      Plowing/Salting Service. They are taking advantage of the elderly and my elderly neighbor uses them and they are doing the same thing to him. My daughter had to install video cameras at my house, to show they ARE NOT saltIng, but we are sure billed for it! Then I gets a huge bill for all this salting and it is 37 -45 outside for days/weeks and I was charged for salting. After reviewing of all the weather and the weather as shown on the camera I was over charged for 6 services and I did not receive salting service nor was salting even needed on the days i was build for. Every time we call or email there is no response! And they delay even trying to rectify their wrong doing and continue to demand payment and threaten us they will contact creditors if we don't pay their bill. And they refuse to let me out of their contract trying to negotiate a larger pay for the season price.

      Put a downpayment on a landscaping project. Ware landscaping was unable to give us a time for install (3 months after check was written), was unable to itemize a bill and had fraudulent charges added, did not show up prepared for scheduled appointments. Decided to go with a different company prior to any work being done because of incompetence and money ($8000) was not refunded. ***** me money and refuses to give a refund.

      Dear BBB, thank you for the opportunity to respond to this complaint.

       

      First, and foremost, please be aware that we have NO contract with the individual that submitted this complaint.  In the spirit of transparency, we do, however, have contracts with his girlfriend, *****************************.  

       

      Please see talking points below:

       

      1)  ***************************** signed not one, but TWO, contracts on 2 different occasions.  Both of these contracts were fully executed and both contracts contain our terms and conditions which are disclosed and require a send approval by initialing.  Please note that both fully executed contracts are attached as well as the full chain-of-custody log proving their validity.

       2) Please see the attachment titled ***************************** Email 2 for a detailed accounting of the timeline and explanation of the chain of events.

      3) Further, the attached message, taken by our receptionist, depicts a telephone call, from ******** some days later, apologizing for her boyfriend's abhorrent, combative behavior during telephone discussion while trying to find a remedy or compromise for this situation.  Not only was this individual rude and out of line, he was yelling profanities, threats, and ultimately hung up on us.

      4) ********, our client, was fully aware of our cancellation policy as it was discussed prior to her requesting an add-on and signing the second contract.

      5) To date, we have already invested a significant amount of labor, administrative time, and materials purchased for the completion of his project.

       

      It is unfortunate that this customer chose to enter into two separate agreements without the consent of her partner as this obviously created discord between them.  This is a domestic dispute between **************** and ************ and does not involve Ware Landscaping.

       

      Ware Landscaping has continued to perform fully within the terms of the two agreements rendering this complaint as factually untrue and deceiving.  To reiterate, the attached email clearly demonstrates the context of our arrangement with this customer.

      Thank you for reaching out again.  In response to this customer's complaint:

       

      1) We have never disputed complainant paid the invoice.  This does not change the terms and conditions agreed to in either of the fully executed contracts.

       

      2) All of our responses have been fully substantiated and fully verified and validated by the documentation that was provided under our original response.  That being said, we have not received a single piece of documentation or evidence from the complainant that proves otherwise which further validates the accuracy of our position.

       

      We would like to reiterative that this customer signed not one, but two, entirely different contracts on entirely different dates where the very same terms and conditions were provided as part of our standard contract.  

       

      We have offered, on more than once occasion, to refund a portion of the down payment in accordance with those terms and conditions.

The deposit is worth 50% of the total charge for this project.- Whether or not the business has tried to resolve the problem No. The business has not reached out for any further update on when they'll start the project.- Account/order/tracking number EST3423087 - Additional information The owner of the business was out of touch and did not respond to text/phone calls. The business owner shall provide the date on when his crew will start working on this project. Otherwise I'd like to request full refund if this business does NOT have capacity to proceed with the project this year.Thanks.
