    Rented an apartment for 1 year, Property management company kept our security deposit AND has placed ** in collections for rents beyond our terms.

    Dear BBB,
    Thank you for the opportunity to respond to this complaint. The first thing I have to make clear is that my management contract is with my client, the owner of the property, by law, as a licensed real estate broker, I have to act on the owner's best interest, so what I do and how I enforce leases has to be judged from that prospective. Unfortunately this position has the tendency to put me at odds with my customer, the tenant leasing the ************************* the interests of both client and customer is often time contrary to one another.  

    **** and *********;************** were informed on August 4the that the lease was up for renewal and if they did not wish it to renew they would need to provide notice by September 1st. At that time, they would either need to vacate by the end of September 2022 or convert to a month-to-month lease. They did not inform us of any intent to vacate the property so the lease automatically renewed on Sept 1st, 2022. On September 16th ****  informed us that they would be vacating on September 30th. She was informed that this was improper notice and that the lease had already renewed however it appeared that they were going to vacate anyway. In cases like this, we work diligently to find a replacement tenant in order to mitigate financial losses and to relieve the offending tenant of their responsibility to the lease. In addition to improper notice and breaking the lease **** and ******************************* did not vacate on September 30th **************************** the property for the months of October and November 2022, additionally, they did not pay rent for both those months! By remaining in the property this impeded our ability to find a suitable new tenant as well as the fact that they owe for those months. Once they were finally out, we were able to get the apartment cleaned up and fixed and acquire a new tenant to take over for January 1st 2023, thereby ending the ************* responsibility to the lease. 

    ******************************* has gone out of his way to defame me publicly and personally, he has been very combative throughout his tenancy and now he is claiming that he deserves the security deposit to be refunded. I believe when you consider the facts surrounding this complaint, it is readily apparent that I acted appropriately and honestly and according to the directive required of me by the laws of the State of ********.
