      On December 22 of 2022 I agreed to have services performed by Mister Quik. They offered the services and financing of the **** system and duct replacement to be financed through ALLY lending and issued a quote for the services. It was later discovered that actual services provided by was less than the total amount financed through ALLY. ALLY issued full payment to Mister Quik in the amount of $19,565. Total actual invoice $18,391.10. When I inquired to Mister Quik regarding the difference between the loan and the invoice amount of ******* that was shown sent back to ALLY, **** confirmed they did not receive the monies and *********** advised it was a dealer fee that was returned to ALLY. Nowhere in the quote or the loan agreement was an amount for a dealer fee disclosed. This was over $1,000 that I could have saved or avoided. I am expecting to receive a refund in the amount of ******* from *********** or a credit to ALLY in the amount of ******* to my loan.

      Hello,

      Mister Quik is not legally required to disclose to the customer the fees ********************** paid to Ally. ******* law pertaining to consumer sales (is I.C. 24-5-.5 et seq.) generally protects against deceptive practices that harm consumers. The statute protecting against such deceptive practices (I.C. 24-5-0.5-3) provides an exhaustive list of prohibited deceptive acts. Deceptive acts relevant to the amount a customer is billed would include charging an amount larger than the estimate, knowing the cost would be larger than the estimate provided. However, this requires some harm to the consumer in the form of charging an amount greater than the estimate to the surprise of the consumer. A seller incurring a fee on its end that does not increase the contract price or otherwise cause unexpected harm to the consumer is not deceptive act under ******* consumer law statutes. Moreover, there is nothing in the ******* consumer law statutes that would requires Mister Quik to disclose such a fee where the fee is incurred solely by Mister Quik and does not affect the contract price or cost to the customer that the customer has agreed to.

      As for contract law generally, Mister Quik could not charge the customer a fee that was not included in the contract price and/or provided for in the contract terms. However, that is not what happened here, where the contract price matches the prices listed on the internal invoice, less the fee Mister Quik paid to Ally. Again, Mister Quik did not charge the customer any additional amount and the fee incurred by Mister Quik is separate from the transaction with the customer for services. There is nothing in the contract terms that requires Mister Quik to disclose such a fee.

      The Loan Agreement with Ally executed by the customer provides $19,565.00 will be credited on your behalf to: Indy Connection Electrical Contractors Inc. We will retain a portion of this amount. If the customer is upset that **** retained $1,173.90 of the $19,565.00 that was funded under the Loan Agreement, that appears to be an issue between the customer and Ally. However, ********************** did not pass on the finance fee to the customer and increase the contract price after the contract was signed. Instead, Mister Quik received less than the contract price for the services as a result of paying Allys fee. This is not a violation of ******* consumer sales law, and neither the contract/Loan Agreement nor ******* law requires Mister Quik to disclose this fee.

      Mister Quik sent out an HVAC technician for our annual service. Before this technician came to our house our unit was working. This technician has been out to our house before and seems to find "issues" every time. I found out later that the technician is paid commission on any additional services charged to the customer. ********************** uses this practice to get consumers to try to pay for more services even if they may or may not need them.The recommendation this time from the technician was that my heat exchanger was rusted out and I needed a whole new unit for $30K. When I asked why the heat exchanger that Mister Quik installed in 2018 was not covered under warranty (was told during that install that they had a 5 year parts AND labor warranty) he froze up and told me it was because it was exposed to water. After this interaction, I received a second opinion from more reputable HVAC companies who said if I wanted to replace the unit that it would only cost $10-12K (vs. the $30K quote by Mister Quik) depending on the model I wanted to go with. With my unit still working perfectly fine, I decided to try one more time with Mister Quik, I called back about the heat exchanger warranty and a very nice dispatcher said absolutely it is covered (despite what the snake oil technician said) and should would send someone out. This person was here for over 7 hours and took apart the entire unit, cleaned the exchanger and "got it working again." I woke up the next am to find out that my system was locked out and no longer working. Mister Quik then sent out another person that am, who said that the blower motor was not working properly and it likely happened when the heat exchanger was cleaned out the day before. His recommendation to his manager was that Mister Quik would cover the blower cost at no additional cost to me. The manager called and said that is not the case and that I need to either pay to have the blower fixed or pay them to swap out the unit.

      I recently had them install an "iron shield" into my home. They charged me almost $7,000. Today I had them come out to replace an element on my water heater and they were going to charge me $6,000. After getting a second opinion from another plumber, he was shocked. I called the iron sheild company and they said the price for the filter was ***** dollars. Which means I paid ***** over the recommended price. And instead of just replacing the element, I was told it would be best to replace the entire heater. The second plumber replaced the top element and the heater is working perfectly fine. I feel like my good faith has been taken advantage of.

      Of the total amount paid, the customer paid $800 to have his drain rerouted. After discussing the concerns with the scope of work completed, Mister Quik agreed to refund $800 by check to resolve his concerns. A check has been mailed and the concern has been closed.

      On 10/7/2022, we had an issue with our water heater spraying water. I contacted the original installer who said 1) they couldnt come out to fix it until next week 2) any plumber could help us because the water heater was still under warranty for another year. Because I had used ******* for another plumbing issue in 2020 as well as years prior at our old house, I gave them a call. I told ******* at Mr. Quik what the issue was and that it was a *************************** water heater still under warranty. She said no problem and would send a tech out. The tech got here (he was very nice and very knowledgeable) and looked at the water heater. He said the water heater would need to be replaced. If it is under warranty, I would have to call the original installer or he could show me their options. I asked if its under warranty, why couldnt he replace it? He said that it would have to be handled by the original installer. So while he was still here I called the original installer and they said no that it is a manufacturers warranty and anyone could fix it. I told the Mr. Quik tech this and he said they are not a dealer for *************************** and still charged me for the service call of $89.00. The part that angers me is that ******* knew that it was a *************************** water heater under warranty for another year. So this was a quick way for Mr. Quik to make $89 without having to do anything. Its pretty disappointing and an extremely shady business practice. They preyed on the fact that we were without hot water and was hoping in my desperation, I would forgo the warranty to put one of their water heaters in. When I didnt, I still got charged the $89 with them knowing that they would not be able to do anything about it. I will NEVER use Mr. Quik again because of this and we have used them several times before. They have lost a customer and I will let everyone know of this issue.

      We apologize for any communication concerns. We can replace a water heater under a manufacturer's warranty, however you would still be subject to a charge for the labor as we were not the company who originally installed it and collected for the job. If it was under warranty with your previous provider, they too would warranty the equipment through the manufacturer. That being said, the labor would have been provided through them since they completed the original work and would need to honor their work per the contract. 

      Mister Quik has already refunded the customer their $89 sf since they were dissatisfied with the appointment and situation.

      Mister Quik was scheduled to visit the home September 13, 2022, for the customer's annual furnace maintenance as part of their preventative maintenance contract with us. During the appointment, the service technician made a video analysis of his findings. The video shows debris build up on the blower motor wheel. Due to this discovery, the technician presented the option to remove the wheel to clean it thoroughly, which the customer agreed to. The service technician also found the humidifier was loose and the humidifier pad had deteriorated leaving debris in the system. This prompted the recommendation for the humidifier maintenance and pad replacement, which includes securing the humidifier and cleaning up the debris from the pad deterioration. The customer also agreed to this recommendation.

      Our technicians are trained to bring any findings to the attention of the customer so that they can make an informed decision on how they would like to move forward. Prior to this complaint, the customer had never notified ********************** of any concerns. Mister Quik is willing to refund the $219 charge for the humidifier maintenance to resolve her concerns.

      ture marks in my new white tub that was filled in with black caulk was acceptable and the deep scratches in the bottom that would scratch your back if you lay on it is up to code as well. He was cool with the big gaps between tiling and wall too. Not only did they puncture and scratch up my brand new tub they scrathed up my new toilet. The manager treated me and my girlfriend as though we are children who dont know what we are talking about. Never meeting deadlines he created to solve our problems. He asked me for the quotes i recieved and denied to use the companies because they added "unneeded" things such as a grab bar and shower valve. After 3 failed installs and 3 weeks of your company in my home and 2 service calls for a hole you hid we deserve to be compensated. We both took time off of work and paid close to $29K for a nightmare experience and a trainwrecked bathroom. Our only option now is accept a $7k refund and leave it as is and still owe $20k. They expect us to be happy with that?!?

      Mister Quik responded to the tub installation concerns initially by offering a tiling resolution as stated in the customer's complaint. Additional concerns were voiced after the tiling and finishing work was completed, which is when a manager from Mister Quik met the customer onsite to review the scope of work and to discuss the concerns in person. Mister Quik responded with a suggested resolution of refunding the tub work in full, along with the drywall work around the tub ($7048). The additional $20k mentioned in the complaint that remains, was for several other items completed at the home (water repipe, drain repipe, softener, tankless water heater, etc). There were zero quality or service concerns on these tasks.

      Mister Quik has offered to refund 100% of what the customer has paid for the tub and handyman work. We are unsure of what additional compensation the customer is asking for.
