    During the removal & replacement of our roof in July of 2024 our air conditioner was broken by this contractor when their worker(s) left a sheet of plywood covering the outside unit. I removed the plywood myself on Friday. That weekend is when the unit stopped working and after reviewing our cameras it appears the plywood had been left on for multiple days. I notified **** at Messing Monday morning that the unit had stopped working and I was in the process of getting new equipment. Later that day he made a site visit and said Messing would make us whole if we send him the bill for the expenses incurred. The new condenser unit requires a new coil be installed inside the furnace otherwise the AC warranty would be voided. Replacing both the air conditioner and the furnace was the logical choice. After completion of both the installation of the new unit and the roof we had conversations about the final bill and shared our costs for the replacement of the air conditioner and furnace. We have paid Messing $500 April 6 2024 and $20,000.00 September 10 2024 while we mutually agreed to finalize the last payment in the coming weeks. In the last site visit, **** took possession of all of our receipts. Messing last offered (via email) $3850 short of what would make us whole.
    Also worth noting, at one point a worker was standing on the shoulders of another worker for an estimated 10 mins in order to apply shingles on a peak area of the roof. Earlier that week, the crew was working under a tarp to cover a large exposed area while rain and lighting were active. Also noticed their life line was secured to a aluminum vent stack out the top of our roof. Multiple crew not using harnesses. (Photos as evidence). None of which are up to OSHA standards which is a violation of their advertisement per their contract. Had we known Messing would hire a sub-Contractor & send a crew w/only 1 individual out of 5-8 worker's able to speak minimal English, we would not have hired them.

    We acknowledge damaging the condensing unit or some part of the HVAC system which stopped air conditioning from working. The homeowner requested to repair it himself. We do not know what was damaged as the homeowner had removed the condensing unit prior to us evaluating the damage. We know that the condensing unit and A-coil can be replaced for around $6,000 by a licensed HVAC contractor. The homeowner opted to not only replace the A-coil and condensing unit, he replaced the entire furnace which was in working order. Mr. ******** out of pocket expense was less than $5,000. I offered well above $6,000 and have reached out numerous times through text and e-mails and have not received a response. Not only is he not declining my offers, he is not responding to me. Before making multiple reasonable offers, I have asked him what an acceptable amount discount his invoice and he will not tell us what he wants. The balance due on his contract before applying discount for damage to HVAC is $16,853.80. Due to his refusal to communicate we have forwarded this to our attorney and have begun the lien and legal process. We would love ***** to tell us what he wants in writing.

    I would like to revise my statement about Mr. ******** costs. He verbally told us he paid a friend $1,000 cash to help him install the HVAC equipment. He submitted receipts to us, including an entire new furnace and accessories (attached) totaling $6,780.99. So his total out of pocket costs would be $7,780.99. I am also attaching a quote from ****** Heating and Cooling, a union HVAC shop, that was quoted to me to install a similar A/C condensing unit and A-coil. I offered him $8,000 in an e-mail dated 10/2/2024 and received no response.

    Date of distribution of transaction 5/11/2022. Dates of install around July 10th
    After date of install it was noticed that the trim fascia was missing and they supposedly came and fixed it and the broken siding. when the gutters needed replaced due to damages caused by the roofers, pictures are available of this, the gutter installers asked who put the roof on because the roofers used the tin that was existing to wrap it to look like they put these boards up. After the winter, animals started getting in to my home and the areas behind the gutters began to deteriorate. Messing came out to assess and repair the issue only to call later and blame the gutter installers and say I owe them $3,000 for these repairs. Messing employees were out to our home a number of times to repair damages or clean up their debris that left nails all over our yard for days, so it is difficult to pinpoint an exact day of damages other than the original damage created upon installation. The amount being disputed is the $3,000 for the damages they caused to our home. We have photos of the problem areas after install.

    Original contract $10,500 they showed up with material 9-5-23 job done 9-6-23. I write final check $6250 (extra $700 to gutter guard)

    Then got letter 10-26-23 want $5500 more put lien on my house, through atty's messing took $3463
