Horrible experience. They just ran up the billable hours while not fulfilling my requests. They sent important information via an old email address which I had told them month prior I did not want then to use. Then they withdrew from the case because I failed to respond. Do not waste your time and definitely not your money dealing with these crooks. I plan to file a complaint with the ****************Business Response

I was seeking an Attorney from OFlaherty Law, I have a retainer of 2,500$ to help me get my visitation for my son, my attorney showed up, 2 times. **** saying he WASNT gonna charge me for the calls and did. I was talking to 4 different attorneys, one was fired. They never got back to me. Now I keep receiving mail and emails from that that I owed *****. Now its *******. I have tried to speak my mind, as well as my wife and I am not happy that I hired them to help me do a job and they barely did a thing. Im not happy with that law firm. I saw an advertisement by O'Flaherty Law that **************** were experts in HOA disputes. OFlaherty publishes blogs on HOA questions and advises anyone reaching out to reach out to ********************************* My husband ************************* (63 years old) and I talked with Attorney ********************* regarding our situation at *** **************************** *******, **. ****** told ** he assigned our case to Attorney ***************** because **** was knowledgeable about tree disputes among neighbors and currently was working on a tree dispute case. Attorney ***************************** also billed on this case. I never met nor spoke with *****************************. Bona Doci began billing on our case on 2/24/2023. Much of Doci, ******, and Purchas billing of $6,000 on the case is in .10 and .20 per hour (6- and 12-minute) segments. We paid $2,500 on 2/24/23; $2,000 on 4/7/23, and$1,500 on 5/9/23, totaling $6,000.We paid $6,000 to OFlaherty lawyers to work on our case in 6-minute and 12-minute segments over five months. And the three lawyers did not even know the law about maintaining trees in an HOA.We exchanged 31 messages with Attorney ********* via ********************** system. The attached Clio messages show Doci not knowing what was going on in the case, and at one point she sent work to us a week late and completely off subject. We talked via phone 2 or 3 times, possibly. We never met her in person. **** sent a demand letter to our neighbors counsel asking the neighbor to trim the tree and pay for car damage. The law is that the Association maintains the tree. **** included a paragraph that she told me she didnt understand; yet, she signed the demand letter.**** quit work on 7/7/23. We sent a request to speak on 7/26/23, and Docis out-of-office message read she would respond after 8/14/2023. Doci never responded. **** and ****** did not respond to our 9/28/2023 letter sending a request for a refund.Could you help us get a refund of $6,000? .Business Response

While I can confirm she was a client and did receive the services she is indicating below, I cannot go into detail due to the nature of attorney client privilege. ****************************** matter was wide ranging and inconsistent. It was also a bit of a moving target, as she informed us that the status of the case was one thing and when asked to demonstrate the same, was unable to. She also spent multiple correspondences and calls requesting and receiving advise on matters we advised her not to pursue.
Nonetheless, our billing was done in accordance with her retainer agreement. Attorney ****** was assigned to the file as a junior attorney to assist Attorney Doci on the file.Long story short on this matter, ************************** has a dispute with a neighbor and did not want to involve her HOA. So we followed her instructions to work around that restriction.
Additionally, our office has an established policy that all billing disputes need to be issued within 14 days of the issuance of the invoice. It is included in our retainer and on each monthly statement. The last invoicing period was in July for this file.September is well over 14 days away from July. Here is our response and request to reopen our case, Complaint ID ********.Please email if more information is needed.OFlahertys response to our BBB complaint is factually incorrect.************ response, however, continues our client experience of OFlaherty lawyers lack of competence and diligence in our matter, as defined in the ******** Supreme Courts VIII Rules of Professional Conduct of 2010, and The American Bar Associations Model Rules Professional Conduct.We asked via email to discuss OFlahertys fees and work product on July 26, 2023, nine days after receiving OFlahertys final invoice.
This date is well within OFlaherty Law Firms 14-day cutoff for questioning fees, contrary to OFlahertys BBB response to our complaint. (See attached our 7/26/2023 email).The OFlaherty BBB response states we requested a discussion in September, which would be two months after our email was received by OFlaherty Law. Actually, we wrote a second letter on Oct 5.************ response to our BBB complaint continues O'Flaherty lawyer's practice of citing incorrect facts during their management of our case. This is part of our complaint to the BBB.OFlaherty Laws website includes 21 different webpages advertising its lawyers expertise in HOA law for cities, towns, and even our neighborhood, ******* Park in addition to blogs explaining HOA law.(See attached.) We believe, in our case, OFlahertys online advertising of its lawyers HOA law expertise violates the FTCs truth-in-advertising laws.We read five of ************ 21 webpages, wherein the firm inserts a rotating message about its lawyers' expertise in HOA law, with simply a change in the name of the neighborhood, city, county, or state.The five pages that applied to our situation were: ******* Park HOA expert lawyers; ******* HOA expert lawyers; ******** Preliminary Injunctions and Temporary Restraining Orders Explained; ******** Orders of PRotection Explained; and ******** Restraing Order Law Changes For 2023.Obviously the 21 pages of advertising ************ legal prowess in ** HOA law and handling Injunctive order and Orders of Protection were materially important to our decision to retain OFlaherty Law.After reading OFlahertys website advertising, we retained OFlaherty Law to help us with our Stalking/No Contact Order against our next-door neighbor due to the neighbors tree encroachment, and car damage issues (which are estimated at $1,095), and months of harassing emails from our neighbor, HOA board president and HOA secretary. (see attached).So far the neighbor's encroaching tree, that hits our roof, window and gutters, has cost our HOA association: 6 roofing decks replacement ($6,470); mold mitigation (estimated at $3,200) and interior restoration (estimated at $1,800). Total, if no further mold mitigation is needed: $11,470.00Our retainer and all invoices from OFlaherty state our matter was Petition for Injunctive Relief.The invoices show OFlaherty lawyers overwhelmingly billed work on the case in 6- and 12-minute increments, i.e., .10 and .20 hours.We maintain a lawyer cant understand a case if the lawyer looks at texts for **** hours or **** every other day or every few days.We maintain O'Flaherty lawyers Dorrich, Doci, Purcha, and MHH(whoever this person is) did not show any knowledge in our case of how to organize the evidence.(See ** Supreme Court Article VIII. ******** Rules of Professional Conduct of 2010: Rule 1.1 Competence and Rule 1.3 Diligence; and Rule 1.1 Competence and Rule 1.3 Diligence.Our assigned OFlaherty lawyer, ***********************, advised us from 2/24/23 to 6/5/2023 that helping us with our 8/23/2023 No Contact Order hearing against our next-door neighbor was "outside of her scope of practice."Then, after more than three months of billing us thousands of dollars, Doci on 6/6/2023 found an OFlaherty colleague who could advise us about our No Contact hearing scheduled for August 23, 2023.We would like ********** to explain why ****** was not consulted in Feb 2023, when we retained O'Flaherty Law.Doci, *******, and ****** could have "found" ********** Attorney ************************* to advise us and told us the applicable ** laws for HOA tree encroachment issues in one meeting.Finally, we were billed $45.00 for a partner review of our file on 6/21/2023 by MMH. Who is this person? We were never introduced to ***. He did not provide services to us.2) O'Flaherty lawyer ***********************, supervised by ***************************** and MHH, organized and worked our case almost exclusively by texts.Attached are thirty-one 8 by 11 pages of texts to/from our assigned OFlaherty lawyer advising us on our case.There was one introductory phone call with *******, who referred us to Doci because she knew HOA law regarding tree encroachment and was currently working on a tree dispute case and 2-3 short calls with Doci when we insisted on calls due to misunderstandings in the texting.************ texts show our attorneys misunderstanding of the messages, which required more billing time to get clarification; texts that were a week late from lawyers promised date of delivery; and texts with Doci's musings that are insulting and defy common sense.Our assigned OFlaherty attorney never asked us to send a timeline of the 12 months of harassing from our neighbor and HOA president and secretary,.3) Our assigned OFlaherty lawyers did not know ** law regarding HOA maintenance of a tree in one unit owners yard that encroaches on the next-door neighbors patio and roof. We paid $6,000 to lawyers who were not experts in HOA law, as O'Flaherty Law advertised.The result was that *********************** sent a demand letter to our neighbors counsel that asks for the tree to be trimmed, our car damage to be paid, and includes a nonsensical paragraph that even Doci stated, to us, she even didnt understand.Why would a professional send a letter that the writer did not understand? This practice shows a lack of diligence, competence, and a lack of respect for us, the paying clients.This embarrassing demand letter was written while we were attending one of our fathers burial in *******, following our father's 13 months in hospice, during the week of April *****, 2023.
My uncle was ill, then in hospice, and died on June 14, 2023. We were further impaired cognitively by withstanding 12 months of harassing emails from neighbors we don't even know, and by ************ handling of our case.Yet, the texts show Attorney **** was emailing us to refill our retainer. We were prompt payers.
We believe ********** misuse of us was not only unfortunate but did not meet the standards of ABA professional conduct. (See ABA Model Rule of Professional Conduct ****).Finally, we were abandoned by the O'Flaherty lawyers, without being given a referral to a lawyer who could competently handle our case.
O'Flaherty lawyers did not respond to our July 26 email (attached) or our October 2023 inquiry.

We request the $6,000 we paid this firm be refunded immediately.
This is our second response to OFlaherty Law Groups responses to our original complaint to the BBB.
This OFlaherty response contains the same pattern of communication we experienced during our four months as OFlahertys clients: it repeats factual errors seen in the previous responses, and veers off into a rote and off-topic comment about relying on legal advice on their website; it drops the factually incorrect statements OFlaherty claimed in its previous response; and it again ignores our main complaint that OFlaherty lawyers didnt know applicable *** law as to who should trim a tree that overhangs a neighbors yard and the ***s roof (a common element).
We cited OFlahertys website advertising because we believe OFlaherty lawyers did not deliver to us anything close to the firm advertised on its webpages: client-focused service at a cost-effective rate, using every resource at our disposal to ensure fair,equitable treatment and fight for your rights against discrimination,illegality, or a breach of fiduciary duty, nor what is stated in the ********************** and American Bar professional standards of conduct.
DOES OFLAHERTY LAWYERS WORK ON OUR CASE SUPPORT THEIR WEBSITE ADVERTISING CLAIMS OF EXPERTISE IN *** LAW?
OFlahertys 22-plus webpages (see below) that repeat nearly word for word OFlahertys claim that its lawyers have expertise in *** law, with the major change being the name of the city,suburb, county, state and of the ******* Park, ******* neighborhood.

Our point is that we believe OFlahertys SEO ranking is boosted by this type of blast advertising. This means the OFlaherty Laws advertisements rise to the top of the search results list because of the repetition of words commonly used by prospective clients seeking legal counsel.

We were told we could not be transferred to Mr. *********************** that his number wasnt public, and that he could not be reached by email.
The OFlaherty Law employee who answered the above telephone number told us email sent to the email listed on each of its webpage, *********************************,is delivered to EVERY OFlaherty lawyers email box. If true, we would be broadcasting our personal information to all OFlaherty lawyers which we believe would compromise our right to attorney-client privilege.
We cannot even be heard in a professionally responsible manner by OFlaherty Law Group.

WHY DID WE RECEIVE SUCH SUBPAR SERVICE IN GATHERING EVIDENCE, CONCEPTUAZING AND MAKING A PLAN OF ACTION FOR OUR CASE?
We believe OFlahertys practice of communicating with us almost solely through 31 separate 8 by 11 pages of texts, led to misunderstandings and the obvious lack of a clear timeline of events.
In hindsight, it would seem obvious that OFlaherty lawyers would ask us to gather all evidence (photos,emails, etc.) from our 10 months of requests to our *** board and neighbor, and to create a timeline of the events.
As we stated in our previous responses, OFlaherty lawyers overwhelmingly worked our case in 0.10/hour (6 minutes) or 0.20/hours (12 minutes) spurts.
No wonder they could not follow or conceptualize our case.
Between Feb 27 and July 26, 2023, the time of our engagement with OFlaherty lawyers, we had two immediate senior family members die, after having spent time in hospice. In retrospect, it seems case work should be halted when a client is too emotionally compromised to think rationally. But we had never retained a lawyer except for estate matters, and we didnt have a sense of the statute of limitations or legal options.
WHY DIDNT OFLAHERTY LAWYERS KNOW THE APPLICABLE LAW OR RESEARCH IT BEFORE WRITING A DEMAND LETTER?
In the end, our assigned OFlaherty lawyers did not know ** law as to who (tree owner, neighbor whose property is negatively affected, or ***) is responsible for trimming a tree.
Neither did the senior partner overseeing our case, *****************************.
Whether there was group think, a lack of interest, an inability by overconfident lawyers to consider they might have to research the ** law, or their inability to grasp what was needed in our case due to working it in 6-minutes or 12-minutes segments,something happened that we believe led to OFlaherty lawyers not meeting the minimum professional standards set out in the ** Supreme Courts Professional Standards of Conduct and the American Bar Associations Model Rule of Professional Conduct.

Rule **** Diminished Capacity - we are pretty clear that O'Flaherty Law recognized that our texts, which again stretched across 31 letter-sized pages,were not clear and show Doci's recognition of two deaths in our family, on March 11 and June 14, 2023. Yet, O'Flaherty lawyers kept billing and sending us requests to refill our retainers.
Finally, OFlaherty has not dropped from its BBB responses the inaccurate claim that we didn't reach out in time to request discussion of our billed fees but continues to repeat the following inaccurate statement in both of their responses.(Clients, sic)s matter was wide ranging and inconsistent. It was also a bit of a moving target, as she informed us that the status of the case was one thing and when asked to demonstrate the same, was unable to. She also spent multiple correspondences and calls requesting and receiving advise on matters we advised her not to pursue.
The statement above just isnt true.
Since OFlaherty lawyers have now responded twice to our BBB complaint with this statement, we would like OFlaherty to prove this statement via evidence from our 31 pages of texts with them. If there is no evidence supporting this statement, quit repeating it.
We do not want to again hear the attorney-client privilege excuse: While I can confirm she was a client and did receive the services she is indicating below, I cannot go into detail due to the nature of attorney client privilege.

I hired this firm to represent me in a case. Multiple facts and letters between me and the other party and their attorney were provided. The attorney wrote a poorly written letter. I approved this based on thinking they knew what they were doing and that maybe this was enough as they took a long time to do this and I was anxious to get this out as they were aware but waited to get it to me late. This situation has caused me great stress and financial loss already. Afterwards a respond from the other attorney was given. Based on the response the first letter was clearly lacking however I decided to work them and instructed them to write another letter. They said it would be sent out the following week and required an additional retainer. On Friday of the following week I contacted them through their portal with no response in the portal on the letter that should have been sent. I waited till 1pm for a response the following Monday before I asked for my retainer back. I think they are really trying to stretch things and additionally taking on to much work that their firm can handle. They clearly also don't seem to know this law very well. The attorney thinks it is an internal issue that job was not provided in the agreed time. Unfortunately attorney's have a lot more leeway for abuse compared to most professions. I am being further harmed and my problem is continuing now and I have to start all over because of these people who wasted my time and money.Business Response

I am rejecting this response because:This has not been reasonably resolved as a complete lack of professional services was provided in my opinion.
Furthermore they disadvantaged my position. The first letter failed to included pertinent information which was given to the attorney. After receiving the response from the other attorney this was very clear to me. However I decided to proceed with them and given more direction for second letter to avoid this being dragged out and looking for a new attorney.
*************** replied a letter would be sent out by the end of the following week. The following Friday early afternoon I had still not received a copy of the letter and sent a message as timely response was needed. No one responded to this. Monday afternoon I still did not receive a response at which point I terminated *************** as the continued unprofessional care in the matter could not go on.
I requested my money back and was not given it. *************** tried to charge me for looking at a message regarding the second letter and not even giving me a response. Their billing practices are very suspected. I received a partial refund. I feel very abused here. *************** is very arrogant and thinks its an internal error that a timely respond. I guess the real answer would get him in trouble though so has to hide behind this. In my opinion this firm lacks any level of professionalism. Based on my experience and other online reviews this does not seem like an isolated incident. I strongly caution working with them. I hired ********************* of this law firm on 8/11/22 to handle a resignation of trustee and appointment of a new trustee for my parents trust. I gave him a $2000 retainer, and was told that this would be enough to cover the matter. **************** apparently was to busy to handle the matter and assigned it to another attorney at the beginning of October. I became concerned that it appeared that there was no progress on my case at the beginning of November, yet my retainer had shrunk to $1200. I finally spoke to **************** after numerous calls to the firm. He assured me that the $1200 left of the retainer would be enough to resolve the matter. He also told me that the matter should be resolved by Thanksgiving. After conversing with the attorney assigned to the case, she said she would do her best to resolve the matter by Thanksgiving, but said it would probably be shortly thereafter. Towards the end of December, I started receiving bills, because the retainer had been depleted. Currently, the retainer is over by $900, with no end in sight. I tried contacting **************** numerous times, and he ignored my requests to speak with him over the phone, or respond to my emails. I contacted the firm on 1/26/23 and left a message with the person who answered the phone, demanding that I be provided with a concrete date and total of the bill due by the close of business on 1/27/23....my demand went ignored. I then called the firm again on 1/27/23 and demanded to speak to someone in charge. I was told no, then hung up on. I called back no less than 50 times and was hung up on every time. Apparently they have caller ID. I also must mention that over the past two weeks, I have been asking to speak to the owner, ******************************* and requesting his email address. I have also been told no on this as well. I then wrote an email on 1/27/23, advising ********************* that the firms services are no longer needed. I am rejecting this response because: The business did not complete the task they were hired to do. I was also being double billed. The attorneys refused to speak to me or update me on progress. They also never showed any proof that any work was done. They only sent me bills. This matter should have been resolved by the very latest, October 31st, I hired them August 11th. The attorney I hired dropped the ball, and then assigned it to another attorney the first week of October. I was then told the first week of November, that their was enough money($1200) left on the retainer to resolve the matter, and that it would be resolved by Thanksgiving. While I (the primary attorney handling ****************************** case) would revel in the opportunity to formally dissuade him of those misconceptions, I am bound by the attorney-client privilege and cannot discuss details of his matter.
To respond to the allegations levied in the context I am allowed to. ************************** was never provided a flat-rate or set cost on his matter. He originally hired my office to review the Trust documents and advise as to what his options were in replacing the Trustee. That was accomplished with considerable funds left over. He then requested that we endeavor to effectuate that transfer to a new trustee.
We began that process.Unfortunately, other parties that were concerned in this matter were difficult to reach and unresponsive. That caused the matter to take longer than anticipated. These delays were communicated to him on several occasions as well as the reasoning for the delays.
************************** then defaulted on the terms of our arrangements. Which prevented my office from continuing in representing him moving forward. He did call the office repeatedly and was abusive towards the staff members in every instance. It became clear that any communication with ************************** was going to lead to further negative interactions. I am rejecting this response because: Mr. ******* response is inaccurate. I originally spoke to him on 8/11/22. At that time he told me he believed hat the $2000 I was giving him as a retainer, would get the matter resolved. He never told me that this was just to advise me. That's ludicrous! I would never agreed to paying $2000 to be advised on a simple matter such as this. I've spoken with 3 other attorneys since then, whom have quoted me at less than $1500 to prepare the paperwork I need. Apparently, **************** couldn't be bothered with my case, because until I called about the progress at the beginning of October,nothing had been done on my case, so **************** finally assigned the case to another attorney. I called again at the beginning of November and spoke with **************** and he told me that the matter would be resolved by Thanksgiving and that the $1200 left on the retainer would cover the matter. Fast forward to January, I started calling and sending emails to find out what was going on with my case, as I started receiving bills that totalled much more than my retainer. I was ignored. As a result, I called the office and yes I did yell at his staff, because they refused to let me speak with Mr ********************** or provide me with his email. I made a final demand that the office provide me with a final date of completion of the matter and what the final cost would be. Once again, I was ignored. As a result, I sent an email saying that the firm's services were no longer needed. Attorney ****** dropped the ball on this one. I still want a refund, as the firm didn't provide any proof that any work was done. If there was any work done, I was not provided with any documents to prove that they actually did anything. On their billing, most of what I was billed for, was reviewing the file. This is unacceptable!
