      I have reviewed the response made by the business in reference to complaint ID ********, and have determined the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. 
       I am writing to formally dispute the reporting of a repossession account listed by Oak Motors, in the amount of $14,993, and to request its deletion under the Fair Credit Reporting Act (FCRA) and applicable Indiana state laws. This vehicle was returned and not paid for due to severe mechanical malfunctions that rendered the vehicle unsafe to drive, consistent with violations under Indiana Code 24-5-13 (Indiana Motor Vehicle Protection Act, also known as Indianas Lemon Law). Specifically: The vehicle experienced dangerous and repeated mechanical failures while still under the dealerships ownership and contractual obligation.
      I provided multiple notices to Oak Motors regarding the unresolved mechanical issues, which were not adequately repaired within a reasonable number of attempts.
      Under Indianas Lemon Law, a seller is required to either replace or repurchase a defective vehicle that impairs the use, value, or safety of the vehicle.
      Indiana Lemon Law (IC 24-5-13-10) allows consumers to revoke acceptance if the vehicle fails to conform to warranty standards and the seller fails to cure the defect.
      Therefore, my non-payment was a direct result of the dealerships failure to provide a roadworthy vehicle, constituting a material breach of contract and a violation of Indiana consumer protection law. The vehicle was returned under lawful grounds, and the alleged debt is not legally valid. In light of this: 
      This account is being falsely reported as a voluntary repossession despite the vehicle being rejected under a Lemon Law breach.I demand immediate deletion of the trade line and any associated derogatory information with all consumer reporting agencies, under 15 U.S.C. 1681s-2(b). I request a full reinvestigation of the debt validity under the Fair Debt Collection Practices Act (FDCPA) and Indiana Lemon Law remedies. If this dispute is not resolved promptly and fairly, I reserve the right to file complaints with the Indiana Attorney General, the ************************************, and to pursue legal claims for damages under 15 U.S.C. 1681n and IC 24-5-13-17.

      The Customer's account was repossessed due to non payment while still owned by the dealership. It is reporting accurately through OAK Motors as: 96 (Repossession) with a balance owed of:$14,993 (Metro2 Credit Reporting file requires rounding to the nearest whole dollar). It is currently reporting accurate delinquency prior to charge off: 10/2024:30 days, 11/24:60 days. The buyer has disputed this account three times in the past two months though Equifax and **********, and the disputes have been answered accordingly.  Therefore, Oak has properly reported this account to the bureaus.

      On 2/14/25, my wife and I purchased a 2017 ***** Silverado LTZ from Oak Motors Indy South location. Less than 2 months later, the check engine and **** lights came on. I took the truck in for service on 4/8/25. When I called for an update on 4/15/25, I was told it hadnt even been looked at and it would be at least another week. Nearly a month later, the truck still isnt fixed. While the transmission is under warranty, I was quoted $308+ for **** ***lacement, plus additional service and warranty costs. I dont have another vehicle and was told I'd be placed on a waitlist for a rental, but it's not likely I'll receive one.On 4/28/25, I was told the truck would be ready by end of day 4/30/25. I called around 4:30 PM that day and was told it wasnt done with no clear explanation or update. Every time Ive called (usually weekly), Ive been told something different by ******* ****** or ****. Im paying $700/month for a truck Ive barely driven, and communication has been nearly nonexistent. *** submitted multiple contact forms and warranty requests online without response, been left without a vehicle for almost a month, spent hundreds of dollars on rides to/from work, and don't have a clear answer on when it this will be completed.When I test-drove the truck, the **** light was on, and the sales *** said it was nothing to worry about. Turns out, all **** sensors need ***laced. I believe Oak Motors knew about these issues before selling the truck. Ive reviewed Indianas Lemon Law and am considering legal action if problems persist. This has been one of the most frustrating experiences Ive ever had. I want to speak with a ** or someone at corporate to address this. The lack of service, communication, and accountability is unacceptable. I have never filed a complaint like this before with any business, but these issues and concerns need to be addressed as soon as possible.

      Customer truck initial complaint was TPMS issue after purchase that then turned into a transmission problem. Customer was updated multiple times and had multiple phone calls with customer after arriving to service.  Customers wife who called multiple times was updated by several service techs and managers prior to 04/15/25. Customer was left voicemails as well even after 04/16/25 and was told couple weeks based off the large amount of vehicle in heavy line ahead of the customer.  Vehicle was brought back into the shop on 04/25/25 to remove the transmission assembly.  The following Monday 03/28/25  the customer's wife called in again and was put on hold in order to get a status update.   The trans was pulled and was at the rebuilder still being rebuilt. Based off the conversation with the tech stating he may have the vehicle completed  in the morning on 4/30/25, customer was told the vehicle might be completed on  4/30/25 if all goes as plan but not guaranteed and we will call them as soon as the vehicle was done and ready for pickup.  Customer wife called in on 4/30/25 and we told her Tech is still working on the vehicle putting the truck back together and was not going to be completed that day (driveshaft transfer case still out of vehicle) . As soon as the phone call ended ****** ***** called in cussing and carrying on using profane language bad mouthing the company cursing out employees and the service manager. Due to his attitude, he was told we would not going to carry on this conversation because of his behavior and we will reach out to them when we have the vehicle completed as the truck was still torn apart.  Tech completed transmission install replacement on 05/01/25 and during multiple test drives the vehicle trans was running hot. Technician pulled vehicle back into shop and found the trans cooler  to have a blockage from the old trans had sent debris into the trans cooler system. Technician was instructed to order the trans cooler. Customer was called and left another voicemail stating issue above and to order another part that would arrive on 5/2/25.  Today 5/2/25 Technician replaced trans cooler and drove the vehicle multiple times and not overheating and fluid is flowing through the cooler correctly and not running hot. Technician also stated upon heavy acceleration the vehicle was having a popping noise. Technician found the vehicle has bad motor mount and was instructed to replace the bad motor mount  to prevent any further complaint from the customer.  Truck should be done today and the technician was informed the truck has to be completed today.

      I am not satisfied with their response because I need my vehicle back! They gave me an option to keep it or return it Because of all of the issues it had Has made me complain. Even though the contract states Return it and get a different one Within 48 hours after purchase! My car broke down before 48 hours, I took it back, ***** said I couldnt return it. He then stated he told me about the issues the car had before I signed for it! He did not tell me this or I wouldnt have chose that car! I have ever right to complain after seeing damages on my car that wasnt there before I brought it through service! All my complaints are justified back to me instead of oak motors Taking responsibility! An example the mold that made me sick and my children, The management claimed it was laundry detergent! I dont use powdered laundry detergent and this smell was there prior to getting the car. I thought it was the dog in the car last. 
      Before they came and took my car in the middle of the night, I gave them my works contact. The day before they took my car in the middle of the night, I told them I had to email my work to get a different letter but they received the contact. I have missed another day at work because they took my car back after I stated I wanted to keep it. My medication and purse is in my car and Ive been sick all day today because of it! They never repo my car either and I told them I could pay them today and they kept saying its because Im complaining!! I was told by representatives at the bank this is why they dont want to put me back into my car because I call a lot and complain. Anyone in my shoes would complain. Also they are lying I never had anyone call on my behalf and I told them that! I want my car back today or I want my down payments, payments Ive already made, and compensation for all the days Ive missed work, including the day the took my car. I make ******* a day. Ive missed 12 days of work including the days in between jobs for these issues: Now Im missing work still because they have my car!!! This is how Im being treated when it was their fault of these issues! I love my car and just wanted them to make it right instead do of justifying their actions. They have put my kids in danger 2 times! The mold and the dry rotted tries in my car and the rental!

My babies and I were out in danger for the 3rd time! They do a walk around each time car is in services the last time they didnt and it was damaged ! At this pointe I couldnt stay calms I did ask to speak to COO. I was told the photos were taken when I dropped my car off without me to sign off on it!! Then they pull up photos online and say they got it that way! They told me i can return the car and I cant be a customer anymore I chose to keep my car! With the car issues, I lost my job. I was in the middle of changing my contract to the new days.!! I sent them my contract and they asked for a different letter with paydays on it! We spoke about it on Wednesday and they didnt give me a time to give it back the following day. The took my car and wont let me have it back or the down payment or payments.

      Customer brought her vehicle in for service.  Service resolved her concern but she was texting and emailing everyone demanding she be switched to a different vehicle or for her vehicle to have some cosmetic issues resolved.  It was explained to the customer our vehicle may have some cosmetic ****** and dings as we can't make them new for sale, but our goal is to provide reliable transportation.  She claims the damage happened at service and it wasn't purchased like that.  We showed her the pictures from the auction's website prior to us buying it and those blemishes are there.


      Then she claims it has mold and made her sick so she lost her job. She was given 2 options, her vehicle was repaired and she could take her vehicle and catch up her payments and move forward.  Or we could move to a strict foreclosure and take the vehicle back in satisfaction of her debt and part ways.  She decided she wanted to keep her vehicle, then that evening she sent our representative a long text again rehashing all the same things demanding a different vehicle.


      She was delinquent so we chose to issue it for repo.  She did state after it was repo'd that it wasn't her that was calling and sending all the texts and emails.  She claims it was her neighbor who previously had a car with us and told the customer she would "get us right".  So she basically provided her personal info for a 3rd party to call in and impersonate her.

       The company hasnt done anything to make it right regarding this matter. Monday April 14th I spoke to the *** about all the issues Ive had. I told him about when I first got the car, the manager at the south location pushed me into it. The coo wasnt understanding or apologetic About all of the issues Ive had. In regards to the manager, not allowing me to test drive any other vehicle, And stated if I wanted a car today, I needed to get it now. The same manager knew I was in there for three days trying to get help getting a vehicle: Each time I arrived at 5 pm and they refused to help me even though they do not close until 7pm! That manager understood my situation and how I needed a vehicle immediately! I explained that to the *** and he would only blame me and stated no one put a gun to my head to sign the car. I told the *** about it breaking down 3 times. The first time was less then 48 hours after getting the car. I told him lady the manager claimed he told me it needed a new battery and needed go **************** I told the coo that and that wasnt true or I wouldnt get a vehicle that had issues since I was in desperate need of one! The *** said I wasnt there. I told the coo about the mold! He said I wasnt there. Coo said I can keep the car or let them buy it back but I would have to get my own ride off their lot. I asked why I couldnt get a different car because i didnt do anything wrong and he said because you have a car thats working. He said the only time I could trade it in for something just like it is within 48 hours. I told him I did try and I was told no to take it through service! I then asked him about the mold and it not being told to me that it had issues before I signed for it.  He said he would speak to those managers and call me back! I drove off the lot deciding to keep my car. The *** never called me back. I sent a message to all the managers through our group chat that they made to communicate to me because of all the issues I had days after signing for it. No one responded. Their bank called me over my new job that I had to get after getting fired from these car issues. I sent them over the contract my work gave me!
      i  am just now making money from this company and havent been paid. They told me Wednesday at 3 pm that they needed a different document with it stating the exact pay dates. I told them okay I have to get it from the CEO to sign it. They didnt wait even 12 hours before coming in the middle of the night taking the car back from me! I made a payment 2 weeks prior and the new payment date was going to be the 22 that we agreed on for the new payment date! 
      they claim they repoed it so they dont have to give me my down payment and 3 payments I paid. I tried to get it out of repo then since thats what they are claiming and they said no I can only get my car if I pay the full price 20k 

      so then how is it repoed?

      I had every right to complain that it still smelled like mold, had mold visible after they cleanse the carpet and for putting me in a rental that had cigarette buds and smell to where I couldnt breathe or my children and it having dry rotted tries from 2018! They also dented my car and scratched it in service. 

       

      I want my car back and they fix the mold smell and then get the dent out and scratches on front of the car.

      I am an innocent victim of oak motors trying to get a car when I have bad credit. I have been treated poorly, blamed and put in danger 2 times with my two babies! This has to end with me before someone else gets hurt

       *********************** did not wait 24 hours to get the document to change my payment dates. After I complained about all the issues in previous messages, they wanted to go separate ways. I spoke to them right away to get my car back but they refused. I spoke to the last week and now they are saying a repo is on my credit but I never got the chance to get it back unless I paid full price because they didnt want me as a A customer! They tried to take payments out of my account 3 times and I sent an email about getting an attorney and they stopped the payments. Now they are putting the car in auction when I could have got it back! The car is being sold on Wednesday! I want my car back immediately or I want to do a law suit. Still havent received my down payment or payments back. I have been scammed by them. I need this addressed today! If I dont get my car back or money back, I want paid for the mold and safety issues for getting sick, loosing job and being put in dangerous situations.

      The day bought after spending 6 hrs getting approved we got 30 mins down the road and it over heated. We barely made it in the driveway. We asked the sales person to add me (his wife) but after choosing the vehicle he said I cannot be added. We have been married 22 years. I have NEVER been told this!! It has been in the shop for over 2 months now without even one day of actually driving it and the finance company is well aware and still to this day our account manager has NEVER returned our 27x phone calls. It needs an engine and still in the shop!!! RUN!!

      I bought a car from ********* in July 2024 and I have had it in the shop at least 10 times I had to get the heater core replaced and since then I have had to put it back in the shop 3 more times since and this last time antifreeze came slushing out of my dash and the antifreeze burned my leg I just want to know my options because this is unacceptable I shouldn't have to keep getting rides to work every week because they don't know how to fix a car and there's no service report from when I first purchased my car because I've already had to change the alternator and battery and heater core then I took it in for the breaks grinding a couple months ago and they are saying i need new breaks not sure how I need new breaks already when they fixed them 2 months ago

      Customer dropped the car off with no appointment. She he told the tech *** that the heater core was leaking on the driver's side and sprayed it on her. Her car was addressed immediately and the heater core was ***laced. ****** never stated that she was burnt by the coolant when dropping off her car. The heater core sits inside a heater box  and when they fail it leaks coolant on the floor of the car. The probability of a heater core spraying into a car directly on someone is almost impossible because it's sitting inside a heater box. Later, she called in and was explained that we could do a ride along and see what is going on with the car. She told the tech *** that the heater core was leaking on the driver's side and sprayed it on her. Her car was addressed immediately and the heater core was ***laced yesterday. ****** never stated that she was burnt by the coolant when dropping off her car. The heater core sits inside a heater box  and when they fail it leaks coolant on the floor of the car. The probability of a heater core spraying into a car directly on someone is almost impossible because it's sitting inside a heater box.  The tech manager intended to talk with this customer after her car was completed. ****** stopped in after 5 pm yesterday as her car was on its final test drive. She was not called yet for pick up as her car was still going through our process.  She took possession of it at that time. She later called in and spoke with the tech manager. She was told that she can come by anytime and tech manager will ride with her for a transmission concern she states is happening.  The tech manager will find out the concern when he rides with her. She thanked him for his help and the call ended.

      Yes I purchased a vehicle a ***** journey on November 2nd of 2024 after 4 days of driving it I noticed the noise in the engine I also noticed the window went and rolled down The back defroster wasn't working, and it was leaking antifreeze *********** at oak motors fix the window that wouldn't go down they said they didn't notice anything about the back defroster they also said they fix the leak then was leaking with the antifreeze and that they didn't hear anything with the noise in the engine so I took it to a different shot The different shop told me that it was still leaking antifreeze and that the engine is knocking I took it back to service you going to to get it looked at December 2nd for 2024 I was told that it was the knockers in the engine I called back January 17th 2025 and was told that I need a new engine and that the new engine will not come in till December 23rd then after that I will still have to wait for them to fix it I talked to a lady and finance and I asked her if she could please help me get in another vehicle but was told that there isn't any rentals I also was told that she couldn't put me in another vehicle and that I would have to pay for a $50 deductible and that my payment for my following month would be put to the back of my car payment last due date which will make will make my signal payment more than the original amount is someone can reach out to me and help me with this problem because I feel like I shouldn't have to pay for a car that I'm not driving I haven't been in this car for 2 months and I've been making payments my number is ************

      Customer had multiple complaints after purchasing a vehicle such as brakes making noise, rear defrost not working, heat on dash not working, Master window switch failure - all of this was within 30 days. Rear defroster is not something we repair as the defroster is part of the rear glass and is not done in recon.  She then brought the vehicle back again on January 2nd for oil leaks and squeaky brakes only. The technician inspected the vehicle and found no active oil leaks and ran a degrease on the engine. Technician checked the brakes and found no issues with the brakes. Customer was then notified the vehicle was ready for pick up.She then kept complaining the engine was noisy and was refusing to pick it up until the vehicle was fixed for free as she was not going to pay for any repairs.  The engine ran and drove fine with no issues and no check engine lights on. The customer was informed the vehicle could still be picked up and driven if needed. She kept complaining about what the other repair shop had told her and was refusing to pick up the vehicle. Vehicle had normal operating drivetrain noise for that vehicle, nothing major or out of the norm considered excessive. 
      The technician pulled the valve covers to inspect the drivetrain for wear on the cams, rockers, lifter, springs. The technician found slight wear on the rockers and no wear on cams or other drivetrain components. The technician  suggested replacing rockers only per concern. Heavy line tech wanted to replace timing additional to just the rockers as they did not have the tool to lock timing in place to do rockers only. Repair estimate was sent to to warranty and engine replacement was done instead. Customer was also notified prior to engine replacement she was given the option to take and drive the vehicle until the engine arrived and she refused to do so. She was also informed of a timeline she may be without the vehicle, and she agreed. She was also informed there would be a deductible on the warranty repair per her advisor. We are happy to proceed to work with the customer to resolve the issues she is flagging.

      I bought a car from them November 6th 2023, starting November 20th of 2023 my car began cutting off every time I slow down or hit the pedal. My car has been in the shop several times since then and here it is a year later my car is still cutting off every time I hit the pedal. ********* sold me a car that does not properly work and has caused me a lot of trouble and money. When I first contacted someone about my car they said there was nothing they can do I had to put it in the shop. This place is a scam!

      After investigation, it was found that the customer has not sought to repair the issues presently causing her concern.  There are only two tickets on this customer. One complaint was squeaky brakes which were just lubricated for the noise issue with ABS traction light was on and left rear wheel hub assembly which was replaced along with the wheel speed sensor to resolve that issue. The other complaint was wobbling while driving and the front lower control arms where replaced.  No help has been sought for her current report.  We have explained to her what payment options are available, and we stand ready to address her current concern if she makes an appointment with our service department.

      After investigation for the no heat concern on the ticket dated Sept 17th, she had multiple issues with the vehicle. One being the blend door was bad and she was given the option to repair.  She declined as she did not want to pay for the part and or labor. She was quoted by the warranty administrator.  We are able to attempt repairs if she is willing to pay.

      Instead of my desired resolution, this company continues to show no regard for their customers, only about taking their money.  Not one time did this company apologize for my convenience, ask me if I needed any assistance in providing a travel/vehicle workaround, instead 'probably the engine will be delivered'.....my position has not changed.  ************ has faulty vehicles.  This is the start of an ongoing problem with all their vehicles that they sell.  I know that I am not the first to file a complaint like this and I will not be the last one to do so.  I am one of many.  My position has not changed.  I do not wish to continue doing business with this company.  I want an mutual release.

      hing about my vehicle. I reminded him that I have only had the vehicle less than 6 months and how unacceptable this was. I told him that I would prefer to put into another vehicle. He told me that he agreed and that he would talk to the ************, and get approval from the Sales Manager. He told me that he would make this an important point to get done that day. I never heard back from him and it's now been a few days. The ************ informed me that they were expecting the engine to delivered on Friday of this week. There has been no other follow up from the Sales Manager or anyone else. All of the vehicles that they sell are NOT serviced or checked for issues beforehand. The common denominator for all their vehicles always wind up being an engine and/or transmission repair which is not fair to the consumers.       Attaching screenshots of recent text messages from the so-called Relationship Manager at ****************  Her repeated disregard of me stating multiple times that I do not want this vehicle due to the extensive engine repair but instead all she/they care about is collecting money from people. I also have the first email exchange from 1/2 where I told her about the car being in the service department.  She also called me while I was at work on 1/7, leaving me a voice mail asking about payment, if I changed jobs and did something happen to the car.  It is common knowledge what is going on with the vehicle and she, Oak Motors and *************** has been knowing about this situation since the vehicle was towed to their ************** on December 23, 2024.   

      Per the screnshot text messages, references to **************** and now respossession is mentioned.  1) The vehicle has still been at their service center location since December so there is nothing to physically repossess.  2) Their so-called auto auction is actually their dealerships of Oak Motors where, after the engine replacement is completed, the vehicle will be listed and resold from Oak Motors

      My position has not changed.  I want an mutual release from this agreement.  I also have access to legal representation and I have no problem of getting a lawyer to represent me in this complaint if need be.

      This complaint should not be resolved.  I received a text message from a third ****** from ******* Finance by the name of  ****** and she has informed me that the ************ has not received the replacement engine as of today, possibly this week and possibly the repair could be done next week.  No final answer because they do not know.  The vehicle is still sitting in their service department with no engine and I have still been without a vehicle all this time.  I am proceeding with obtaining a lawyer and sharing this update with the ********************************

      This is not an updated comment.  It's the same exact comment they shared the first time  I am not seeing anything else by the company.  Am I missing something?.  As of 1/15, the engine was ordered 5 days after it was towed on 12/30/2024 and they are still waiting for parts.  Nothing has been resolved or settled.  I still wish for my original resolution to be granted.

      Attaching an screenshot of a text message that I received from the ****************** on Friday, January 23, 2025, 30 days after the vehicle was towed in their service department.  The engine replaced took 30 days and during this time I had to find my own way to work with no workaround from Oak Motors/*************** only accepted to be asked to make a payment with no transportation.  As I have already stated from the very beginning, I do NOT want the vehicle.  Nor is it fair to me that that engine failed after 5-6 months of driving the vehicle.  I am not the only person that has had complaints again these two companies and I know that I will not be the last.  Complaints are going to continue to come in about them.

      I do not want to continue dealing with Oak Motors and Indiana Finance.  The vehicle is still at their ************** where it's been for an entire month, they can keep the vehicle and resell it - since they have threatened to repossess it.  They already have it.  My position has not and will not change.

      The vehicle has been at the dealership's ************** for an entire month getting the engine replaced.  No other alternative or workaround was offered to me.  All this company cared about was demanding payment for a car that I had less than 6 months, no way of getting to work for 30 days.  They already have the vehicle and fixed or not, I do not want that vehicle. Every vehicle they sell, they do not check beforehand. They sell it 'as is' and then the customer always has to deal with a major repair and be without a vehicle for a period of time.  This is not the way to do business.  Since I have been threatened with repossession and since the vehicle is already at their **************, they can keep it. There is nothing to physically repossess since I have not had the vehicle since December 23 2024.  Any vehicle that they 'repossess' gets put back in their inventory and listed for sale on their website again.
