    Momentum title handled the closing on my new home on April 1, 2023. I used some of the proceeds from the sale of my previous home to pay off a ****** credit card. I believe the amount was approximately $1300. To settle this debt, Momentum Title wrote a check to ******* and I promptly mailed the check via regular USPS mail service. I waited about 4 weeks and the check had still not been applied to my ****** account. I contacted Momentum title, and they canceled that check and issued another one. I mailed the second check to ******* this time with tracking number. I tracked the letter, it showed delivered, but again I waited a few weeks, and it was not applied to my account. I ended up paying off the ****** account myself and when I approached Momentum about having the proceeds from the sale of my previous home refunded, they informed me that I needed documentation showing that my ****** account was paid off. I provided proof to Momentum Title and then they informed me that since the account number on my statement did not match what they had on record, they could not refund my proceeds. They advised me to get a statement with the account number that matches what they have on record in order to get the proceeds from the sale of my previous home refunded to me which would be impossible.

    I am rejecting this response because:

    Momentum Title stated in their response to you “He ultimately sent us a statement but the account number did not match the account information provided by the lender. We repeatedly asked for him to provide the correct statement and even involved the lender to assist”. I had only one account with ******. If they recorded an incorrect account number….how on Earth could I ever provide Momentum with a statement containing the incorrect account number? I explained this to Momentum numerous times over the phone and in person. It seems to me they could easily clear this up with a few phone calls or emails….but they seem intent on being obtuse regarding the situation. I’m the victim in this scenario and I’ve provided them with the statement as they stated (the only one I have access to and the only one that had ever existed). They are at fault for recording the incorrect account number. All I want is my money returned, which is rightfully mine.

    I understand his frustration and if the lender authorizes us in writing to release the funds to *** ****** directly, we will do so.  Without that, we must hold the funds and release only to ****** to pay toward the credit card.  The funds are in our escrow account and we are happy to release upon the correct account information from *** ****** or differing instructions from the lender.
