      On 10/11/22 it was discovered that one of the apartments in the building I live in had a severe cockroach infestation due to neglect of an empty apartment. Many complaints were filed over the last year over the apartment. Suspicious liquids would leak through the floors into the apartment below. I, as well as many other residents, have been facing health issues due to the managements neglect. The health department has been made aware of the situation. Management has not given updates to tenants on how this situation will be handled. I have included pictures of the abandoned apartment.

      This situation was just brought to our attention last week. We had no idea that the tenant had vacated. His lease had not termed. Once we were made aware, the situation was taken care of within 24 hours.

      Cockroach infestation is still an issue throughout the entire building. Company has been rude and dismissive of the severity of the situation when contacted otherwise.

      The apartment has been cleaned out. Pest control has been to the complex three times in the past 10 days. We have cleaners scheduled to clean the common hallway area. All residents have been notified. There is nothing else BK Management is required to do at this time.

      BK Management will not uphold the ************* Law Section 32-31-3-13 - Use of deposits which states:A security deposit may be used only for the following purposes:(1) To reimburse the landlord for actual damages to the rental unit or any ancillary facility that are not the result of ordinary wear and tear.(2) To pay the landlord for:(A) all rent in arrearage under the rental agreement; and (B) rent due for premature termination of the rental agreement by the tenant.(3) To pay for the last payment period of a residential rental agreement if a written agreement between the landlord and the tenant stipulates that the security deposit will serve as the last payment of rent due.(4) To reimburse the landlord for utility or sewer charges paid by the landlord that are:(A) the obligation of the tenant under the rental agreement; and (B) unpaid by the tenant.BK Management refuses to return the security deposit claiming deductions for carpet cleaning and "sparkle clean" services along with blind repair. All of this would be considered normal wear and tear under the state law. We have video evidence of what the apartment looked like upon move in and upon move out. I have read BK's response to other complaint stating they charge for "much more intense cleaning...This includes pulling out all appliances..." We did all of that. They said they had to clean a door, wipe shelves and there was dust on the ** unit. No damage. . . just normal wear and tear. We left the apartment cleaner than it was on move in day. We have asked repeatedly for clarification and have been met with hostility and unprofessionalism. It seems BK is trying to take advantage of college students banking on their lack of resource to fight their unethical practices. My son was the tenant, but I will be helping with the resources so they cannot take advantage of another tenant. A complaint will also be filed with the Attorney General and legal action will be taken if necessary.

      BK Management disagrees with this complaint. We have provided photos and feedback regarding each inquiry received. While I understand that this party does not agree with our definition or explanation, we have definitely provided feedback and continue to do so daily. The lease states that the unit is to be left in move in ready condition and if it is not then there will be fees that are charged in order to get the unit into move in ready condition. We have returned the portion of the lease that remains after the necessary cleaning was completed. By no means are we trying to take advantage of anyone.

      The building is infested with cockroaches. We believe they are not using a professional pest control company (as they will not provide company name) they have some young guys in shorts and tennis shoes and no masks spraying and dont know what they are doing - they do not spray outside hallways, etc. My daughter had to ask him to spray bedrooms-a professional would know what it takes to kill a building infested. BK gets very defensive if they dont like what us, as parents, have to say. When do we have right to stop paying rent and move our kids? Our kids have not lived there since moving in 8/19 so why dont we get credit until ***** problem resolved. Three of the girls live out of state so its not like they can commute.

      We have tried very hard to make things right with these tenants. Once we found out about the roaches we have had someone there spraying. He has gone weekly for the last four weeks. We are contracting another extermination company to go there next week since they think what the current one is doing is not working. We have used a pest control company each time. She asked for their information or what chemicals were being used. I received the *** sheets from them and sent them to her. During all of this we have not heard from the tenants themselves just this parent and one other. This is an outside vendor exterminator that we use, we cannot tell them what to wear. I have attached the *** sheets we received and sent to her. The company is Superior Pest Control. They were there and sprayed every apartment on August 5, 15, and 29th. Also on September 5th. It is recommended to spray every two weeks and we have had them going every week. They have also sprayed some apartments in July when we noticed the issue from the previous tenants move out on July 21st. It was not an issue with just this apartment, unfortunately it was multiple apartments, and we are trying our best to take care of the issue.

      I am not trying to be unreasonable.  I am satisfield that a professional company is now coming out.

      They have not truthful when they said they found out in July - we talked with past tenants and they said BK was notified in April and May of this year and according to them nothing was done .  Our kids should have been notified immediately (as well as all the tenants in the building) that there was a cockroach infestation and let them decide if they wanted to lease the apartment.  I have talked with several tenants and all of them say the same thing..we are students and no one listens to us.  I know that BK has received several complaints for parents of other kids - its just I have gone the extra mile to get it done.  BK mentioned none of the tenants in #2 are addressing this - the thing is...none of these 4 tenants ARE LIVING THERE (one never moved in)  - no one wants to come back to roaches crawling on their walls, their beds, their toilets - and as a parent I am my daughters advocate.  Sorry if I ruffled their feathers - I would hope they would do the same for their child.  There are 3 parents involved - one parent called and spoke with ******, another one is talking with a lawyer and I am writing letters to get something done.  BK would not tell any of us who the company was and not until the Tippecanoe Public ************ got involved - all of a sudden a professional company is coming. 

      ALL I WANT IS THE ROACHES TO BE GONE - I will say ****** has worked with me and I thank her for that so hopefully this new place will get the job done.
