    My wife and I bought a second home for family reunions and to rent out when we were not using it. We looked for about a year trying to find the right house. We landed on a home in ******** near Lake ******, it looked amazing. The seller did not disclose anything during the sell and we had a home inspection, but he missed a lot. Since the seller didn't mention the master bedroom floor was sinking and the siding was leaking, and there was wiring issues. Now we are asking the realtor ************************* to make it right he is sticking to his guns saying the seller didn't have to disclose any of that and since the home inspector missed it we are stuck with it. DO NOT BUY FROM THEM.

    The **** Residential Property Condition Disclosure completed by the seller and signed by the buyers states: "The declarations and information contained in this disclosure are not warranties, express or implied of any kind, and are not a substitute for any inspection or warranties the purchaser may wish to obtain." The document further states, to the seller, to "report known conditions affecting the property." To the best of our knowledge, the seller filled out the property disclosure to the best of her ability. The buyer had a home inspection done prior to closing. An agreement was made between the buyer and seller to reduce the purchase price by $15,000 in lieu of doing any of the repairs found during the buyer's home inspection. There was also an agreement that the property was being sold "as-is" and the buyers were responsible for all repairs. The buyers and sellers agreed to these items by way of a supplement to the ******** Uniform Contract of Sale of Real Estate. An additional document called a Notice of Treatments, Repairs, and Replacements that stated, "no repairs to be made," was submitted by the buyer's agent representing the buyers and signed by both the buyers and the seller. The buyer also signed at the closing a document called a "Closing Acknowledgement and Release" which states, "Buyer(s) acknowledges that he has been advised and is fully aware of all rights to inspections as set out in the real estate contract for sale and has inspected the premises of the above-described property and that the buyer accepts the above-described property in its present condition...." The second home inspection the buyer's reference in their complaint was done over a month after closing on the property. We feel Whitetail Properties Real Estate does not any fault in the described event. The buyers in this transaction were represented by an agent from another brokerage, not an agent with Whitetail Properties Real Estate.
