Empire today installed Berber carpet in my home in July 2022. Two days after they completed the installation of the Berber carpet we had water seepage in our basement. Immediately contacted Empire today to tell them that we needed them to simply remove the carpet from the area where we had the leak in order to allow us the opportunity to make repairs. Empire today stated that they could do this and the cost for them to pick up the carpet and to retack the carpet would be $150 which we paid in July. The carpet was picked up the work proceeded we had a separate contractor come back and make repairs to the walls and the floor and when we reached back out to Empire today to arrange to have our carpet retacked we were told that the carpet would have to be replaced and then it would cost $325. Please keep in mind we never received a visit from Empire and the carpet was never inspected byEmpire today nothing was wrong with the carpet it was somehow decided within customer Service that the carpet needed to be replaced after fighting them for two days on the replacement of the carpet they finally conceded that they could re-tack the carpet for $175 for two days we pushed back on this requirement stating that the original quote was 150 and that was to re-tack the carpet after it was picked up. Empire today came back and casually offered that they could re-tack the carpet for $100 and they would void our warranty on the carpet. It took us over a week to discuss all this and we were upset to not only have to pay again to have carpet reinstalled but also to void the warranty.,after we had worked so very hard to maintain the integrity of the carpet . I would like my warranty for the carpet reinstated and I would like a refund of the money that was paid to have the carpet rolled back because the carpet was never really talked as was our original agreement. I want no contact with ************************* in customer service but she should be reprimanded for her poor management.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me. I still want it noted for the record that I find Empire Todays customer service model deeply flawed and it it werent for the actions of *****************************, I feel this could have been managed better. Empire today customer service is unhelpful at best and all agents need to do a better job of coordinating communications with local offices noting customer accounts.

On February 3rd, 2022 an order was placed to replace flooring at our existing home, continuing work that the Empire Today crew had attempted but failed at installing correctly in September of 2021. The new crew tore out all the flooring, leveled multiple rooms that had different heights into one uniform height and installed completely new product on order number PRJ001976845. This was completed on approximately February 26, 2022. The first day, several boards were found that were installed broken. 4 closet doors were found to have been taken off their hinges and reinstalled incorrectly, unable to function. Quarter-round near the fire place was installed that was peeling. 2 door stops were removed and not replaced. One hole was found in the dry wall. In two rooms, the wrong size corner trim was used (4" instead of 8" tall). One bullnose stair piece was chipped. One transition to the garage wasn't properly installed. Approximately 75 boards were misprinted and are blurry. After talking to Empire about the problem, emails, photos and phone calls were sent to the individuals requested. The master inspector, ****, came out and inspected our claim and agreed with all of our findings. On August 12, 2022 a crew was sent out to repair/fix everything. They had insufficient replacement planks, the wrong trim, and zero idea of what to do. They left without attempting any repairs. After speaking with ********************* **********************), Empire claimed the fix was more complex than expected and exceeded their prices. We provided the above proof again and he said it would be fixed within 2 weeks. On August 24, 2022 we were notified that the earliest we would get a call back would be August 31.We have yet to receive any calls from any individual that promised them - we've had to reach out to them every time. When pressed, they claim they "want to make it right" but fail to take any action to do so. We have paid thousands and cannot use our home. It has been nearly a year.

Empire flooring came in to give a quote very misleading with pricing and advertising 50 dollars a room only applied to 4 items they carry even if advertising makes no notation. Went with floor partially installed not enough product to finish was told they would come back on Monday now 5 days later from start my house is torn apart and no one has shown. Called customer service last three days got complete run around and even a fake extension to another department. Cats have ruined the room i keep putting them in everyday they are supposed to show. Beyond crazy how disappointing this is.

We had flooring put in about a month ago. When the sales rep was here, we specifically told him multiple times we would tip up and dispose of our old flooring but he still charged us for it. In addition he added the warranty for our carpet without telling us it was an additional charge and never offered a warranty for the *** flooring. I noticed we were charged for the old flooring removal and called to have the fee removed prior to installation- U was given a reference number and told someone would call me. The day of my carpet install- still no call. So called customer service again- given a different reference number as the 1st was closed without anyone calling me- and told again someone would call me in 1-2 days. Called back and told someone would call me. Now several weeks later I called again and was told they would have to give me a new reference number and someone would call me back. When I asked to talk to a manager I was told they were unavailable and they would contact me. They have horrible customer service, shady sales associate and do not care about you once they have your money!!!

I scheduled a consultation with ************** from Empire Today because I was interested in having new flooring installed. Mr. ***** assured me that the material I selected was life-proof, which was important to me because I have children and dogs. I had the flooring installed and after awhile I noticed that the flooring on the steps was becoming discolored and had started peeling. I contacted Mr. ***** and he directed me to the warranty department. When I called the warranty department, they told me that it was a manufacturing defect and that I needed to call the company directly. I called ***************** and was informed by them that I needed to go the Empire and that Empire would send the necessary paperwork to them directly. I went back to Empire and after several months, they finally sent someone to access my flooring. The person told me that they had never seen anything like this before and that it had to be defective. He took pictures of the issues and said that he had to go back and write up a report to send to ***************** and that I would hear back from Empire once all of that was done. I never heard back from Empire to I called Mr. ***** and he directed me to ***********************. **************** then passed me to ***********************, who asked me to send him pictures. I did and then I received a call from his assistant in which she left me a voicemail stating that they would replace my flooring, but that I would have to pay for it myself. I have tried several times to call and email ****************** asking why I would be responsible for the replacement cost but is no longer responding to my phone calls or emails. This whole situation has been going on for almost 2 years with no resolution. I feel that Empire Today did not honor their warranty and used falsehoods in order to sell me inferior flooring.

Over a year ago I opened a case for a couple of warped/lifted boards that were within the warranty for repair. Within this time, Empire scheduled and no showed for repairs, rescheduled and never contacted me about the appointments, cancelled and rescheduled countless times. They keep saying the cancels are due to no inventory. After a year of that they offer to replace my floor with new product via email correspondence with no mention of a fee. This was not at my request but a resolution they offered. They waste more of my time by scheduling the appointment to pick new flooring, arrive ************************************************** that the floor Im picking is from the same line I had before and shouldnt be an up-charge. I hear nothing for days after and contact ***** again. She responds via phone call stating the upcharge for new flooring would be >$3000. I inform her that they offered to replace my floor and that I will not be paying for new flooring. On Aug 19th ************************* sends another email stating they are searching AGAIN for the original floor inventory at other stores and took back the offer to replace my floor. Since then there has been no resolution. They have used these stalling tactics for too long and have not honored the warranty for my floor. Please help me get a final resolution. Email offering to replace floor:From: ************************* Sent: Thursday, July 28, 2022 8:03 AM To: ************************* <**********************>Subject: RE: ************ I spoke with my Manager and we are just going to have you do a reselect on the flooring. I purchased flooring from Empire on 1/4/21 in my new home for $12.029 downstairs vinyl plank. I was promised quality flooring and satisfaction. Less than a year the vinyl flooring began lifting and separating throughout the downstairs living , dining and kitchen areas. I reached out to empire with my concern via email and received an email from Kora Amsterdam.asking for photos. I sent the photos and didnt hear anything for a while. She finally responded offering a repair as a solution. I didnt believe it was a repair job by the looks of the flooring as it was happening more and more throughout. She sent a repair guy who said he couldnt repair it would need reinstalling. I kept emailing she seemed to become frustrated and pawned me off to *******************. who sent an inspector who took photos and agreed it was more widespread then they understood. *** emailed it was now in the manufactures hands and would be in contact with the mil to reach a resolution. Then another email months later that it would be repaired. Sends yet another repair guy who says he could not repair due to the widespread issue and it would need a complete reinstallation. Took more pictures and said someone would contact. Didnt hear back so I emailed again and *** again says shell send someone else to do the repair. No care or concern for the obvious defective flooring. They show no intent to resolve and are only offering a patch up job that not even the installers want to touch knowing thats not the answer. Looking at other customer reviews seems like were not the only ones experiencing the issues with this flooring. We are requesting for the flooring to be replaced. We deserve to enjoy what we paid for. Empire should fix product they sell that is not the quality they claim to stand behind and promise to provide customer satisfaction and quality ********************.

Date of transaction 12 July 2022, Amount paid: 17, 247. 69, ID number ***********, Empire was committed to provide quality vinyl flooring and according to their website description, the product we purchased was supposed to be scratch free, stain free and easy to clean. It has a warranty of 25 years. we purchased insurance on the floor and the company offered manufactures warranty.EMPIRE IS deceiving us regarding the quality of products offered: We purchased a so-called Luxury Vinyl floor meadow, which compared to other companies is nothing but poor quality. that my 7 year old can brake it. Empire installed the floor on 7/14/2022 but we noticed marks on the floor due to foot traffic. we notified the company and they reluctantly agreed to replace the floor. they replaced the floor on 8/12 but we had the same issues. marks on the floor as a result of foot traffic. Empires sales rep ******* is utterly violating our rights as customers, after I told him about what was going on with the floor, he said that Empire was not going to replace the floors because the floors were already replaced. He suggested that we could fix the issue by "not stepping on the floor" and that the reason we saw the marks on the floor is "because you have too many windows in the house." Every time I ask him to allow me to speak with a supervisor his answer is "they are just going to tell you the same thing that I am telling you, that there is nothing wrong with the floor" and that I am telling you what they told me to tell you. It has been a month and we still have not talked to a supervisor. He also wont let us use the insurance we had on the floor because we already replaced it even though it states that they can reimburse us if we dont receive the quality product, they said they are offering us. Empire is not honoring its commitment to its customers or reimbursed if the product they offer is short of expectations. Empired said that they are not using contactors when they are.

I am rejecting this response because:

Thank you so much for taking the time to contact EmpireToday on our behalf, and I said on our behalf because the stress I am under because of EmpireToday's terrible customer service and deceiving practices has taken a toll on my entire family.
We have shown you more than enough evidence to prove that the floorboards installed are anything but what EmpireToday claims to be. We are reporting that the marks left behind are not easily removed and sometimes cannot be removed at all. EmpireToday claims that the product they sold to us is a product that is stain-free and that if any, they will be easily removed. Our floor was installed in the middle of August. So far and from the pictures we have provided, this floor looks as if it has been there for years instead of a few days.
I dont appreciate a company like Empire responding with effortless, disinterested 5 sentences. To a complaint that has supporting evidence and their approach to this matter is distasteful.
In response to their lack of consideration from which they claim:
Visible shoe (foot) prints on the flooring is from site related activities and is not considered a defect in the flooring.
I dont understand why their luxury products easily retain prints.
In the Empire website: https://www.empiretoday.com/vinyl/vinyl-plank-flooring-high-ridge-creek.They state: Dont let the worry of spills, scratches, and scuffs scare you from getting a luxurious wood look in your home.
The prints wipe clean during normal cleaning of the floor and do not affect the finish of the floor.
On the same website, deceit continues with guarantees. In the Features section the product has a Urethane Finish which eliminates the need for waxing, buffing, or polishing. I have cleaned the floors as Empire has recommended being appropriate for this product. Its shiny finish is gone. The floor looks like its been there for years.
The customer warranty claim has been denied.
Without a proper explanation from the company, just a straight denial, we also have the empire service plan protection and we have been denied using that as well. The Warranty claim states that if we are satisfied and that the product is not what they say it is, we will be reimbursed.
Its not the first time I have been denied. I have been denied the right to speak to a supervisor. In numerous attempts as I have begged to speak to the supervisor, I have been I denied this customer-given right!
*******, a customer service rep, from the Austin ************ want me to speak to a supervisor, his explanation was the supervisor would repeat the same words he rudely had explained. His excuses of the marks and scuffs have evolved from my AC producing heavy partials that have settled on the plank. To a low-brow excuse of not walking on the floor with shoes. To add insult to injury, he took some of the plank of the same product and had a science project. He said that he and fellow co-workers stepped

on the planks, and he said they didnt see any marks until he took the planks to the light. The result of his experiment was that the marks and scuffs are visible because I have too many windows in my home that reflect light. I didnt have any problems with marks and scuffs with the planks I had before.
For a project of **** sqft with a Luxury Vinyl of an unknown price for sqft, according to the contract its only 75% off to include the Empire Service Plan the total price tag of $17,247.69. For that price that I expect more professionalism from Empire. Im not getting what Im buying for. My home is open for any moral, serious professional, who works for Empire and not contracted out to come look at the product they sell to customers.

I dont know what to do, it feels like I am fighting a giant. The evidence is there, but just because EmpireToday is saying no, no-one is really looking at the evidence we have provided and we are ignored as if we were lying. As I stated before, my husband and I are ready to lay our life down for this country, our freedoms are not trampled, but our rights are easily trampled down without regard.

      Sincerely,

And then what? Are they going to fix this issue? Or are they going to continue going back and forth?

So far, no one from EmpireToday has taken the time to come to our home to look at the damaged floor.

I dont know what to do. The evidence is there, but just because EmpireToday is saying so, we are not allowed to use the flooring warranty, or the empire protection plan.

the floor is damaged, the stains are there and can't be removed. The floor lost its luster, and we are fighting a big company that can crush us at any time if no-one is willing to help... Please help us...

Flooring install. Irregularly cut flooring. Gaps. Scratches. Glue on flooring that wont come off. Floored over my heating vent. Caused significant damage to the living room ceiling (underneath the area they were working) through pounding. So hard that the bolts connecting joists came through the ceiling. They claim it was preexisting. They argued about repairs needed. Offered a $75 inconvenience check that wont even begin to address damages. I do plan on taking this to court.
