost completely up/horizontal to the pavement. While the bed of the truck was in the air, the driver's chain, that was hooked to my car, snapped. My car rolled off the bed of the truck, the front two wheels hit the ground, making the car stand almost upright on the front two tires and nose of the vehicle and then the back of my vehicle slammed to the ground. If the curb in the parking lot had not been there, my vehicle would have gone out into traffic. My grandparents were still sitting in their vehicle in the parking lot, facing North towards the tow truck. So, they did see everything that transpired. The driver did call the incident into his dispatch office. Then my car was towed to my home. I did inform ******** in dispatch of the incident but still had to pay for the tow. The next business day, I called and talked to the claims manager, **** ***********. He said that he was not made aware that this incident had taken place over the weekend. My 2004 Chevrolet Caviler has been damaged as a result of this incident. I filed a police report, took pictures and had submitted this information along with my statement and all the details the tow company requested to be sent to their claims department at and included the claims manager on the submission. I have tried to reach out and get an update on this claim several times, but now I am getting no responses.

On March 12, 2025 my blue 2014 **** Q7 was towed by E&R Towing at approximately 3pm from a ***** parking lot located at **************************************. The parking lot is operated by the city of **********. Upon filing police report the city of ********** confirmed that they did not request for the car to be towed. Nothing was owed on the vehicle. Parking for the day was paid for. On March ******* the storage business next to the parking lot was able to provide us with video surveillance showing that E&R towed my vehicle. My husband and I called E&R several times and they said they did not have record of my vehicle. It was not until my husband emailed them the video that they admitted having towed the vehicle. Their story is that a girl named ******* called them stating that her key fob did not work and paid them $100 to relocate the vehicle to Progressive ************************* at ************************. E&R pretty much said your vehicle was taken here, if you want it, go get it. Of course we went looking for the vehicle and it was nowhere to be found. E&R refused to take any responsibility stating that no towing company verifies ownership and there was nothing else they can do. E&R illegally towed our vehicle, or they were involved in the theft of the vehicle. How can a stranger call to have a vehicle relocated and the tow company does it no questions asked? How can a tow company not have record of the service performed? It took several phone calls, a video and visit from the police department to get any information. E&R is responsible and they need to make this right by replacing our stolen vehicle.

We have been in contact with the *****************************  We have provided to them all of the paperwork and video/audio recordings in our possession.  Hopefully this information will help them with their investigation.

      Customer Answer

      Complaint: 23108985

I am rejecting this response because:

The issue is not your cooperation with police.

The issue is that your negligence, and your lack of appropriate protocols led to my vehicle being stolen.

The issue is that your business did not protect my rights, as the owner of the vehicle. The issue is that your legal compliance is questionable.

The issue is that your business lacked the customer service and professional conduct when my husband and I reached out to you for information.  You were dismissive and refused to take any responsibility for the occurrence. It was not until a video surfaced, and police were involved that you magically found details on the relocation of the vehicle.  It took a handful of phone calls for us to get any information. Do you not keeps record of the services you perform daily? Why did it take 5 phone calls for you to let me know that you picked up my vehicle in **********, but relocated it to *******?

The issue is that the address you provided my husband of where the vehicle was relocated, was not the same address you provided to police.  The issue is that a woman called to have the vehicle relocated, but a male took possession of the vehicle at the relocation cite; and neither of those people had any rights to the vehicle.

The issue is that my vehicle was stolen and destroyed, and that I am now without a vehicle.

So please, do let me know how you plan to fix this huge mishap on your end.  It was your negligence that led to this.

      Sincerely,
      ***** ****

We have and will continue to cooperate with the **************************** regarding this case.  Your frustration with this situation is obviously well-warranted.  Our subpar customer service in response to both you and your husbands inquires was not as professional as it should have been.  However, at no time were we either complicit or negligent in the final disposition of your vehicle.   What happened to your vehicle is very unfortunate.  We responded to a phone call for service, provided that service and received payment for it.  The fraudulent intent of the caller who requested the tow was unforeseeable.

      Complaint: 23108985

I am rejecting this response because:

While I appreciate that you finally take accountability for your lack of customer support, it's quite disappointing that you continue to wash your hands of any responsibility relating to the theft of the vehicle.

Your lack of the appropriate protocols eventually led to the theft.  I am sorry to hear that you are unwilling to take any accountability for that, and that this might lead to another situation similar to mine.

      Sincerely,
      ***** ****

      Business Response

      Date: 05/05/2025

This is very unfortunate circumstance where one fraudulent caller can cause such trouble.
Our protocols are industry standard.  Transporting disabled or trespassing vehicles is the towing business.  When dealerships, body shops, auctions, motor clubs and private parties call us for service it is an industry practice to respond to their request and tow the vehicles to the designations they specify.  As most of these requests happen via phone calls, email and faxes; we are unable to verify intent or even the legal responsibility of the requestor for the vehicles to be towed.  Such is the case with most service industries utilizing the honor system in regards to customers.

      Customer Answer

      Date: 05/13/2025

      Complaint: 23108985

I am rejecting this response because: More than unfortunate, it has been devastating, and a total loss of time, money, and energy for my entire family. My vehicle was neither disabled nor trespassing. A private party called you to transport the vehicle, but a different private party received the vehicle at the designation. How is that not a red flag? If you are blaming this on industry standards, what about your business standards? I am not asking you to verify intent, I am asking why you do not verify that the private party calling you has any rights to the vehicle. Do not blame this on industry standards, when you as a business have every right and responsibility to apply and follow protocols that protect, not just your business, but also customers, and consumers.

      Sincerely,

      ***** ****

Our investigation as substantiated by the type of towing equipment used to perform this tow (auto-loader tow truck with wheel dollies),vehicle inventory report, pictures and questioning of personnel involved; we have concluded the alleged damage reported was not the result of any action or negligence on the part of our company. Utilizing specialized wheel lift equipment that only tows vehicles by securing to the tires does not sensibly contribute to any physical damage to a towed vehicle.  We deny any responsibility for the current condition of the vehicle.

My car was towed by this business and they damaged my car. I am currently unable to drive my car because they towed my AWD car by pulling it instead of putting it on a flatbed. My transfer case/differential is broken and leaking fluid. This company keeps getting away with damaging peoples cars. They lie and they're very corrupt. They're con artists!

Had a mechanical breakdown tow from E&R Towing arranged by Geico on Dec. 5, 2024. When my car was removed from the tow truck at the dealer to which it was towed, the front left tire hooked on the rail of the tow truck bed, causing a deep ***** in the sidewall, requiring the tire to be replaced. The driver acknowledged that the tow truck damaged the tire on my invoice, as well as on the invoice given to the dealer to which the car was towed. I filed a discrepancy report with copies of both invoices with the driver's acknowledgement of the damage on Dec. 19th (the original filing was sent on Dec. 6th, but sent to the wrong email address which was given to me by a receptionist at E&R). With the report and copies of the invoices, I attached pictures of the damaged tire and a copy of the receipt for the purchase of the new tire. The rim was also damaged, but since I haven't determined the monetary amount, I am not asking for that, but only for the tire replacement cost. I was told it takes 4-6 weeks to process the claim- it has now been 8 weeks. I have made multiple phone calls and have not been able to talk to the claims person (****). I have left numerous call-back messages. The last time I was able to get through to him was on January 8th, at which time he told me to call back in two weeks. I have not been able to get through to him since, trying multiple times, multiple days, leaving multiple call-back messages. I also emailed him and have not received a response. I am seeking reimbursement for the tire replacement. The original tire was only 6 months old.

I am rejecting this response because:

The car had to be towed from the impound to the Toyota dealership because it was not drivable. Also I live in Ohio and had to go back so I didn’t miss anymore time at work. Thus, it was not feasible for me to tow my car to 2 other locations ($225 tow fees plus additional nights hotel stays while they inspect my car) so I was only able to get one estimate. Please see attached. The BBB won’t let me attach a last picture which is the service fee of $188 however all of these photos were emailed to the claims email listed which they gave me at the impound. That email was sent on September 14, 2024.

      Sincerely,

      Taylor Berns
