    Failure to timely perform and prosecute the work for replacement of an ingroup swimming pool liner and additional work contracted:A contract was signed on July 23, ***************************************************** ***** business days. Swim Solutions Company was paid a deposit of $9,000 via a personal check to order a pool liner and start the prep work for pool liner installation under invoice #****.After doing the prep work, it was determined that the concrete around the pool needed to be extracted and new rebar was needed to stabilize the pool exterior. An additional deposit of $8970.50 was paid to do this work under invoice #****.Additionally a new water slide was purchased with installation costs included was paid in full under invoice #****.Failure to staff the project with adequate forces to perform the work resulted in a hazardous space in our back yard that was not secured as required by local requlations. The agreement was verbally cancelled on 11/29/22, with a formal contract termination letter submitted on 12/29/22. The response to the termination and refund for the deposits requested was provided on 1/3/23. The Swim Solutions Company owner acknowledged the letter and said that they would review and get back to us. That was the last we heard from Swim Solutions Company. We have since hired a new pool company to replace the liner. They have confirmed with the same liner company we were going to use that the liner measurements were in their system, but no order was ever placed. This was after the deposit of $9000 was provided on 7/22/23 towards this purchase.

    Swim Solutions was hired to repair a crack in my inground swimming pool stairs as water was leaking through the crack. I had to drain a significant amount of water to allow dry access to the step. I paid Swim Solutions $1,000 to repair the steps and $1,000 for water to replace the water that had drained out. In Early September a crack in the repaired step appeared. I contacted Swim Solutions and they sent an employee out who wrote that the step was deteriorated. Since the step was repaired and resurfaced 3 months prior it appears that I have paid $2,000 for inadequate repairs. I have attempted numerous times to contact the owner to try to come to a resolution of either reimbursing me for my monetary loss or to repair the steps properly. My numerous texts and phone messages have been ignored.
